    Full Text Available The amandement of Article 18 UUD 1945, has brought significant changes in the regional administration. One of the changes associated with  the position of head region, which previously  for this position and for the vice of head region  elected by the Legislative Council, Now it is elected trough election.  Article 18 paragraph (4 UUD 1945 states as follows : " Governor, Regent, and Mayor respectively as head of the provincial government, district, and city elected democratically. " Term " democratically elected " under Article 18 paragraph (4 UUD 1945 is implemented through the provisions of Article 56 paragraph (1 of Law No. 32 of 2004 on Regional Government, which stipulates that all regional heads both governors, regents and mayors elected as a pair of candidates directly by the people. In fact, the provisions of the law apply to all areas without considering the fact different areas , so it has attracted a wide range of issues. Though the constitution does not definitively establish that such electoral procedures. Similarly uniformity to diversity in terms of uniformity of areas including recruitment system or filling the post of regional head felt at odds with the fact of diversity in Indonesia. Keywords : Regional Head; Regional Diversity ABSTRAK Adanya perubahan ketentuan Pasal 18 UUD 1945, telah membawa perubahan yang cukup besar pada penyelenggaraan pemerintahan daerah. Salah satu perubahan itu terkait dengan pengisian jabatan kepala daerah, yang sebelumnya kepala daerah dan wakil kepala daerah dipilih oleh Dewan Perwakilan Rakyat Daerah, saat ini telah diubah dengan cara pemilihan secara demokratis.     Full Text Available Abstract Cooperative identity is at risk with the Act 17 of 2012 on Cooperatives, which relies on the values of capitalism. Capitalism is characterized through the economic activities and financial control by the efforts of large private properies in the sense of the individual and groups, profit oriented, the market economy competition dominant supported by consumerism, and the pricing of labor that follows the market mechanism. As a result, it is importance to make purification of cooperative base on UUD 1945 as set in Art. 33 par. (1, to make clear the principles of constitutionality of cooperatives in Indonesia. The principle of the constitutionality of the cooperative include brotherhood, man as main actors, social welfare oriented, synergy, market driven, shared interests, and mutual interest . Key words: cooperative, constitutionality, brotherhood   Abstrak Jati diri koperasi terancam hilang dengan adanya UU 17 Tahun 2012 tentang Perkoperasian yang menyandarkan pada nilai-nilai kapitalisme. Kapitalisme dicirikan adanya kegiatan ekonomi dan kontrol keuangan oleh usaha-usaha besar milik privat dalam arti orang seorang maupun keluarga, akumulasi laba sebesar-besarnya dalam motif profit (profit oriented, ekonomi pasar persaingan dominan yang ditopang dengan konsumerisme, dan penentuan harga tenaga kerja yang mengikuti mekanisme pasar. Akibatnya diperlukan pemurnian bangun usaha koperasi sebagaimana UUD 1945 mengaturnya dalam Pasal 33 ayat (1 sehingga jelas prinsip-prinsip konstitusionalitas koperasi di Indonesia. Prinsip konstitusionalitas koperasi meliputi berasaskan kekeluargaan, manusia sebagai penentu, berorientasi pada kesejahteraan sosial, kerjasama/sinergi, pasar dikendalikan, kepentingan bersama, dan mutual interest.     konsekuensi yuridis pelaksanaan pengadaan tanah bagi pembangunan untuk kepentingan umum dengan cara jual beli oleh instansi pemerintah dengan pemilik tanah menurut perundang-undangan, membahas cara yang seharusnya dilakukan oleh instansi pemerintah dalam pelaksanaan pengadaan tanah bagi pembangunan untuk kepentingan umum. Hasil penelitian mengenai konsekuensi yuridis pelaksanaan pengadaan tanah bagi pembangunan untuk kepentingan umum dengan cara jual beli sebagaimana diatur dalam UU No. 2 Tahun 2012 tentang Pengadaan Tanah Bagi Pembangunan Untuk Kepentingan Umum, Perpres No. 40 tahun 2014 yang mengakibatkan tanah tersebut menjadi tanah milik pemerintah/pemerintah daerah adalah bertentangan dengan ketentuan yang diatur dalam Pasal 33 ayat (3 UUD 1945 dan ketentuan UUPA No. 5 Tahun 1960. Cara yang seharusnya bagi pembangunan untuk kepentingan umum yang sesuai dengan Pasal 33 ayat (3 UUD 1945 adalah melalui proses pelepasan hak dan/atau pencabutan hak dengan pemberian ganti rugi, seyogyanya besaran ganti rugi tersebut didasarkan pada nilai harga jual beli bukan berdasarkan nilai jual objek pajak.     Full Text Available The Head of Region Election is a means of democracy for the autonomy region in the efforts to implement the local autonomy through the process of decentralization in the political field to manage and take care the government’s matters in the efforts to improve the people’s welfare which is based on the Section 18 Article (4 Basic Constitution 1945 of Republic Indonesia as its constitutional foundation. At the operational level of constitutional base can cause multiple interpretations about the democracy model that can be carried out. Therefore, that decision needs to be taken an amendment so that it results the clarity and firmness of the Head of Region Election stated firmly and elected directly by people. Furthermore, there’s still “debatable” opinion to classify whether head of general election is included in the regional government regime or the public election regime, so that it needs an amendment towards Chapter VIIB about General Election Section 22E Article (2 Basic Constitution 1945 of Republic Indonesia, that’s why to classify the Head of Region into the General Election management together with House of Representative (DPR, Board of Regional Representative (DPD President and Vice President and also Regional House of Representative (DPRD.     Full Text Available Konsep negara dalam praktik ketatanegaraan menurut konstruksi konstitusi terbagi dalam dua kutub yang berlawanan, yaitu negara kesejahteraan (welfare state dan negara liberal (liberal state. Keduanya berbeda, yang pertama menuntut fungsi negara yang kuat dan luas dalam mengatur keadilan ekonomi, sedang yang kedua sebaliknya mempercayakan pada pasar bebas dalam perekonomian, sehingga fungsi negara harus dipinggirkan. Berdasarkan metode penelitian yuridis-sosiologis (socio-legal sesuai Pasal 33 UUD 1945 Pasca amandemen Indonesia menganut konsep negara kesejahteraan. Namun secara sosiologis dalam praktiknya berkecenderungan menganut negara liberal yang tak menyejahterakan rakyat. Tantangan negara kesejahteraan Indonesia adalah negara liberal yang melahirkan sistem ekonomi kapitalis. Pilihan yang tersedia untuk melawan sistem ekonomi kapitalis adalah dengan melakukan aneka usaha politik hukum (legal policy, yakni: Pertama, memfungsikan kembali peran fungsi negara dalam pengaturan dan pengendalian ekonomi. Kedua, memperbesar penghasilan negara melalui pajak dan diimbangi dengan belanja sosial yang tinggi untuk mewujudkan kesejahteraan sosial dan keadilan ekonomi. According to the constitution, the state concept in constitutional practice can be divided into two opposite poles, namely welfare and liberal state. They have different characteristics in which the first concept (welfare state requires a strong and extensive state functions to regulate an economic justice, on the contrary the second concept (liberal state relies on the free market economy which state’s role should be marginalized. Sosio-legal research is used in this article. Based on the Article 33 of Indonesian post constitutional amendment of 1945, Indonesia embraced the concept of welfare state. Yet, the practice sociologically tends to embrace a liberal state that is not suitable with the welfare of the people. There are challenges, in the context of liberal state, faced by Indonesia

