Are ethics promulgations self-defeating?

Alan Wertheimer argues that promulgating some ethical standards of international clinical research may be self-defeating: the intended purpose of these standards is to promote the interests of subjects and communities in LMICs, while the outcome of promulgation could be to undermine these very same interests. If enforced, such standards would increase the costs of performing beneficial research in LMICs, potentially diverting opportunities to participate in this research away from those who have no other access to the care participation allows. I argue that these standards are really intended as deontological constraints protecting subjects from being exploited by research sponsors. First, I show that Wertheimer begs the question against this deontological interpretation of ethics promulgations, rejecting it on non-deontological grounds. I go on to show that non-exploitation is an important goal on its own, sometimes independent from-and sometimes even outweighing-the goal of promoting the interests of subjects and communities in LMICs. I conclude by suggesting that those who criticize the promulgation of non-exploitation on the grounds that exploitative practices help those badly off might do best to reconsider the background assumption that sponsors in wealthier countries have no pre-existing obligation to promote the interests of the world's poor.

This was also increased through the promulgation of legislations that render the practices, which could be accompanied with exposure to ionizing radiations, more safe within a firm legal system that is also backed by promulgating suitable executive regulations. Most Arab countries are keen to promulgate their legislations for regulating the work with ionizing radiations and protection against their dangers. Those legislations usually get their genesis and provisions from the international recommendations as well as from the general legal system of the country. The present work consists of four chapters. The first chapter deals with the definition of legislations for regulating the work with ionizing radiations. Chapter two discusses the international trend to promulgate legislations for protection against ionizing radiations. Regulation of radioactive material can occur at the Federal, State, and sometimes local level. In addition to regulations at the federal and state level, there are guidelines and standards that do not carry the weight of law, yet are often referenced. Neither the Nuclear Regulatory Commission (NRC) or Environmental Protection Agency (EPA) categorically regulates NORM at this time. However, many of the existing regulations and guidelines for licensed radioactive material can be applied by states and other regulatory agencies to NORM. The primary regulations covering radioactive materials and exposures were promulgated under the Atomic Energy Act (AEA) or 1954, as amended. NRC licenses and regulates civilian use of nuclear materials to protect public health and safety and the environment. NRC makes rules and sets standards for licensees and inspects the activities of licensees to insure that they do not violate safety rules. OSHA regulations for worker protection from exposures to radioactivity are contained in 29CFR1910.96. These standards are designed to protect workers from exposure to radiation in programs other than those regulated by OSHA. The Uranium Mill Tailings Control Act, with implementing regulations found in 40CFR192 were promulgated by the EPA for cleanup of uranium mill tailings. These standards are often used by states and other agencies in regulating cleanup of NORM. EPA is currently considering regulation of NORM on NRC and DOE facilities under 40CFR195

Full Text Available We introduce a dynamic model of emotional behavior regulation that can generalize to a wide range of decision dilemmas. Dilemmas are characterized by availability of mutually exclusive goals that a decision maker is dually motivated to pursue. In our model, previous goal pursuant decisions produce negative emotions that regulate an individual’s propensity to further pursue those goals at future times. This emotional regulation of behavior helps explain the non-stationarity and switching observed between so-called “preferences” revealed in repeated decision dilemmas (e.g., by choosing A over B at time 1, then choosing B over A at time 2. We also explain how behavior regulation under dilemma conditions is affected by the set of available options and how the strength and decay rate of emotions affect the tendency to choose behaviors pursuant of extremely (rather than moderately different options over time. We discuss how emotional behavior regulation insights provided by our model can extend to a variety of topics including approach and avoidance, temptation and self-control, moral balancing, impulse buying and shopping momentum, dieting and exercise, work and leisure, sleep regulation, cooperation, and competition.

The “Natural” vs. “Natural Flavors” Conflict in Food Labeling: A Regulatory Viewpoint.

Food branded with a Natural label can be found in any grocery store across the United States. Consumers consider this label to be an important attribute when making a purchasing decision and billions of dollars are spent annually on these products. While many consumers believe Natural foods are healthier, heavy reliance on that assumption is misguided as “Natural” has no formal legal definition—it’s merely defined pursuant to an FDA approved informal policy. Another important health attribute in a consumer’s purchasing decision is the presence of natural flavors in food. However, unlike the term Natural, FDA has promulgated legally binding regulations for natural flavors. These flavors are currently the fourth most common food ingredient listed on food labels. In reality, “natural flavors” are a far cry from what consumers might expect, as they can contain both artificial and synthetic chemicals (often used as processing aids). Nonetheless, without a legally binding Natural regulation, there has been little opportunity to contest the naturalness of natural flavors in the past. Recently, FDA has initiated a notification of request for comments on use of the term Natural, so an attempt to promulgate regulations may be underway. Thus, it is appropriate to consider where natural flavors will fall if binding regulations are set forth. This article looks at the Natural debate, its history, and model regulatory standards worth considering. Within that context, it also provides a critical discussion concerning a misunderstood, yet federally regulated, ingredient that our society so heavily consumes: natural flavors.

