This final rule implements provisions of the Patient Protection and Affordable Care Act and the Health Care and Education Reconciliation Act of 2010 (collectively referred to as the Affordable Care Act. This final rule finalizes new Medicaid eligibility provisions; finalizes changes related to electronic Medicaid and the Children's Health Insurance Program (CHIP) eligibility notices and delegation of appeals; modernizes and streamlines existing Medicaid eligibility rules; revises CHIP rules relating to the substitution of coverage to improve the coordination of CHIP coverage with other coverage; and amends requirements for benchmark and benchmark-equivalent benefit packages consistent with sections 1937 of the Social Security Act (which we refer to as ``alternative benefit plans'') to ensure that these benefit packages include essential health benefits and meet certain other minimum standards. This rule also implements specific provisions including those related to authorized representatives, notices, and verification of eligibility for qualifying coverage in an eligible employer-sponsored plan for Affordable Insurance Exchanges. This rule also updates and simplifies the complex Medicaid premium and cost sharing requirements, to promote the most effective use of services, and to assist states in identifying cost sharing flexibilities. It includes transition policies for 2014 as applicable.

The Canada Atlantic Accords signed in 1985 with Newfoundland and Labrador and in 1986 with Nova Scotia facilitate the orderly development of petroleum resources in Canada's Atlantic offshore area. These accords established the Canada-Newfoundland and Labrador Offshore Petroleum Board and the Canada-Nova Scotia Offshore Petroleum Board and made them responsible, on behalf of the federal government and the respective provincial government, for the joint management of petroleum resources in the offshore area. While the federal and provincial governments are responsible for establishing the regime for operational safety and occupational health and safety to be administered by the 2 boards, there is no division of responsibilities between the provincial occupational health and safety regime and the Accord Acts. There is agreement amongst governments that the accord acts should be amended to clarify responsibilities and vest sole authority for occupational health and safety in the accord acts. This document outlined the policy intent of the proposed amendments to the Accord Acts to ground an occupational health and safety regime for the east coast offshore areas in legislation. The document discussed legislation to be amended; governance; and provisions of the occupational health and safety regime. General matters such as the application of the policy, allocation of responsibility and interpretation were also discussed. The general duties of the operators were identified along with specific duties of operators; duties related to transportation; occupational health and safety policy; health and safety management system; codes of practice; notification of accidents; duties of employers; and occupational health and safety program. Compliance and enforcement provisions were also summarized.

The federal and state governments are increasingly focusing on food labeling as a method to support good health. Many such laws are opposed by the food industry and may be challenged in court, raising the question of what is legally feasible. This article analyzes outstanding questions in First Amendment law related to commercial disclosure requirements and conducts legal analysis and policy evaluation for three current policies. These include the Food and Drug Administration's draft regulation requiring an added sugar disclosure on the Nutrition Facts panel, California's proposed sugar-sweetened beverage safety warning label bill, and Vermont's law requiring labels of genetically engineered food to disclose this information. I recommend several methods for policy makers to enact food labeling laws within First Amendment parameters, including imposing factual commercial disclosure requirements, disclosing the government entity issuing a warning, collecting evidence, and identifying legitimate governmental interests. Preventive and/or manipulative practices will be needed to maintain soil's biological, physiochemical, nutritional, and structural health in natural, managed, and disturbed ecosystems as a foundation for food security and global ecosystem sustainability. While there is a substantial body of interdisciplinary science on understanding function and structure of soil ecosystems, key gaps must be bridged in assessing integrated agro-biological, ecological, economical, and environmental efficiency of soil manipulation practices in time and space across ecosystems. This presentation discusses the application of a fertilizer use efficiency (FUE) model for assessing agronomic, economic, ecological, environmental, and nematode (pest) management efficiency of soil amendments. FUE is defined as increase in host productivity and/or decrease in plant-parasitic nematode population density in response to a given fertilizer treatment. Using the effects of nutrient amendment on Heterodera glycines population density and normalized difference vegetative index (indicator of physiological activities) of a soybean cultivar ‘CX 252’, how the FUE model recognizes variable responses and separates nutrient deficiency and toxicity from nematode parasitism as well as suitability of treatments designed to achieve desired biological and physiochemical soil health conditions is demonstrated. As part of bridging gaps between agricultural and ecological approaches to integrated understanding and management of soil health, modifications of the FUE model for analyzing the relationships amongst nematode community structure, soil parameters (eg. pH, nutrients, %OM), and plant response to soil amendment is discussed. The Food and Drug Administration (FDA) is further delaying, until December 1, 2008, the applicability date of a certain requirement of a final rule published in the Federal Register of December 3, 1999 (64 FR 67720) (the final rule). The final rule implements the Prescription Drug Marketing Act of 1987 (PDMA), as modified by the Prescription Drug Amendments of 1992 (PDA), and the Food and Drug Administration Modernization Act of 1997 (the Modernization Act). The provisions of the final rule became effective on December 4, 2000, except for certain provisions whose effective or applicability dates were delayed in five subsequent Federal Register notices, until December 1, 2006. The provision with the delayed applicability date would prohibit wholesale distribution of blood derivatives by registered blood establishments that meet the definition of a "health care entity." In the Federal Register of February 1, 2006 (71 FR 5200), FDA published a proposed rule specific to the distribution of blood derivatives by registered blood establishments that qualify as health care entities (the proposed rule). The proposed rule would amend certain limited provisions of the final rule to allow certain registered blood establishments that qualify as health care entities to distribute blood derivatives. In response to the proposed rule, FDA received substantive comments. As explained in the SUPPLEMENTARY INFORMATION section of this document, further delaying the applicability of Sec. 203.3(q) (21 CFR 203.3(q)) to the wholesale distribution of blood derivatives by health care entities is necessary to give the agency additional time to address comments on the proposed rule, consider whether regulatory changes are appropriate, and, if so, to initiate such changes.