    Full Text Available Abstract. As a contest for garnering the trust of the people, an election shall be lawful and legitimate whenever it is conducted in a fair manner. A fair election is a constitutional mandate, explicitly stated in Article 22E point (1 of the 1945 Constitution. However, the Constitution had not provided further guidance on fair election. Consequently, exploring the philosophical base of the fairness of the election will be critical in order to formulate the benchmark of fairness of the election. Furthermore, such benchmark will be referred to in formulating regulations or the technical issues of election organization. By means of conceptual approach, this Excerpt wishes to explore this cause. Based on the studies conducted, the fairness of election as intended by the Constitution is actually based on the concept of fairness and the social justice stated in the Fifth Principles of Pancasila.Abstrak. Sebagai kontestasi memperebutkan kepercayaan rakyat, sebuah pemilu akan sah dan memeroleh legitimasi bila mana ia dilaksanakan secara adil. Pemilu yang adil merupakan salah satu mandat konstitusional yang secara tegas dimuat dalam Pasal 22E ayat (1 Undang-Undang Dasar 1945. Konstitusi tidak memberi panduan lebih jauh ihwal bagaimana sesungguhnya pemilu yang adil. Oleh karenanya, menelurusi landasan filosofis keadilan pemilu menjadi amat penting guna merumuskan ukuran adil atau tidaknya pemilu. Untuk selanjutnya, ukuran itulah yang akan diacu dalam merumuskan aturan maupun teknis penyelenggaraan pemilu. Dengan menggunakan pendekatan konseptual, nukilan ini hendak mendalami hal itu. Berdasarkan hasil kajian yang dilakukan, keadilan pemilu yang dikehendaki konstitusi sesungguhnya dilandaskan pada konsep keadilan sebagai fairness dan keadilan sosial yang termuat dalam Sila Kelima Pancasila.  DOI: 10.15408/jch.v4i2.4098

    Full Text Available The multi-party system is a system that consists of more than two dominant parties. Under the provisions of Article 6 and Article 6A the Constitution NRI 1945 Results Changes in the election of the President and Vice President of the Republic of Indonesia using the direct election system based on the proposals of the political party or coalition of political parties. If if adopted multi-party system, the presidential election will take place on the basis of a compromise between several parties contained therein. This was done because among the party that produced no outright majority. President elected in this way, would not want or desire should always pay attention to political parties that support it. The formulation of the problem is How the Implementation of the System Setup Multi Party in Indonesia? How to Influence System Against Multi Party Presidential Position In the presidential system of government in Indonesia? The research method is a normative juridical approach. Normative juridical approach method used to assess or analyze secondary data in the form of legal materials, especially primary law materials and secondary legal materials. Indonesia adheres to to multi-party presidential system. Multi-party system has been running since 1945 and runs until today even though some time has been changed the system of government. Post-reform, democratic system in Indonesia entered a new era, especially in an election in Indonesia. In a presidential system of government, multi-party system affect the difficulty of candidates for President and vice president produce a majority in the election.

    Full Text Available Cooperatives are one ideological concept of Indonesian economy and stated firmly in constitutional of Republik Indonesia. The growth of cooperatives in Indonesia has complex problems so they are pushed by capitalism power from private companies. Whereas, cooperatives were built as economical blocks in mediating Indonesian people to be more welfare economically. Data from Cooperatives Department, there are significant growth of cooperatives from 2006 to 2010: the active cooperatives are 98.944 up to 124.855. Meanwhile, the unactive cooperatives are 42.382 (2006 to 52.627 (2010, in total amount of 177.482 in 2010. The cooperatives growth is interesting to be research in the future to identify wealth of cooperatives and which area has the most rapid growing of cooperatives.

Implemention of those two principles changes the structure of the state that established the Constitutional Court. This institution known as the guardian of democracy of any process of political democatization and legal policy. The consitutional Court plays an important role in maintaining the state constitution (Constitution 1945. Constitutional Court have an authority to solve dispute elections and general election.     Full Text Available Konstitusi dapat ditafsirkan berbeda-beda oleh masing-masing rezim yang berkuasa termasuk mengenai kekuasaan Presiden. Di Amerika Serikat berkembang pemikiran yang diperdebatkan apakah presiden memiliki kekuasaan yang sifatnya tersirat (implied power dari kekuasaan yang diberikan oleh konstitusinya, dan berkembang executive order sebagai implied power presiden. Undang-Undang Dasar 1945 sebelum perubahan dinilai memberikan kewenangan atau membuka celah tafsir yang besar pada kekuasaan Presiden. Dengan demikian, paradigma perubahan UUD 1945 diantaranya adanya keinginan untuk mengurangi kekuasaan tersebut. Tulisan ini akan membahas apakah UUD 1945 setelah perubahan telah memberikan kekuasaan yang cukup kepada presiden dan apa saja kewenangan yang merupakan turunan langsung dari kekuasaan presiden. Kekuasaan Presiden berdasarkan UUD 1945 juga mempunyai kecenderungan untuk bertambah seiring dengan berkembangnya sistem ketatangaraan bahkan untuk menjalankan pemerintahan, presiden dapat membentuk Peraturan Pemerintah dan Peraturan Presiden selain terlibat secara langsung dalam pembentukan UU dan dapat mengeluarkan Peraturan Pemerintah Pengganti Undang-Undang dalam keadaan kegentingan yang memaksa (emergency law. Kewenangan presiden dalam pembentukan UU, Perpu dan PP secara tegas disebutkan dalam UUD 1945, sedangkan kewenangan pembentukan Perpres menjadi kewenangan yang ditafsirkan dari ketentuan Pasal 4 ayat (1 UUD 1945.