After much debate and controversy, the Bush administration announced on April 12, 2001, that it would implement the Health Insurance Portability and Accountability Act (HIPAA) privacy regulations issued by the Clinton administration in December of 2000. The privacy regulations became effective on April 14, 2001. Although the regulations are considered final, the Secretary of the Department of Health and Human Services has the power to modify the regulations at any time during the first year of implementation. These regulations affect how a patient's health information is used and disclosed, as well as how patients are informed of their privacy rights. As "covered entities," physicians have until April 14, 2003, to comply fully with the HIPAA privacy regulations, which are more than 1,500 pages in length. Pursuant to the Hazardous Materials Transportation Act (HMTA), the Department of Transportation (DOT) has promulgated a comprehensive set of regulations regarding the highway transportation of high-level radioactive materials. These regulations, under HM-164 and HM-164A, establish interstate highways as the preferred routes for the transportation of radioactive materials within and through the states. The regulations also provide a methodology by which a state may select alternative routes. First,the state must establish a ''state routing agency,'' defined as an entity authorized to use the state legal process to impose routing requirements on carriers of radioactive material (49 CFR 171.8). Once identified, the state routing agency must select routes in accordance with Large Quantity Shipments of Radioactive Materials or an equivalent routing analysis. Adjoining states and localities should be consulted on the impact of proposed alternative routes as a prerequisite of final route selection. Lastly, the states must provide written notice of DOT of any alternative route designation before the routes are deemed effective

The Title VI Stratospheric Ozone Protection Program of the Clean Air Act (CAA) requires promulgation of regulations to reduce and prevent damage to the earth's protective ozone layer. Regulations pursuant to Title VI of the CAA are promulgated in the Code of Federal Regulations (CFR) at Title 40 CFR, Part 822. The regulations include ambitious production phaseout schedules for ozone depleting substances (ODS) including chlorofluorocarbons (CFCs), hydrochlorofluorocarbons (HCFCs), halons, carbon tetrachloride, and methyl chloroform under 40 CFR 82, Subpart A. The regulations also include requirements for recycling and emissions reduction during the servicing of refrigeration equipment and technician certification requirements under Subpart F; provisions for servicing of motor vehicle air conditioners under Subpart B; a ban on nonessential products containing Class 1 ODS under Subpart C; restrictions on Federal procurement of ODS under Subpart D; labeling of products using ODS under Subpart E; and the Significant New Alternatives Policy Program under Subpart G. This paper will provide details of initiatives undertaken at US Department of Energy (DOE) Oak Ridge Reservation (ORR) Facilities for implementation of requirements under the Title VI Stratospheric Ozone Protection Program. The first section of this document presents the results of a technical workshop on the process of regulations development and amendment sponsored by the Nuclear Regulatory Commission (NRC). This workshop focused on methods for reducing the time it takes to promulgate regulations to help those States that are having difficulty meeting the three-year deadline for adopting new NRC regulations. Workshop participants responded to six questions, reviewed the procedures used by various States for revising and adopting changes to their regulations, and reviewed the time-flow charts used by various States. This workshop was designed to provide guidance to States that are promulgating and revising regulations. The second section of this document summarizes the proceedings of a technical workshop, also sponsored by the NRC, on funding radiation control programs that emphasized fee schedules and effective strategies for the 1990s. This workshop focused on determining the true costs of running a program, on setting realistic fees for the various categories of licenses, and on the most efficient methods for sending invoices, recording receipts, depositing money received, and issuing licenses. Workshop participants responded to seven questions; reviewed the methods various States use to determine true costs; reviewed the procedure that the various States use to produce invoices and licenses; reviewed the procedures that the States are required to abide by when they receive money; and reviewed the method used by the NRC to determine the cost of its various programs

There appears to be no compelling public health protection reason for EPA`s promulgation of NESHAP regulations to control air emissions of radioactive materials from NRC-licensed facilities engaged in activities associated with the practice and development of nuclear medicine. The NRC`s existing regulations provide the necessary controls for protection and EPA`s regulations would only add burdensome reporting requirements at substantial cost to medical treatment and diagnosis. Availability of nuclear medicine practice could be impacted and advancements through research delayed.

The Radiation Act was passed by the Estonian Parliament on 23 Apr 1997 and promulgated by the President on 8 May 1997. It is the principal legal instrument in the field of radiation protection for workers, the public and the environment. The Act is based on the concepts, principles, terminology and dose limits stipulated in the Basic Safety Standards (IAEA Safety Series No. 115-1) and the EC Directive 96/29/EURATOM. The Radiation Act defines the institutional framework for, and establishes the rules applicable to, the use of ionising radiation, the detention of radiation sources, the transport of radioactive materials, radioactive waste disposal and other activities which cause or may cause harm to health or to the environment. It also contains some general provisions on radioactive waste management, import and export of such wastes and the prohibition against importing radioactive waste for disposal purposes. The Act deals solely with radiation protection; all other nuclear activities are to be covered by other specific laws. The Estonian Radiation Protection Centre is empowered under the Act to inspect sources of radiation exposure and to register dose and source data. It is generally responsible for enforcing the provisions of the Act, although the details of the medical checks for radiation workers are governed by rules established by the Minister for Social Affairs. Chapter 3 of the Radiation Act contains detailed provisions on dose limits for the following categories of exposure to ionising radiation. The Act provides that Government and nominated Ministers be empowered to enact implementing regulations on exemption levels, requirements to ensure observance of the stipulated dose limits, qualification procedures for radiation workers, medical checks of radiation workers, medical applications of ionising radiation, packaging and safety procedures for radiation sources and rules for handling radioactive waste