This is a Notice of Construction for the 105-KE Basin Fuel Encapsulation Activity. This Notice of Construction is being submitted to the State of Washington Department of Health pursuant to the Washington Administrative Code, 246-247, ''Radiation Protection--Air Emissions,'' as amended. The encapsulation activity will consist of all of the activities described in Section 1.3 as necessary to complete encapsulation of the fuel elements and sludge contained in the 105-KE Basin. The encapsulation activity will be carried out on the 105-KE Basin floor under a minimum of 3 m (10 ft) of water. The encapsulation activity.includes emptying irradiated fuel elements from the existing canisters stored in the 105-KE Basin, packaging.these fuel elements in new canisters, packaging sludge from previous fuel inventories and the current inventory in new canisters, capping these canisters of fuel elements and sludge, and returning the new canisters to the storage racks in the basin. The empty canisters will be cleaned and crushed underwater. Packaging and disposal of the crushed canisters will take place above the water

Many studies have examined the application of soil amendments, including pH change-induced immobilizers, adsorbents, and organic materials, for soil remediation. This study evaluated the effects of various amendments on trace element stabilization and phytotoxicity, depending on the initial soil pH in acid, neutral, and alkali conditions. As in all types of soils, Fe and Ca were well stabilized on adsorption sites. There was an effect from pH control or adsorption mechanisms on the stabilization of cationic trace elements from inorganic amendments in acidic and neutral soil. Furthermore, acid mine drainage sludge has shown great potential for stabilizing most trace elements. In a phytotoxicity test, the ratio of the bioavailable fraction to the pseudo-total fraction significantly affected the uptake of trace elements by bok choy. While inorganic amendments efficiently decreased the bioavailability of trace elements, significant effects from organic amendments were not noticeable due to the short-term cultivation period. Therefore, the application of organic amendments for stabilizing trace elements in agricultural soil requires further study.

Full Text Available Abstract Background Health warnings labels (HWLs have the potential to effectively communicate the health risks of smoking to smokers and non-smokers, and encourage smokers to quit. This study sought to examine whether non-smokers in China notice the current text-only HWLs and whether they support adding more health information and including pictures on HWLs. Methods Adult non-smokers (n = 1324 were drawn from Wave 4 (September 2011–November 2012 of the International Tobacco Control (ITC China Survey. The proportion of non-smokers who noticed the HWLs, and supported adding more health information and pictures to the HWLs was examined. Additionally, the relation between non-smokers’ demographic characteristics, including whether they had a smoking partner, their number of smoking friends, and noticing the HWLs and support for adding health information and pictures was examined. Because the HWLs changed during the survey period (April 2012, differences between non-smokers who completed the survey before and after the change were examined. Results 12.2% reported they noticed the HWLs often in the last month. The multivariate model, adjusting for demographics showed that respondents with a smoking partner (OR = 2.41, 95% CI 1.42–4.13, p = 0.001 noticed the HWLs more often. 64.8% of respondents agreed that the HWLs should have more information, and 80.2% supported including pictures. The multivariate model showed that non-smokers who completed the survey after the HWLs were implemented (OR = 0.63, 95% CI 0.40–0.99, p = 0.04 were less likely to support adding more health information. The multivariate model showed a significant relation between having a smoking partner and supporting pictorial HWLs (OR = 2.03, 95% CI 1.24–3.33, p = 0.005. Conclusions The findings indicate that the Chinese HWLs are noticed by a minority of non-smokers and that non-smokers strongly support strengthening the Chinese warning labels with more health