Politik hukum pengelolaanminyak dan gas bumi yang berlaku pada kurun waktu tertentu di Indonesia menyebabkan pengaruhyang berbeda-beda terhadap kesejahteraan sosial yang dicita-citakan. Prespektif penguasaan dan pengusahaankepemilikan energi menjadi semakin kabur, padahal Pasal 33 UUD 1945 telah memberikanbatasan kepemilikan sumber daya alam oleh Negara untuk kesejahteraan rakyat. Karenanya, perlu segeradilakukan reinterpretasi kepemilikan energi secara faktual dan de facto, dalam perkembangan politikhukum minyak dan gas bumi di Indonesia untuk mengembalikan dalam kerangka de jure dan ideal,yang sesuai dengan semangat Pasal 33 UUD 1945 sebagai landasan filosofis politik hukum pengelolaanminyak dan gas bumi. Given that changes in the constitution can not be done easily, then the judicial review in UUD 1945 should not be formulated too limitedly that restricting the organic law to complete and explore the authority that is adaptable to any concrete problem.     Full Text Available The implementation of direct election toward District Head either in province level or regency level gets a constitutional legitimacy through the second amendment of UUD 1945. It is stated that a governor, regent, and mayor are the heads of province, regency, and city who are elected democratically. The understanding of �elected democratically� can be interpreted variously. However, UUD 1945 as the constitutional base regulates everything not in detail, only the outline. Thus, there must be a further explanation with the law as the organic regulation. As it is stated in UUD 1945, the stipulations of the articles in the constitution are implemented with the law as the operational base. So, the authority of constitution will explain the stipulations of the articles. Paying close attention to the role of political party in District Head Election (PILKADA, it needs to be paid attention that anybody who wins in Pilkada must have political debt to the parties that have supported him, so the parties will �explore and exploit� the position of the chosen District Head as the �rice barn�, and it is worried that the chosen District Head cannot act fairly, wisely, do not pay attention on the people�s interest, but tend to be the � instrument� of the political parties that have supported him with the reason as �the debt of honor�. So that effective counseling process, counselors are required to have cultural sensitivity and break away from cultural biases, understand and can appreciate and have skills that are culturally responsive. Communication activities between nations is a consumption activity that occurs between different clients mores, race, language, religion, level of education, social status or even gender. Thus intercultural communication should be by the diplomacy of foreign astudents, a teacher at an international school , social workers and others.To be able to understand more , intercultural communication as well as some that affect communication (1 Comunication approach, (2 Communication barriers between cultures, (3 How can these barriers interfere with communication between cultures. At the time of counseling , the counselor does not deal with the client's culture but also cultural counselor with individual clients.     Full Text Available This article critically and pragmatically analyze and expose the concept and basic principles of caring economics as a new paradigm of economics as opposed to neo-liberal economics and its implications to economic education in Indonesia. The analysis and exposition based on unobtrusive research techniques, i.e. comparative content analysis and historical notes among references used here and in the context of Pancasila and UUD 1945. The implications of the study in this article are formulated into three key recommendations: (a the need to review and operational translation of Articles 33 and 34 of the UUD 1945 (Amendment IV, 2002; (b the need to review the curriculum, learning approaches and tools, and practices of learning economics in schools in order that caring economic becoming educational character of the national economy; and (c the need to campaign of introduction to paradigm and practice of caring economics in the universities, both as an academic study or studies the development of teaching-learning models based on caring economics, through collaboration of higher education, school, community and local government.

Kegiatan pembangunan dengan berbagai aktivitas manusia mempunyai pengaruh langsung terhadap daya dukung lingkungan, sehingga terjadi pergeseran keseimbangan lingkungan dan pemanfaatan sumber daya alam yang tidak proporsional dan tidak efisien, kurangnya kesadaran perusahaan sebagai sektor swasta dalam program pengelolaan lingkungan hidup, menimbulkan permasalahan lingkungan hidup. Lingkungan merupakan bagian yang sangat penting dalam siklus kehidupan manusia. Lingkungan hidup yang baik dan sehat merupakan hak asasi manusia sesuai yang diatur dalam Undang-Undang Dasar Negara Republik Indonesia Tahun 1945 (UUD 1945, dalam Pasal 28H ayat (1 UUD 1945 merumuskan setiap orang berhak hidup sejahtera lahir dan batin, bertempat tinggal, dan mendapatkan lingkungan hidup yang baik dan sehat serta berhak memperoleh pelayanan kesehatan. Semangat otonomi daerah dalam penyelenggaraan pemerintahan Negara Kesatuan Republik Indonesia telah membawa perubahan hubungan dan kewenangan antara Pemerintah dan pemerintah daerah, termasuk di bidang perlindungan dan pengelolaan lingkungan hidup. Bahwa kualitas lingkungan hidup yang semakin menurun telah mengancam kelangsungan perikehidupan manusia dan makhluk hidup lainnya sehingga perlu dilakukan perlindungan dan pengelolaan lingkungan hidup yang sungguh-sungguh dan konsisten oleh semua pemangku kepentingan. Pencemaran merupakan salah satu permasalahan yang timbul akibat perkembangan teknologi tersebut. Untuk menjaga kelestarian fungsi lingkungan hidup, sanksi administrasi dan sanksi pidana merupakan salah satu efek jera guna menjaga kelestarian fungsi lingkungan hidup.