The regulatory act of promulgating REMIT, the Regulation on Wholesale Market Integrity and Transparency, has highlighted the commanding position of both the European Commission and ACER, the Agency for the Cooperation of Energy Regulators, in the regulation of energy affairs in the European Union. Furthermore it has led to major changes in how surveillance is organized at the national level. The first part of this publication is dedicated to the organization of market surveillance following the promulgation of REMIT. It depicts the tasks of the European Commission and ACER in this context. The Regulation has accorded the authorities a central role in managing the European Union's responsibilities with regard to energy wholesale trade. The act of delegating such far-reaching competence to the authorities deserves careful review however. The article shows how, given ACER's lack of practical experience in market surveillance, as well as its lack of human resources, the task of surveilling the European energy wholesale market confronts the agency with a significant challenge. How successfully the EU energy agency will master this challenge will depend on a number of different factors. Stringent requirements will be needed for the data registration offices in order to ensure optimal data processing. National authorities and supervisory bodies should be made to participate in the data monitoring process. ACER's efficiency in surveilling the market will furthermore depend decisively on its IT infrastructure.

An underlying assumption of the partial preemption approach is the belief that minimum federal standards contribute to the prospective decentralization of environmental protection programs by removing or reducing industry incentives to shop around for states with a more lenient regulatory stance. This assumption was examined through a survey of chiev executive officers of pollution-generating firms. The data suggest that corporate officials see regulatory climate as an important component of overhead costs. The International Commission on Radiation Protection (ICRP) has been providing recommendations for limitations on radiation exposure for decades. The ICRP recommendations address ionizing radiation and are concerned with protecting humans from its effects. These recommendations assist regulatory and advisory agencies in establishing and promulgating national regulations and practices in radiation Protection. Most countries have incorporated at least some aspect of the recommendations in their regulations since about 1956 when the first basic prowdon standard was Published in ICRP 2. Since that time ICRP has issued two major revisions to the recommendations. ICRP 26 was published in 1977 and ICRP 60 was published in 1991. These last two publications have companion works, ICRP 30 atid ICRP 61, that contain Annual Limits of Intake (ALI) for radiation workers. Numerous air pollution regulations affecting petroleum refineries recently have been promulgated, have been proposed, or are under consideration at the federal, state, and local level. As shown in Figure ES-1, all of these environmental regulations are intended to take effect over the relatively short time period from 1989 through 1995. In the aggregate these regulatory activities have significant implications for the US refining industry and the Nation, including: Major investment requirements; changes in industry profitability; potential closure of some refineries; and potential changes in crude oil or product import dependence. At issue is whether the cumulative effect of these regulations could so adversely affect the US refining industry that US national security would be affected. In addition to the regulations outlined in Figure ES-1, President Bush recently presented a major new plan to improve the nation's air quality. The aspects of the President's plan that could strongly affect US refineries are summarized below

Since this publication is an updated version of the 1985 Edition of the Transport Regulations, the old IAEA Safety Series style is maintained for the convenience of the user, although the old style has now generally been superseded by a new one. The present 'Regulations on Nuclear Materials Control of the People's Republic of China' were promulgated by the State Council on June 15, 1987, which are enacted to ensure safe and lawful use of nuclear materials, to prevent theft, sabotage, lose, unlawful diversion and unlawful use, to protect the security of the State and the Public and to facilitate the development of nuclear undertakings. The nuclear materials controlled are: 1. Uranium-235 (materials and products); 2. Uranium-233 (material and products); 3. Plutonium-239 (materials and products); 4. tritium (materials and products); 5. lithium-6 (materials and products); 6. Other nuclear materials requiring control. The present regulations are not applicable to the control of uranium ore and its primary products. Radioactive sources are widely used in medicine, in industrial exploration and development, as well as in basic scientific research and education in Madagascar. The ability to use such radioactive materials in these sectors depends on their safe and secure transport both within and between countries. Transport safety of radioactive materials within the country is regulated. The law No. 97-041 on radiation protection and radioactive waste management in Madagascar promulgated in January 1998 and the decree No.2735/94 dealing the transport of radioactive materials promulgated in June 1994 govern all activities related to the transport of radioactive material. This law was established to meet the requirements of the International Basic Safety Standards (BSS, IAEA Safety Series 115). It is not fully consistent with current international standards (GS-R-1). Indeed, in order to enhance the security of radioactive sources, Madagascar has implemented the Code of Conduct and the Guidance on the Import and Export of Radioactive Sources. Faced with delays and denials of shipment of radioactive materials issues, the National Focal Point has been appointed to work with ISC members and the regional networks on the global basis.

