The idea of environment protection has found worldwide acceptance and led to the establishment of environmental codes in many countries. Knowledge of the environmental codes of other countries facilitates a better understanding of the strong and weak points of the environmental laws of one`s own country. This because, firstly, the ecological problems of different countries are often similar and, secondly, even good ecological solutions are often still capable of improvement. Furthermore, such knowledge provides a basis for a reciprocal intellectual pervasion of national environmental codes thus facilitating a worldwide exchange of ideas on environmental law. The present work is intended as a contribution to such an exchange. It describes the environmental codes of 22 states whose economic, social, and political situations are comparable to that of Germany. The address delivered by the Federal Minister of the Interior on selected topical issues of environmental policy is published. The study especially probes into the historical roots of German environmental law - not lastly in order to better understand present-day law. It deals with the pre-industrial period, the early industrial period, high industrialization up to 1945, and the development after 1945 in the Federal Republic of Germany and the former German Democratic Republic. - How successful environmental law is not a matter of how many norms for the protection of the environment there are. Important is, rather, to seek a balance between stability and flexibility: This will ensure, on the one hand, that legal environmental protection measures will be sufficiently effective and for a sufficiently long time, and on the other hand, that new ecological insights and technical opportunities are brought to bear. In October 1988, the 7th annual meeting of the German-Brazilian Lawyers' Association took place in the Federal Republic of Germany. With pollution laws being the main subject, a comparative evaluation was given of the two countries' legal situations. A Portuguese contribution was dealing with Amazon economy and ecology as an important Brazilian topic of world-wide interest. A German topic of international concern are environmental impact statements in German development projects. Details are given about practical experiences gained in the application of German pollution laws, in environmental authority matters, and in the application of pollution regulations as part of the new Brazilian Constitution. Evidence for administrative final decision power is the singularity of this particular domain with assessments which require comprehensive expert knowledge. The climate change accelerated the discussion on renewable energies and sharpened the public consciousness for it. This particularly is correct in the case of the use of biomass. However, the power generation and heat generation by transformation of biomass is in a licensing area of conflict between the regulations of the building law, the regulations of the immission prevention, the nature protection and the ground-water protection. Under this aspect, the contribution under consideration reports on the mutual relations between building planning law and immission prevention law according to both material considerations and procedural considerations.

The authoress presents an analysis of the entire range of governmental instruments and measures and their systematic interlacement, as available under the German or the U.S. American law for protection of the environment. This analysis is the basis for the subsequent study aiming at clarifying the legitimacy and the required design of laws and regulations defining crimes and sanctions or penalties in the system of environmental law. The authoress derives a characterisation of legislative intent and mode of application of environmental criminal law which differs from that of the ``classic`` criminal law. Pursuing from this characterisation of legal instruments and methods, and from the framework of governmental action and related alternatives available under U.S. legislation, the authoress explains a number of appoaches recommended for reform and amendment of the current German system of environmental criminal law, which hitherto has shown low efficiency. Dabei werden auch Erfahrungen und Probleme aus anderen Bundeslaendern einbezogen, so aus Brandenburg und Sachsen.