    Observation of exotic resonant structures decaying into $J/\\psi p$ found in the LHCb experiment is discussed. Examination of the $J/\\psi p$ system in $\\Lambda^{0}_{b} \\to J/\\psi K^{-} p$ decays shows two states, each of which must be composed of at least $c \\bar{c} uud$ quarks, and are thus consistent with pentaquarks. The significance of each of these resonances is more than 9 standard deviations. Their masses are ($4 380 \\pm 8 \\pm 29$) MeV and ($4 449.8 \\pm 1.7 \\pm 2.5$) MeV, and their corresponding widths are ($205 \\pm 18 \\pm 86$) MeV, and ($39 \\pm 5 \\pm 19$) MeV. The preferred $J^{P}$ assignments are of opposite parity, with one state having spin 3/2 and the other 5/2.

    Full Text Available Penelitian ini bertujuan untuk menjelaskan kedudukan partai politik lokal Aceh dalam sistem ketatanegaraan Republik Indonesia, secara objektif bagaimana peran partai politik local Aceh dalam mewujudkan demokrasi dan hambatan-hambatan yang timbul dan bagaimana penyelesaiannya. Penelitian ini menggunakan metode empiris yaitu mengumpulkan data primer. Pengumpulan data primer dilakukan dengan mewawancarai responden dan informan yang menjadi sampel pada penelitian ini. Hasil penelitian menunjukkan bahwa kedudukan partai politik local Aceh di dalam sistem ketatanegaraan Republik Indonesia tidak bertentangan dengan perundang-undangan. Hal tersebut diperkuat dengan pasal 18B UUD 1945 yang menjadi dasar pembentukan partai politik lokal di Aceh dan juga berlaku asas di dalam ilmu hukum yaitu Lex Specialis Derogate Lex General yang maksudnya hukum yang bersifat khusus dapat menyampingkan hukum yang bersifat umum, demikian di Aceh juga menerapkan UU yang bersifat khusus.

    Full Text Available We propose and examine a new form of high-density neutral composite of Λ⁎≡K−p=(su¯⊗(uud, which may be called anti-Kaonic Proton Matter (KPM, or simply, Λ⁎-Matter, where substantial shrinkage of baryonic bound systems originating from the strong attraction of the (K¯NI=0 interaction takes place, providing a ground-state neutral baryonic system with a large energy gap. The mass of an ensemble of (K−pm, where m, the number of the K−p pair, becomes larger than m≈10, is predicted to drop down below that of its corresponding neutron ensemble, (nm, since the attractive interaction is further increased by the Heitler–London type molecular covalency as well as by chiral symmetry restoration of the QCD vacuum. Since the seed clusters (K−p, K−pp and K−K−pp are short-lived, the formation of such a stabilized relic ensemble, (K−pm, may be conceived during the Big-Bang Quark Gluon Plasma (QGP period in the early universe. At the final stage of baryogenesis a substantial amount of primordial (u¯,d¯'s are transferred and captured into KPM, where the anti-quarks find places to survive forever. The expected KPM state may be cold, dense and neutral q¯q-hybrid (Quark Gluon Bound (QGB states, [s(u¯⊗uud]m, to which the relic of the disappearing anti-quarks plays an essential role as hidden components. KPM may also be produced during the formation and decay of neutron stars in connections with supernova explosions, and other forms may exist as strange quark matter in cosmic dusts.

    Full Text Available Abstract: In the second trial BPUPKI, both nationalist and Islamic groups consensual that the future of Indonesia's independence will be based on the principle "godhood by running Shari'ah obligation for adherents". The consensus seems to be built on the foundation is not solid. Therefore it is not surprising that one day after the proclamation of independence, the agreement re-questioned. That same day, PPKI held a hearing to review the deal. As a result, the clause contained in the Preamble of the 1945 Constitution was changed to "Based on Belief in God Almighty". After the issuance of a Presidential Decree, began the debate about the existence of the spirit of the Jakarta Charter in 1945 which is applicable in the context of Indonesian politics in this contemporary age.  Abstrak: Spirit Piagam Jakarta dalam Undang-Undang Dasar 1945 Pasca Lahirnya Dekrit Presiden 5 Juli 1959.     The prohibition of books conducted by the government through its apparatus without any due process of law is unfortunate. The Constitutional Court of the Republic of Indonesia (MKRI) in 2010 was decided that book banning is contradictory to the 1945 Constitution (UUD 1945). The purpose of this paper is to know Indonesia, according to the Constitutional Court must absolutely carry out the function of due process of law that is law enforcement in a judicial system when it wants to prohibit printed material which is a book, whether it is a book that is considered criticism and books that teach radicalism. It would be wise for anyone who disagrees with a book, and then responds by writing through a book. The result of this article is to support and suggest that the government and its apparatus in the state of the law should not arbitrarily impose a book ban. Likewise, people should not take violence action to respond this issue. In historical records, the prohibition of books without due process of law is always followed by the withdrawal of books and make people unable to deal with differences, especially in knowledge. That’s why, the government and its apparatus must create a conducive situation and support the creation of various perspectives in the framework of the progress of science through a book. The result of the research shows that philosophically, environmental crime victims should be protected because according to the theory of the law of the welfare state that the country is responsible for citizen’s welfare.     This article aims to analyze the implementation of state obligations and responsibility ensuring the availability of clean water as part of human rights in Karimunjawa islands. The analysis based on principle of the State obligations and responsibility to fulfill their citizen right. Water sources in Karimunjawa Islands is very limited. It depend on forest conservation. Around 9.600 peoples live in Karimunjawa Islands, but Karimunjawa is non groundwater basin region. It means, Karimunjawa doesn't have groundwater potential. The quantity of water depends on the season. The solution to maintain the sustainability of clean water is piping from water reservoir to residential areas. The problem is there are so many hotels in Karimunjawa islands, it disrupted the fulfillment of clean water. Besides utilizing water from reservoir, many hotels drilled the ground to get water. It had impact to the availibity of water in dry season and affected to fulfillment of water supply for Karimunjawa people. There is no specific regulation and policy to solve this problem. Clean water management is doing by Karimunjawa's people. Meanwhile, based on Mahkamah Konstitusi Decree number 85/PUU-XI/2013, state is a rights holder to dominate the water in accordance with the Articles 33 paragraph (2) and (3) UUD NRI 1945, so the government has an obligation to make a policy, regulations, management, and supervision.