The Fernald Environmental Management Project (FEMP) is a former uranium processing facility currently under remediation pursuant to the Comprehensive Environmental Response, Compensation, and Liability Act as amended (CERCLA). Contamination at the FEMP consists of low-level radioactivity, hazardous substances, hazardous wastes and/or mixed wastes. Regulations promulgated under the Resource Conservation and Recovery Act as amended (RCRA) are evaluated as applicable or relevant and appropriate requirements (ARARs) for remediation of the FEMP. Historically, joint CERCLA-RCRA guidance dictated that hazardous waste could not be treated, or moved out of the designated area of contiguous contamination (AOC), without triggering land disposal restrictions (LDRs) or minimum technology requirements (MTRs). To avoid invoking these stringent requirements, in situ capping was chosen as the lower cost remedy at many sites, although on-site disposal and/or treatment of hazardous wastes would have been more protective. The Corrective Action Management Units (CAMUs) and Temporary Units (TUs) Final Rule [58 FR 8658, Vol. 58, No. 29, hereinafter the open-quotes CAMU Ruleclose quotes], promulgated on February 16, 1993, provides facilities regulated under RCRA corrective action authority with greater flexibility to move, treat, and dispose of wastes on site without triggering LDRs or MTRs, thereby encouraging application of innovative technologies and more protective remedies. The waste acceptance criteria for the on-site disposal facility is based on site-specific considerations including the mobility of the contaminants through the underlying site geology and the protectiveness of the engineered liners. Application of the open-quotes CAMU Ruleclose quotes allows for disposition in the on-site facility based on these technical considerations rather than on regulatory classifications

In an effort to resolve underground storage tank (UST) management problems, several states and localities have moved ahead of EPA in the promulgation of UST regulations. Developed independently, these regulations represent different strategies for ensuring compliance: from an extensive set of permitting requirements that allow for the implementation of site-specific control measures to a uniform set of technical and operational requirements that vary according to installation date. For the tank owner, complying with these regulations can be a time-consuming and frustrating endeavor. However, during the course of several environmental audits of similar facilities in different states, useful strategies were observed or developed that enabled facilities to respond more effectively to requirements: these included computerization of files, designation of tank custodians, installation of low-maintenance equipment, and increased use of above-ground tanks. Of special additional interest was the wide variation in costs for similar tank services quoted by both private and government sources. These strategies are coupled with general observations on the efficacy of the various regulatory approaches to provide a field view that may be useful to tank owners and others involved in underground tank management and evaluation

Naturally Occurring Radioactive Material (NORM) was first recognized as a potential problem as long ago as 1904 in the oil fields of Canada. NORM later became an issue in the North Sea oil and gas production facilities in the early 1980's and became more widely recognized in the United States in 1986 during a routine well workover in the state of Mississippi. NORM contamination of oil and gas industry production equipment has since been identified world wide. The United States, including Alaska and the Gulf of Mexico region, the North Sea region, the United Kingdom, Canada, Australia and several Middle Eastern countries have all reported NORM contamination. The purpose of this paper is to discuss some of the international regulations or guidelines that have been promulgated concerning NORM in the oil and gas industry. In Japan, the waste management practice is carried out in accordance with the Waste Disposal Law of 1970. The first rule of infectious waste management was regulated in 1992, and infectious wastes are defined as the waste materials generated in medical institutions as a result of medical care or research which contain pathogens that have the potential to transmit infectious diseases. Revised criteria for infectious waste management were promulgated by the Ministry of Environment in 2004. Infectious waste materials are divided into three categories: the form of waste; the place of waste generation; the kind of infectious diseases. A reduction of infectious waste is expected. The 1972 Robens Report is widely regarded to have provided the underlying rationale for the 'modern' system of occupational health and safety regulation in Britain, embodied in the Health and Safety at Work Act (HSW Act) 1974. The HSW Act advanced a new, more flexible system of regulation, premised on the ideal of self-regulation by industry. This article advances a more nuanced historical understanding of the Report and its ethos-the 'Robens philosophy'-than hitherto developed, situating its assumptions about accidents, regulation and the role of the state in the social, economic and political context of Britain in the 1960s and early 1970s. Highlighting the interaction between these trends and long-established regulatory practices, the article argues that the turn to 'self-regulation' heralded by the Robens Report was highly convincing from a political and regulatory perspective at the time it was promulgated.

Following a six-year effort, a major revision to the Agency's Regulations for the Safe Transport of Radioactive Material (Safety Series No. 6) was issued in 1985. In order to address minor problems with the 1985 Edition of Safety Series No. 6, a panel of experts convened by the International Atomic Energy Agency met from 13 to 17 January 1986. This panel considered minor inconsistencies, omissions or errors that had occurred in the course of preparing the 1985 Edition of Safety Series No. 6, and recommended that two types of change be made. First, changes which will correct errors in the presentation of the text, translation errors (in the French, Russian and Spanish versions of the 1985 Edition), and drafting which failed to express the intent of the panels which reviewed the previous edition of the Regulations; these minor changes are promulgated herewith by the authority of the Director General. Secondly, changes of detail which can only be introduced in accordance with the procedure approved by the Board of Governors on 22 September 1972, which authorizes the Director General to promulgate such changes after giving Governments not less than ninety days' notice and taking into account any comments that they make. Three changes of this second type were recommended by the panel, and were circulated according to the 'ninety-day rule' amendment procedure on 3 February 1986. Those changes which received unanimous support by Member States are included in this Supplement. Corrected text to the 1985 Edition of Safety Series No. 6 (paragraphs, tables, etc.) is provided in this Supplement, and this corrected text supersedes the corresponding portions of the 1985 Edition of Safety Series No. 6.