The 2010 amendments to the environmental emergency regulations

This presentation gave notice of amendments to the Environmental Emergency Regulations, pursuant to section 200 of the 1999 Canadian Environmental Protection Act. At the time of publication, the Regulations required the development and implementation of environmental emergency plans for 174 substances with associated thresholds that, if released to the environment, could harm human health or environmental quality. Substances of concern, including CEPA toxic substances are reviewed regularly by the Environmental Emergencies Division of Environment Canada to determine whether they should be added to the Regulations. An evaluation of substances has been completed and, as a result, 33 new substances have been proposed to be added to the Regulations. Thirty are known CEPA toxics and the other 3 are substances of concern, notably acetic acid, ammonium nitrate and styrene. These substances of concern are considered to pose an unacceptable level of risk from their release and would require environmental emergency planning. This paper also identified the substances from the Chemicals Management Plan that have been evaluated using environmental criteria and have been found to be candidates for possible future addition to the Regulations. The process used to determine regulated threshold quantities was also described. 5 refs., 5 tabs.

Amending soil with biosolids or livestock manure provides essential nutrients in agriculture. Irrigation with wastewater allows for agriculture in regions where water resources are limited. However, biosolids, manure and wastewater have all been shown to contain pharmaceuticals and personal care products (PPCPs). Studies have shown that PPCPs can accumulate in the tissues of plants but the risk that accumulated residues may pose to humans via consumption of edible portions is not well documented. This study reviewed the literature for studies that reported residues of PPCPs in the edible tissue of plants grown in biosolids- or manure-amended soils or irrigated with wastewater. These residues were used to determine the estimated daily intake of PPCPs for an adult and toddler. Estimated daily intake values were compared to acceptable daily intakes to determine whether PPCPs in plant tissue pose a hazard to human health. For all three amendment practices, the majority of reported residues resulted in hazard quotients plants to concentrations of PPCPs that would not be considered relevant based on concentrations reported in biosolids and manure or unrealistic methods of exposure, which lead to artificially elevated plant residues. Our assessment indicates that the majority of individual PPCPs in the edible tissue of plants due to biosolids or manure amendment or wastewater irrigation represent a de minimis risk to human health. Assuming additivity, the mixture of PPCPs could potentially present a hazard. Further work needs to be done to assess the risk of the mixture of PPCPs that may be present in edible tissue of plants grown under these three amendment practices. Copyright © 2014 Elsevier Ltd. Phosphogypsum (PG) is a waste produced by the phosphate fertilizer industry that has relatively high concentrations of some heavy metals (e.g., Cd, Cr, Cu, Pb, V, and Zn). The present study was conducted to investigate heavy metal contamination in soils and vegetables (tomatoes and green peppers) and to evaluate the possible health risks associated with the consumption of vegetables grown in PG-amended soils. The enrichment factor values indicated that Pb, Cr, Cu, Ni, Zn, and V were depleted to minimally enriched, and Cd was moderately enriched. The pollution load index values indicated that the PG-amended soils were strongly polluted with Cd, moderately polluted with Cr and Ni, and slightly polluted with Pb, Cu, Zn and V. The geo-accumulation index values indicated that the PG-amended soils were uncontaminated with Pb, Cr, Cu, Ni, Zn, V, and moderately contaminated with Cd. The trace metal transfer for Cd, Cr, Pb, and Zn concentrations was below what are considered as acceptable limits ( Pb > Cd > Cr. The biological absorption coefficients in plants are, in order of highest to lowest, Pb > Zn > Cd > Cr, which suggests that Pb is more bioavailable to plants than Cd, Cr, and Zn. Furthermore, this study highlights that both adults and children consuming vegetables (e.g., tomatoes and green peppers) grown in PG-amended soils ingest significant amounts of the metals studied. This study examines the effects of electrokinetic amendments for phytoremediation of mixed contaminated soil where typical silty clay soil was spiked with organic contaminants (naphthalene and phenanthrene) and heavy metal (lead, cadmium and chromium). The contaminated soil was treated with compost and placed in electrokinetic cells, which were seeded with oat plant or sunflower. Thirty days after germination, 25 V alternating current was applied to selected cells using graphite electrodes for 3 h per day. The plants were harvested after a growth period of 61 days. One cell remained unplanted to evaluate the effect of the electric current on the soil, alone. The results confirm a significant reduction of heavy metals and organic contaminants in soil. However, there was no noticeable improvement of heavy metal phytoextraction or PAH degradation due to the application of electric field despite the increase in biomass production by the plants subjected to the electric current. The electric potential application time and frequency are suggested to be increased to have noticeable effects in heavy metal uptake and PAHs degradation.