    Full Text Available The glory of Aceh Darussalam Kingdom in the past cannot be separated from the complete application of Islamic Sharia (kāffah as the way of life in Aceh. Reflecting the historical past, the implementation of Sharia in Aceh in the present context is absolutely necessary. However, today's enforcement must refer to the three foundations, namely judicial, sociological, and philosophical. The most fundamental of juridical basis is the Constitution of 1945 (UUD 1945 Chapter XI on Religion and paragraph 2 of Article 29, new amendment of Article 18A paragraph 1 and Article 18B paragraph 1. The implementing of Sharia law in Aceh began with the birth law No. 44/1999 regarding the Implementation Features Special of Aceh Province, then refined by law No. 18/2001 on Special Autonomy for Aceh Province as Nanggroe Aceh Darussalam province. Then it is continued by the Law Number 11/2006 on the Governing of Aceh (UUPA. The sociological ground is majority Muslim of Acehnese can receive all the products based on Islamic Sharia law. The philosophical foundation, Islamic law, should be enforced based on the Qur'an and Hadith recommended preserving religion, life, property, lineage, and resourceful.

    Full Text Available In the process of impeachment, Constitutional Court has the obligation to give its judgement to House of Representatives’s opinion regarding allegation of violation by the President and/or Vice President. Constitutional Court checks and judges House of Representatives’s opinion on whether or not the President and/or Vice President works fulfill Article 7A of Constitution of Republic Indonesia 1945 (UUD NRI 1945. The inspection done by Constitutional Court is the judicial process whose decision is in the form of justisil. The result of this impeachment process heavily depends on the judgement of People's Consultative Assembly in its plenary meeting which is also a politics forum, where President and/or Vice President could be dismissed or not. Constitutional Court’s judgement does not apply to People's Consultative Assembly, hence, the difference of Constitutional Court and People's Consultative Assembly’s judgement in plenary meeting that is very political by its nature is very likely to happen. Involvement of Constitutional Court in the procss of impeachment is, of course, different in each country. It depends on governance system in that particular country, it also relies on how much authority that is given by Constitution to Constitutional Court in the process of impeachment itself.

This research tried to answer some  questions:  (1  How is  the adjustment  between cooperation principles and syariah economy cooperation? (2 What is the foundation of law being employed in the operationalization of syariah cooperation  in Bandung?  (3 How is the existence of syariah cooperation in Bandung nowadays?     The study of hypernuclei affords unique insights into the nature of hadronic forces beyond those obtainable from ordinary nuclear physics research. A hypernucleus consists of one or more hyperons bound to a nuclear core. In the SU(3) classification, Λ,Σ, and Ξ hyperons occupy the same octet representation of spin-parity 1/2 + baryons as the neutron and proton, the familiar constituents of ordinary nuclei. The Λ and Σ possess strangeness S = -1 and isotopic spin I = 0, 1, respectively, while the Ξ has S = -2, I = 1/2. In the underlying quark picture, the Λ and Σ have the flavor structure s(ud) I=0, 1 , compared to the combination uud for the proton. The strange quark, s, carries the strangeness quantum number S = -1, which makes it distinguishable from the S = 0 u and d quarks. The lowest-lying hyperon is the Λ, with a mass of 1,115.6 MeV/c 2 , some 177 MeV/c 2 heavier than the proton. The study of the behavior of a hyperon embedded in the nuclear medium, through the theoretical analysis of level spectra, sheds light on the nature of the hyperon-nucleon (YN) effective interaction, i.e. on the role of the strange quark in strong interactions. Pembukaan UUD 1945 alinea 4 menyatakan bahwa Negara bertujuan mencerdaskan kehidupan bangsa. Efektifitas suatu proses pembelajaran secara umum ditentukan oleh kurikulum dan system pendidikan yang diterapkan pada lingkungan  pendidikan tersebut, berkaitan dengan pendidikan yang diterapkan terhadap anak yatim maka diperlukan adanya kurikulum khusus yang dapat menjawab dan mengakomodir kebutuhan seorang anak yatim, baik secara fisik maupun secara spiritual. Penelitian ini dilakukan di Pesantren Yatim Ibnu Taimiyah Bogor dengan audience santri-santri yatim dari jenjang Madrasah Ibtidaiyyah (MI, Madrasah Tsanawiyah (MTs dan Madrasah Aliyah (MA. Secara psikologi anak-anak yatim merasa kehilangan dengan meninggal-nya salah satu orang tua mereka yaitu ayah. Hasil dari penelitian ini menunjukan bahwa hilangnya figur ayah dalam kehidupan mereka mengakibatkan mereka merasa kurang terlindungi sehingga kepribadian mereka cenderung lebih bebas. Diperlukan adanya model pendidikan yang mengarahkan dan membimbing mereka untuk menjadi manusia yang mandiri baik pada saat proses pembelajarannya ataupun hasil dari pembelajaran tersebut. Pendidikan berkarakter Islami yang memberikan pola pembelajaran yang disesuaikan dengan tingkatan umur dan kematangan spiritual menjadi sesuatu yang harus ada bagi pendidikan mereka.