Exploration activities of U.S.-headquartered petroleum companies have increasingly shifted to international targets, in large part due to excessive environmental regulation. However, governments hosting new exploration venues are promulgating environmental regulations, often based on U.S. EPA regulations, which affect the economics of oil and gas operations. New host-country regulations, combined with a growing worldwide open-quotes green movement,close quotes require the new exploration climate to be evaluated in terms of environmental restrictions on drilling, production, and downstream operations. Is the industry truly fleeing regulation, but destined to dead-end in a never-never land of dwindling opportunity? Or is there hope for a system of reasonable regulations which encourage open-quotes sustainable developmentclose quotes of new petroleum resources? The green movement now places a new burden on trade. Exporters must verify to open-quotes greenclose quotes consumers that their products are open-quotes environmentally friendlyclose quotes, effectively introducing a non-tariff trade restriction. The playing field of international trade is leveled by adaption of US or European-style environmental regulation. THe UNCED conference in Rio has further promoted a system of international environmental regulation which will likely grow stronger as globalization of trade increases. This study reviewed three bodies of current Mine Safety and Health Administration (MSHA) gassy mine regulations, to address whether the Code of Federal Regulations (CFR) Title 30, Part 57 Safety and Health Standards - Metal and Nonmetal Underground Mines, Section 21-Gassy Mines, or Parts 75 Mandatory Safety Standards - Underground Coal Mines, and Part 77 Mandatory Safety Standards - Surface Coal Mines and Surface Work Areas of Underground Coal Mines, are more applicable to a subsurface repository design. Part 57.21 is determined to be most applicable. There are, however, three sections in Parts 75 and 77 which address certain applicable items in greater detail and, therefore, will provide a more conservative design approach in these areas than Part 57.21, and should be incorporated into the basis for design. Waste waters from industrial facilities are often treated at waste water treatment plants and then discharged to streams or rivers, or may be reused. Discharges of pollutants to waterways are regulated under the Clean Water Act, and require a permit. The Resource Conservation and Recovery Act (RCRA) regulates the management of solid wastes. This paper discusses the status of waste water treatment plant discharges and sludges pursuant to RCRA. It concludes that some exceptions to RCRA allow waste water treatment plants to accept dilute solvent mixtures, treat them, and discharge effluent without needing a RCRA permit. If residual sludges do not exhibit a hazardous characteristic, then they may be managed as nonhazardous solid waste. For DOE and other generators of mixed waste (both radioactive and hazardous), this may allow sludges to be managed as low level radioactive waste. (author)

This presentation gave notice of amendments to the Environmental Emergency Regulations, pursuant to section 200 of the 1999 Canadian Environmental Protection Act. At the time of publication, the Regulations required the development and implementation of environmental emergency plans for 174 substances with associated thresholds that, if released to the environment, could harm human health or environmental quality. Substances of concern, including CEPA toxic substances are reviewed regularly by the Environmental Emergencies Division of Environment Canada to determine whether they should be added to the Regulations. An evaluation of substances has been completed and, as a result, 33 new substances have been proposed to be added to the Regulations. Thirty are known CEPA toxics and the other 3 are substances of concern, notably acetic acid, ammonium nitrate and styrene. These substances of concern are considered to pose an unacceptable level of risk from their release and would require environmental emergency planning. This paper also identified the substances from the Chemicals Management Plan that have been evaluated using environmental criteria and have been found to be candidates for possible future addition to the Regulations. The promulgation of the National Primary Drinking Water Regulations (NPDWR) follows specific steps. First, the Advance Notice of Proposed Rule Making (ANPRM) is published. Second, the EPA, as mandated by the SDWA Amendments, proposes maximum contaminant levels (MCLs), (enforceable standards) and maximum contaminant level goals (MCLGs) simultaneously. The Office of Drinking Water developed a six-phase schedule that has attempted to parallel the SDWA-specified deadlines: Phase I - Voltile organic chemicals - July 8, 1987; Phase II - Synthetic organic chemicals and inorganic chemicals - June 1989, microbials and surface water treatment - June 1989, and Lead/copper - December 1988; Phase III - Radionuclides - December 1988; Phase IV - Disinfectants and disinfection by-products - June 1989; Phase V - Other inorganic chemicals, synthetic organic chemicals, and pesticides - June 1989; and Phase VI - 25 additional chemicals - January 199. In selecting contaminants for regulation, the most relevant criteria are (1) potential health risk; (2) ability to detect a contaminant in the drinking water; and (3) occurrence or potential occurrence in drinking water. The regulatory act of promulgating REMIT, the Regulation on Wholesale Market Integrity and Transparency, has highlighted the commanding position of both the European Commission and ACER, the Agency for the Cooperation of Energy Regulators, in the regulation of energy affairs in the European Union. Furthermore it has led to major changes in how surveillance is organized at the national level. The first part of this publication is dedicated to the organization of market surveillance following the promulgation of REMIT. It depicts the tasks of the European Commission and ACER in this context. The Regulation has accorded the authorities a central role in managing the European Union's responsibilities with regard to energy wholesale trade. The act of delegating such far-reaching competence to the authorities deserves careful review however. The article shows how, given ACER's lack of practical experience in market surveillance, as well as its lack of human resources, the task of surveilling the European energy wholesale market confronts the agency with a significant challenge. How successfully the EU energy agency will master this challenge will depend on a number of different factors. Stringent requirements will be needed for the data registration offices in order to ensure optimal data processing. National authorities and supervisory bodies should be made to participate in the data monitoring process. ACER's efficiency in surveilling the market will furthermore depend decisively on its IT infrastructure.

Information Security for Compliance with Select Agent Regulations

The past decade has seen a significant rise in research on high-consequence human and animal pathogens, many now known as “select agents.” While physical security around these agents is tightly regulated, information security standards are still lagging. The understanding of the threats unique to the academic and research environment is still evolving, in part due to poor communication between the various stakeholders. Perhaps as a result, information security guidelines published by select agent regulators lack the critical details and directives needed to achieve even the lowest security level of the Federal Information Security Management Act (FISMA). While only government agencies are currently required to abide by the provisions of FISMA (unless specified as preconditions for obtaining government grants or contracts—still a relatively rare or narrowly scoped occurrence), the same strategies were recently recommended by executive order for others. We propose that information security guidelines for select agent research be updated to promulgate and detail FISMA standards and processes and that the latter be ultimately incorporated into select agent regulations. We also suggest that information security in academic and research institutions would greatly benefit from active efforts to improve communication among the biosecurity, security, and information technology communities, and from a secure venue for exchange of timely information on emerging threats and solutions in the research environment. History and future of genetically engineered food animal regulation: an open request.

Modern biotechnology resulted from of a series of incremental improvements in the understanding of DNA and the enzymes that nature evolved to manipulate it. As the potential impact of genetic engineering became apparent, scientists began the process of trying to identify the potential unintended consequences. Restrictions to recombinant DNA experimentation were at first self-imposed. Collaborative efforts between scientists and lawyers formalized an initial set of guidelines. These guidelines have been used to promulgate regulations around world. However, the initial guidelines were only intended as a starting point and were motivated by a specific set of concerns. As new data became available, the guidelines and regulations should have been adapted to the new knowledge. Instead, other social drivers drove the development of regulations. For most species and most applications, the framework that was established has slowly allowed some products to reach the market. However, genetically engineered livestock that are intended for food have been left in a regulatory state of limbo. To date, no genetically engineered food animal is available in the marketplace. A short history and a U.S.-based genetic engineer's perspective are presented. In addition, a request to regulatory agencies is presented for consideration as regulation continues to evolve. Regulators appear to have shown preference for the slow, random progression of evolution over the efficiency of intentional design.

The Nuclear Regulatory Commission is promulgating regulations specifying the technical criteria fo disposal of high-level radioactive wastes in geologic repositories. The proposed rule was published for public comment in July 1981. Public comments have been received and considered by the Commission staff. The Commission will soon approve and publish a revised final rule. While the final rule being considered by the Commission is fundamentally the same as the proposed rule, provisions have been added to permit flexibility in the application of numerical criteria, some detailed design requirements have been deleted, and other changes have been made in response to comments. The rule is consistent with the recently enacted Nuclear Waste Policy Act of 1982

The Subcommittee on Energy and Power conducted hearings on the administration proposal to revise the process by which nuclear power plants are licensed. The purpose of this proposal is to substantially reduce the amount of time needed to license and construct nuclear powerplants. The bill attempts to encourage the early selection of possible sites by separating the process by which such sites are approved fom the process by which plants are licensed. The bill would dispense with the existing requirement that all hearings be adjudicatory, and instead authorize informal hearings on certain issues, principally those which would be conducted pursuant to the National Environmental Policy Act of 1969. The bill would authorize a State which has established a program, consistent with the criteria contained in the act and regulations promulgated by the Nuclear Regulatory Commission, to determine the environmental acceptability of, and/or the need for, a proposed nuclear plant which would be located within its boundaries. Finally, the bill seeks to encourage the use of standardized design and authorizes the NRC to provide funds to intervenors under certain specified conditions

Full Text Available In the aftermath of the last financial crisis a strong message prevails that ‘something’ has to be changed in the manner global finance is governed. What exactly this ‘something’ entails and what could constitute the ‘common ground’ of anticipated change is more difficult to determine. Many envisage future improvements of global financial governance by evoking deliberative democracy, political equality and cosmopolitanism. As financial regulation is the main instrument through which global finance is shaped and governed nowadays, these principles should then be transmitted to regulatory arrangements. This paper focuses on a new conceptual approach to regulatory and governance issues in global finance, by employing the philosophical idea of cosmopolitanism. It argues that although as a concept, cosmopolitanism cannot mitigate all the flaws attributed to contemporary finance, its development and extension to international financial regulation that is promulgated by institutions of the global financial system, would represent a worthwhile endeavour in making global finance more accountable and just in the eyes of many.