    In the quark model, the proton is described as a system of three quarks UUD. However, recent experiments (CERN, SLAC) have shown that the strange quarks may contribute in a significant way to the mass and the spin of the proton. The HAPPEX experiment gives one further knowledge about the question of the role the strange quarks play inside the proton. It measures parity violating asymmetry in the scattering of polarized electrons from a proton because the latter is sensitive to the contribution of the strange quarks to the electromagnetic form factors of the nucleon. The observed asymmetry is in the order of a few ppm (part per million).     Full Text Available La obra Miray al-s. uud, del alfaquí de Tombuctú Ah. mad Baba (1556-1627, perteneciente a la escuela jurídica malikí, es una fatwà u opinión legal en el marco de la jurisprudencia islámica, que aborda la cuestión de los esclavos negros (sudan que reclamaban la libertad en los mercados del norte de África, por haber sido capturados siendo musulmanes, algo que no está permitido en el islam. De acuerdo con el Derecho islámico clásico, sólo los no musulmanes que no cuenten con la protección de un pacto o del estatuto de lad imma, pueden ser esclavizados. Ah. mad Baba reitera esta doctrina en el Miray, haciendo hincapié en que, de acuerdo con la religión islámica, no existe ninguna relación entre el color de la piel y la esclavitud, y que los negros que habitan el bilad al-sudan (el África occidental premoderna no son esclavos por naturaleza. One feature of the Rule of Law is the existence of human rights in the state administration. Indonesia, since independence on August 17, 1945 has asserted the defense of human rights as stated in the opening clause and in the torso of the 1945 Constitution Article 27-34. In the era of reform, on the Government of President Habibie, the President and the Parliament ratified the UN convention against torture and other cruel, inhuman, or degrading human dignity into Law number 5 of 1998. Then the MPR also publishes the statutes of MPR No. XVII/MPR/1998 on Human Rights, which was followed up with the appearance of Law No. 39 of 1999 on human rights. In accordance with the law in Indonesia based on the sort of Law No. 12 of 2011, the actual products that have been issued by the Government (the MPR, DPR and President that follow up the substance of Human Rights in the Constitution with established Assembly and the law is already correct.   3. High-density kaonic-proton matter (KPM) composed of Λ* ≡ K-p multiplets and its astrophysical connections

    We propose and examine a new form of high-density neutral composite of Λ* ≡K- p = (s u bar) ⊗ (uud), which may be called anti-Kaonic Proton Matter (KPM), or simply, Λ*-Matter, where substantial shrinkage of baryonic bound systems originating from the strong attraction of the (K bar N) I = 0 interaction takes place, providing a ground-state neutral baryonic system with a large energy gap. The mass of an ensemble of (K-p)m, where m, the number of the K- p pair, becomes larger than m ≈ 10, is predicted to drop down below that of its corresponding neutron ensemble, (n)m, since the attractive interaction is further increased by the Heitler-London type molecular covalency as well as by chiral symmetry restoration of the QCD vacuum. Since the seed clusters (K- p, K- pp and K-K- pp) are short-lived, the formation of such a stabilized relic ensemble, (K-p)m, may be conceived during the Big-Bang Quark Gluon Plasma (QGP) period in the early universe. At the final stage of baryogenesis a substantial amount of primordial (u bar , d bar)'s are transferred and captured into KPM, where the anti-quarks find places to survive forever. The expected KPM state may be cold, dense and neutral q bar q-hybrid (Quark Gluon Bound (QGB)) states,[ s (u bar ⊗ u) ud ] m, to which the relic of the disappearing anti-quarks plays an essential role as hidden components. KPM may also be produced during the formation and decay of neutron stars in connections with supernova explosions, and other forms may exist as strange quark matter in cosmic dusts.

Adapun salah satu kebijakan dari Pemerintah yang dianggap tidak mencerminkan nilai-nilai keadilan dan meresahkan bagi masyarakat, yakni kebijakan pemerintah yang melakukan pembiaran atau penundaan dalam penerapan pidana mati. Penelitian ini merupakan penelitian hukum normatif dengan menggunakan pendekatan yuridis normatif. Data yang dikumpulkan adalah data sekunder yang dianalisis dengan menggunakan metode analisis yuridis kualitatif. Berdasarkan hasil penelitian ini dapat ditarik kesimpulan bahwa di dalam penerapan pidana mati terdapat permasalahan hukum yang serius, hal ini dikarenakan kebijakan pemerintah yang melakukan pembiaran atau penundaan dalam eksekusi pidana mati merupakan pelanggaran terhadap hak asasi manusia sebagaimana yang diatur dalam Pasal 28 UUD 1945.   Law enforcement without direction and not based on the three pillars of the justice of the law, legal certainty and the benefits to society can break the law anyway even violate human rights. As one of the policies of the government that do not represent the values of justice and disturbing for the people, the government policy that acts of omission or delay in the application of the death penalty. This research is a normative legal normative juridical approach. The data collected is secondary data were analyzed using qualitative methods juridical analysis. Based on these results it can be concluded that in the application of the death penalty there are serious legal issues, this is due to government policies that commit omission or delay in the execution of the death penalty is a violation of human rights as stipulated in Article 28 of the 1945 Constitution.

Hal ini berarti pihak pencari keadilan dapat mengajukan permohonan hak uji materil di bawah undang-undang kepada MA dengan alasan antara lain ketentuan yang dimohonkan uji materi tersebut bertentangan dengan hirarki peraturan yang lebih tinggi dalam sistem hukum nasional. Dalam pengujian ini, Mahkamah Agung memiliki kesempatan untuk menilai legitimasi (keabsahan dan menentukan apakah peraturan yang diuji telah melampui kewenangan atau tidak sesuai dengan kewenangan. Mahkamah Agung berwenang untuk membatalkan peraturan yang bertentangan dengan hirarki peraturan yang lebih tinggi. Tulisan ini menganalisis kewenangan Mahkamah Agung dalam pengujian peraturan perundang-undangan di bawah undang-undang, dengan melacak sejarah pengujian hak uji materi sebelum diberlakukan PERMA No. 1/1993 sampaidengan diberlakukannya Perma No. 1/2011, termasuk mempelajari beberapa aspek hukum acara dalam Perma tersebut.   Under art 24A(1 of the Constitution, the Supreme Court is granted the power to review legal instruments below laws (undang-undang. This means that an applicant could seek judicial review of regulations other than Acts of Parliament (Undang-Undang with a request to strike it out because, for example, it contravenes national laws. This would provide the courts with an opportunity to review the legitimacy of the regulation and determine whether it is ultra vires, or beyond power. The Supreme Court has the power to cancel a regulation if it is found to be in conflict with a higher law. This article analyses the judicial review in the Supreme Court. It begins by highlighting the origins and formation of judicial review before the regulation promulgation of the Supreme Court (PERMA No. 1/1993, and then examines several aspects of procedural law in the current Supreme Court Regulation in No. 1/2011.