The science Act of 1958 created the Philippine Atomic Energy Commission, presently known as the Philippine Nuclear Research Institute (PNRI), under the Department of Science and Technology (DOST). The PNRI is tasked with the dual role of promotion and control of the peaceful applications of atomic energy. To carry its mandate of regulation and control on the use of raioisotopes in various fields, the PNRI had promulgated and issued specific regulations known as the Code of PNRI regulations. This paper summarizes the activities undertaken by PNRI in the continuing process of review and subsequent revisions of the Code of PNRI regulations and related guidance documents. It highlights proposed modifications in the present regulations in an attempt to adopt the new international basic safety standards, the practical problems and related issues attendant to the implementation of these new standards, among others. In line with the overall objective of PNRI to ensure the safe application of nuclear energy and radiation technology in various fields, the institute conducted a series of regulatory information conferences to provide an opportunity for members of the regulatory staff of the PNRI and licenses to discuss safety initiatives and regulatory issues. This paper will also provide an in-depth assessment of the lessons learned from these conferences which were conducted by sector or by specific applications for a more focused approach, e.g. radiopharmaceuticals, industrial radiography, research, among others. Licensees' feedback on the PNRI regulatory process are presented as part of the overall objective of enhancing the operational experiences of the licensing, review and evaluation group as well as that of inspection, enforcement and compliance. Several proposed initiatives for consideration of the PNRI to further strengthen its regulatory functions are also briefly outlined. (author)

Full Text Available The valuation of assets is a relatively challenging activity as well as a scientific discipline having an impact on the amount of the reported assets and economic result process. The report deals with the issue of valuation of the tangible fixed assets in the accounting entities compiling the financial statements pursuant to the Czech national legislation and in conformity with the requirements of the International Accounting Standards IAS/IFRS and US GAAP. The substantial differences in the definitions and valuation of the tangible fixed assets in these systems have been determined, indicating the impact on the economy of the accounting entity, both at the primary acquisition and as at the day of the closing of books. Attention has also been paid to the possibilities of recording the value decreases and to subsequent expenses. The analysis of legal regulations was completed with the analysis of the financial statements from selected economic entities. As per the international standards, the main difference consists in the possibility of component depreciation of tangible assets or, on the other hand, the possibility of group depreciation, in the differences in valuation in the event of acquisition paid for and of acquisition by one’s own production, and in the possibility to consider the costs of disposal of assets. The subsequent expenses are also construed in a different manner: as per the Czech regulation, they are construed as repairs and maintenance. The substantial difference in comparison with the Czech regulation consists in the possibility of re-valuation of assets upwards as well as the method of actual value determination.

In this paper we shall delineate the current regulatory set-up in Namibia, i.e. legal framework, administrative arrangements for the management of uranium exploration, mining, milling and waste management. Uranium, mining plays a big role on the economy of Namibia. With changing policy worldwide on supply of materials and its assurance, with consequences of worldwide on supply of materials and its assurance and with consequences of the concepts of sustainable development which coupled environmental and economic consideration, industry, people, communities, and governments will realign their future perception and concepts. Environmental considerations in Namibia require that for any major development, such as uranium exploration, environmental safety analysis reports are made which should incorporate community, industrial and government regulatory concerns. Namibia, being a developing country, knows that any new regulations that will consider environmental safety and regard for safe management of uranium wastes will add more pressure on present human resource needs (regulatory enhancement) and financial burden to the existing limited infrastructure. The new regulations should address; the environmental effect on mill tailings which are a result of processing the uranium ore in a mill; heap leaching residues which result from treatment of ore; tailing impoundment; tailing pile and tailing stabilization chemically or physically. From the radiation protection concepts, consideration will be made of the relationship of the new regulations and the current practice of the (ALI) recommended by the ICRP 60 of 1990 released in 1991, vis a vis SS-115 of IAEA for uranium intakes, considering the absence of either Nal or Germanium detector or scintillation/whole body counter in Namibia; implementation of the new regulations will require material and human resources if viable advise and training on regulatory implementation of statutory promulgation are to be enforced. The Food and Drug Administration (FDA) has taken the position that human reproductive cloning falls within its regulatory jurisdiction. This position has been subject to criticism on both procedural and substantive grounds. Some have contended that the FDA has failed to follow administrative law principles in asserting its jurisdiction, while others claim the FDA is ill suited to the task of addressing the ethical and social implications of human cloning. This Article argues, that, notwithstanding these criticisms, the FDA could plausibly assert jurisdiction over human cloning as a form of human gene therapy, an area in which the FDA is already regarded as having primary regulatory authority. Such an assertion would require that the FDA's jurisdiction extend to products affecting future persons, i.e., those not yet born. This Article demonstrates, for the first time, that such jurisdiction was implicit in the enactment of the 1962 Kefauver-Harris Amendments to the Federal Food, Drug, and Cosmetic Act and that the FDA has historically relied on such authority in promulgating regulations for drugs and devices.

The regulation antecedents in nuclear question in Mexico are placed in 1950, with the promulgation of L aw that declares national mining reserves the uranium deposits, thorium and the other substances of which obtains fissionable isotopes that can produce nuclear energy , instrument that stipulated the control of uranium, thorium, as to its it indicated it name, and other fissionable substances, on the part of the state, although they were without a doubt the respective institutions, the National Commission of Nuclear Energy in 1955, and the one of the National Commission of Nuclear Safety and Safeguards (CNSNS) in 1979, those that allowed the development of a prescribed frame in the nuclear and radiological areas. One characteristic of the regulation in radiological protection is the variety in the authorities type that have incidence in the regulation, as a result of the different approaches with which it can be approached. For example, in Mexico normative instruments with content in radiological protection exist and are watched over the Health Secretary, who is oriented to the protection of the patient, their relatives and the medical body; Work and Social Welfare Secretary, with a labor approach; Communications and Transport Secretary, which regulates the transport of nuclear and radioactive materials; Finance and Public Credit Secretary, who regulates the import and export of radioactive materials; Environment and Natural Resources Secretary, which regulates the environment protection; Energy Secretary who has responsibilities inside of the p rescribed law of article 27 constitutional in nuclear matter ; and within the energy sector, the CNSNS that expedite and watch the fulfillment of normative in radiological protection and nuclear safety. The emergence of car-hailing service satisfies the need of public travel in Internet era. Didi—the representative of car-hailing service, provides users with cost-effective service and great travel experience and quickly became the leader in the field of mobile travel depending on its price advantage, market segmentation, fast respond and some other competitive strategies. However, the promulgation of the new car-hailing regulation brings many challenges to Didi. After the new regulation, it is hard for Didi to gap away significantly from its competitors in scale and price. Thus the differentiated service is the competitive focus for all platforms. So there is an urgent need for Didi to do something to make difference, such as improving the interface design of the platform and the process of order allocation, establishing exclusive ‘station’, increasing the interaction between drivers and passengers. By doing so, Didi can reduce the information asymmetry and increase the user engagement and loyalty with high quality service.