    The recent discovery of two hidden-charm resonances by the LHCb Collaboration in the J/ψp invariant mass distribution denoted as P c , with masses (widths) (4380 ± 8 ± 29) MeV ((205±18±86) MeV) and (4449.8±1.7±2.5) MeV ((39±5±19) MeV), respectively has immediately attracted a lot of attention from the whole community since they could be the long-searching-for pentaquark states in the heavy flavor sector. The high mass and the decay channel J/ψp suggest that these two states must have minimal quark content of cc¯uud, which can be called pentaquark-charmonium states. Soon after the experimental results released, much theoretical effort was paid into this field and many ideas were inspired.There have been several attempted assignments, such as the molecule-like pentaquark states, the diquark-diquark-antiquark type pentaquark states the diquark-triquark type pentaquark states, re-scattering effects, etc. Search for pentaquarks is one of the most challenging theoretical and experimental problems in the physics of strong interaction and quantum chromodynamics (QCD). The last rise and down of the pentaquark study happened at ten years ago due to claim of finding of the strange pentaquark Θ by the LEPS collaboration. But now this topic received serious attention since discovery of P c has rekindled the hope for long searched mysterious pentaquark states

Salah satunya dengan menggalakkan kembali program-program kaderisasi anak-anak pesantren untuk segenap wilayah perhatian bangsa ini ke masa depan, politik, ekonomi, kebudayaan, intelektualitas, dan hukum. BMT sebagai koperasi syari’ah berada di bawah naungan Dinas Koperasi, konsekuensinya , segala aktivitas keuangan yang terjadi dilindungi oleh kebijakan Undang-undang Koperasi. Namun secara faktual keberadaan UU Koperasi justru belum mampu memberikan dasar hukum yang sesuai dengan praktik BMT yang ada. Oleh karenanya pembentukan aturan hukum yang pasti merupakan hal yang tak bisa ditunda lagi mengingat keberadaan BMT kian tumbuh dan semakin berkembang baik dari aspek jumlah maupun permodalannya. Dengan dibatalkannya UU Koperasi No.17 Tahun 2012 maka perlu bagi BMT memiliki aturan hukum tersendiri sebagai payung hukum bagi aktivitas BMT sebab Koperasi dan BMT (yang disejajarkan dengan Koperasi Syari’ah berbeda secara operasional dan prinsip.     Full Text Available Post implementation of UU No. 22/1999 (revised with UU No. 32/2004 about Local Government, recruitment mechanism of Governor and Vice Governor of D I Yogyakarta is being discussed around public opinions. They are polarized into two main groups; first, a group to agree and support recruitment through decision, and second, to agree and support a conventional mechanism of recruitment used in several provinces, namely election. This paper tries to analyze recruitment of Governor and Vice Governor of DI Yogyakarta on the perspective of political ethics. This perspective of analysis is based on two approaches. The first is formal-juridical approach; it means analysis about recruitment of Governor and Vice Governor of DI Yogyakarta and its congruency with the laws, which are valid. And the second is philosophy of power ethics; it includes resources, legitimacy, and implementation of power. Recruitment mechanism of Governor and Vice Governor of DI Yogyakarta finds legal and juridical justification in the positive laws; they are UUD 1945 (Constitution of RI, UU No. 22/1948, UU No. 3/1950, UU No. 5/1974, UU No. 22/1999, and UU No. 32/2004. In the other hand, according to political ethics of Thomas Aquinas about resources, legitimacy, and implementation of power, resources and legitimacy of power during recruitment of Governor and vice Governor of DIY get the right way in ethics manner. They correlate further with implementation of the power. So that, recruitment of Governor and vice Governor of DIY in perspective of political ethics is not merely matter of feudalism or monarchy, but it relates more with a matter of resources, legitimacy and implementation of power. If the power is correctly implemented, the resources and legitimacy will grow up, so does the contrary.