The United States Board on Geographic Names was created in 1890 to standardize the use of geographic names on federal maps and documents, and was established in its present form in 1947 by public law. The Board is responsible for geographic name usage and application throughout the federal government and its members must approve a name change or new name before it can be applied to federal maps and publications. To accomplish its mission, the Board has developed principles, policies, and procedures for use in the standardization process. The Board is also responsible legally for the promulgation of standardized names, whether or not these names have ever been controversial, and today this is accomplished by the universal availability of electronic databases for domestic and foreign names. This paper examines the development of Board policies and the implementation of these policies to achieve standardization with a view to relating these policies and activities to questions of standardization or regulation. ?? 2000 by The American Name Society.

Full text: Since the 9.11 terror, strengthening physical protection has been an accelerated trend internationally. IAEA has been requesting that member states implement a strengthened physical protection of nuclear facilities on the basis of threat assessments. In order to cope with this demand, the Korean government promulgated the 'Law for Physical Protection and Radiological Emergency Preparedness (LPPRE)' as a substantial countermeasure against possible threats. Pursuant to LPPRE, which entered into force on February 16, 2004, nuclear enterprisers are obliged to implement an effective physical protection of nuclear materials, get approval for its physical protection system, and be constantly inspected on. The Ministry of Science and Technology (MOST) approved physical protection regulations of 24 domestic facilities operated by 14 enterprisers. National Nuclear management and Control Agency (NNCA) is entrusted with physical protection related duty and has been conducting physical protection inspection on nuclear materials in use, storage and transport. In addition, NNCA has established the methodology of threat assessment that entails organizing the threat assessment working group to develop a design basis threat (DBT). Korea is putting its best efforts to construct the threat assessment system and strengthen domestic physical protection regime in cooperation with competent authorities. (author)

In the second part, specific issues relating to a disqualification pursuant to Section 35 of the German Trade, Commerce and Industry Regulation Act are presented based on various court decisions. This is to show how the German courts interpret the indefinite legal term of 'unreliability'. It is highlighted that the determination of unreliability is a predictive decision rather than a sanctioning of conduct in the past. Moreover, it is pointed out that unreliability always has to be determined in relation to the respective trade.

Concern for health, safety and the environment has grown rapidly during the last two decades. Exploitation of any mineral commodity, including uranium, involves the modification of the surrounding environment. Appropriate regulations governing such activities can assure good practices and minimize possible negative impacts on the environment and the health and safety of the workers and the general public. During the past few years, a number of countries have promulgated new regulations related to uranium exploitation, mining, milling and the related waste management. Recent regulations are stricter in terms of environmental assessment, mitigation, radiation protection and control of waste. The impact of those regulations in developed countries has resulted in better planning of operations, improvement in mine and mill designs and a more efficient approach to tailings management. The Meeting was attended by 25 participants from 17 countries representing government organizations and private industry. This document includes 21 papers presented at the Meeting on new experiences in major uranium producing countries on the subject, past producers, as well as on country where regulations and related regulatory structure are still at the early evolutionary stage. Each of the papers was indexed separately.

1.1. Background Indonesia is a biggest archipelago country with 17,508 islands in 33 provinces. In transportation Indonesia has large number of airports, railways, roadways, waterways, and merchant marines. Since nuclear and radiation utilizations are expanding on whole country, the mobilization of these is usually placed outside of controlled facilities, in the public domain, and often entails movement between countries. The Indonesian Nuclear Energy Regulatory Agency (BAPETEN) is responsible for supervision and also authorization of the transport of radioactive material (TRM). TRM is the specific movement of a radioactive material consignment from origin to destination by public transportation (road or rail, water and air). This study aims to determine whether national regulation is harmonized with international practice in ensuring safety and security of TRM. The finding of this study will provide recommendation for enhancement of regulation on TRM. 1.2. Regulation of TRM in Indonesia Government Regulation (GR) No. 26, 2002 on the Safe Transport of Radioactive Material is implemented pursuant to Act 10, 1997 on Nuclear Energy. This GR was repealed GR 13, 1975 on TRM. The GR 26 consist of 16 chapters and 39 articles, included licensing: authority and responsibilities: packaging: radiation protection programme; training: quality assurance programme: type and activity limit of radioactive materials: radioactive materials with other dangerous properties: emergency preparedness: administrative sanction: and penal provisions.