    Penulisan jurnal ini dilatarbelakangi oleh tiga permasalahan. Pertama, permasalahan yuridis yang bisa dicermati dari adanya kekosongan norma. Pasal 292 KUHP hanya merumuskan ancaman pidana bagi pelaku tindak pidana yang melakukan perbuatan cabul terhadap sesama jenis kelamin yang korbannya anak. Kedua, permasalahan teoritis, kejahatan bisa ditafsirkan sebagi mala in se atau perbuatan yang buruk dengan sendirinya, perilaku terlarang yang didasarkan kesepakatan luas tentang tata kelakuakan bagi satu larangan. Ketiga, permasalahan sosiologis yang bisa dicermati dari ditemukannya perbuatan cabul yang dilakukan oleh pasangan sesama jenis kelamin dan penolakan dari mayoritas masyarakat terhadap keberadaan homoseksual. Tujuan penulisan jurnal ini dirumuskan dalam dua rumusan. Kedua: untuk menganalisa dan menjelaskan konsep kebijakan formulasi hukum pidana dalam mengkriminalisasi perbuatan cabul oleh pasangan sesama jenis kelamin di Indonesia. Penulisan jurnal ini menggunakan metode penelitian hukum normatif. Perbuatan cabul yang dilakukan oleh pasangan sesama jenis kelamin perlu dijadikan tindak pidana, pertama: Dasar yuridis, didasarkan pada UU Nomor 11 tahun 2012, Pancasila serta beberapa pasal dalam UUD NRI dan terakhir Pasal 1 ayat (1 KUHP yang mengatur mengenai asas legalitas. Kedua: dasar teoritis, didasarkan bahwa kriminalisasi perbuatan cabul terhadap perbuatan cabul yang di lakukan oleh pasangan sesama jenis kelamin telah memenuhi kriteria umum kriminalisasi yang didukung oleh bentuk teori kriminalisasi, teori hukum alam, positivisme, dan HAM.     Full Text Available Presidential System Government as the result of 1945 Constitution Amandments has not been accomplised yet since its implementation reminds anomaly. President (executive in presidential system has decision authority to produce acts with House of Representatives (DPR, without involving People Council (DPD as one of parlement chambers. To restore DPD legislation role, Constitutional Court Decision No. 91/PUU-X/2012 states that DPD has equal position with DPR and President in acts establishment. It implicates that DPD should be involved since the legislation planning, but still does not have authority to make decision even for bills concerned with its authority. This Constitutional Court brings about the trilateral relationship model in legislation process without any institutional construction towards interchambers relation between DPD and DPR. It will result in Judicial Review despite the involvement of DPD in phase 1 and 2 Process, since this involvement does not bind DPR and President. UU tersebut mewajibkan parpol menggunakan asas Pancasila sebagai asas tunggal dan sampai sekarang dalam UU No. 2 Tahun 2008, dan Undang-Undang No. 2 Tahun 2011 Tentang Partai Politik masih berlaku. Paper ini bertujuan untuk menganalisis undang-undang partai politik yang mewajibkan setiap parpol di Indonesia berideologi Pancasila dan kesesuannya dengan prinsip-prinsip Negara Hukum Indonesia. Metode penelitian yang digunakan adalah metode penelitian yuridis-normatif. Hasil penelitian ini menunjukkan bahwa berdasarkan Pasal 28 UUD 1945 kewajiban Partai politik berideologikan Pancasila merupakan pembatasan hak dan kebebasan sesuai dengan prinsip negara hukum yang berlaku di Indonesia. Ideologi Pancasila pertama kali ditegaskan sebagai satu-satunya asas bagi parpol dalam Ketetapan Nomor II/MPR/1983 dan UU Parpol, dan Golkar Tahun 1985. Hal ini tertera dalam penjelasan Pasal 33 Undang-Undang Dasar 1945 (UUD 1945 yang menempatkan koperasi sebagai saka guru perekonomian nasional serta bagian integral tata perekonomian nasional. Koperasi merupakan lembaga ekonomi strategis yang mampu menjadi penarik dan pendorong seluruh kegiatan ekonomi. Melalui koperasi, masyarakat secara kolektif dan nyata dapat menciptakan dan memperoleh nilai tambah, keuntungan dan kesempatan usaha yang lebih besar. Apabila koperasi masih bertahan dengan pola kelembagaan dan pengelolaan manajemen seperti 20 tahun lalu, maka koperasi tidak akan mampu bersaing. Secara statistik, kondisi koperasi tetap berkembang dari tahun ke tahun, namun kontribusi terhadap perekonomian nasional tidak signifikan. Mengadopsi sistem ekonomi konglomerasi dengan dibentuknya konglomerasi koperasi, berarti mengadopsi model koperasi dengan usaha-usaha besar dan beragam sehingga diharapkan mampu meningkatkan kesejahteraan anggotanya. Mewujudkan konglomerasi koperasi dapat melindungi kepentingan masyarakat lokal di tengah arus globalisasi dan kapitalisme, karena koperasi menjadi organisasi yang modalnya dimiliki oleh anggotanya.     Full Text Available Penelitian ini bertujuan untuk mengetahui berbagai ketentuan peraturan perundangan yang mengatur tentang pemilukada; menganalisis kesesuaian peraturan perundangan tentang pemilukada ditinjau dengan Konstitusi Indonesia (UUD tahun 1945 serta mendapatkan alternatif model pemilukada yang sesuai dengan Konstitusi Indonesia. Penelitian ini termasuk penelitian yuridis normatif dengan teknik pengumpulan data melalui kepustakaan dan dokumentasi menggunakan bahan hukum primer dan sekunder. Hasil penelitian menunjukkan bahwa Pemilihan kepala daerah langsung berdasarkan Undang-Undang Nomor 22 Tahun 2007 tentang Penyelenggara Pemilu dan Undang-Undang Nomor 12 Tahun 2008 tentang Perubahan Kedua Atas Undang-Undang Nomor 32 Tahun 2004 tentang Pemerintahan Daerah telah dimasukkan ke dalam kategori pemilu. Apabila dikaji, maka hal tersebut tidak sesuai  dengan ketentuan Pasal 22E ayat (2 Undang-Undang Dasar Negara Republik Indonesia Tahun 1945 yang menyatakan bahwa pemilihan umum diselenggarakan untuk memilih anggota Dewan Perwakilan Rakyat, Dewan Perwakilan Daerah, Presiden dan Wakil Presiden, dan Dewan Perwakilan Rakyat Daerah. Dalam rumusan Pasal 22E tersebut tidak terdapat rumusan pemilihan umum untuk memilih Kepala Daerah. Pemilihan kepala daerah  langsung bukanlah satu-satunya model demokrasi.     A quiescent single-component gravity-free gas subject to a small steady uniform temperature gradient T, despite being at rest, is shown to experience a drift velocity UD=-D* gradient ln T, where D* is the gas's nonisothermal self-diffusion coefficient. D* is identified as being the gas's thermometric diffusivity alpha. The latter differs from the gas's isothermal isotopic self-diffusion coefficient D, albeit only slightly. Two independent derivations are given of this drift velocity formula, one kinematical and the other dynamical, both derivations being strictly macroscopic in nature. Within modest experimental and theoretical uncertainties, this virtual drift velocity UD=-alpha gradient ln T is shown to be constitutively and phenomenologically indistinguishable from the well-known experimental and theoretical formulas for the thermophoretic velocity U of a macroscopic (i.e., non-Brownian) non-heat-conducting particle moving under the influence of a uniform temperature gradient through an otherwise quiescent single-component rarefied gas continuum at small Knudsen numbers. Coupled with the size independence of the particle's thermophoretic velocity, the empirically observed equality, U=UD, leads naturally to the hypothesis that these two velocities, the former real and the latter virtual, are, in fact, simply manifestations of the same underlying molecular phenomenon, namely the gas's Brownian movement, albeit biased by the temperature gradient. This purely hydrodynamic continuum-mechanical equality is confirmed by theoretical calculations effected at the kinetic-molecular level on the basis of an existing solution of the Boltzmann equation for a quasi-Lorentzian gas, modulo small uncertainties pertaining to the choice of collision model. Explicitly, this asymptotically valid molecular model allows the virtual drift velocity UD of the light gas and the thermophoretic velocity U of the massive, effectively non-Brownian, particle, now regarded as the tracer particle

    Full Text Available Eksistensi hukum pidana adat Indonesia dikaji dari perspektif normatif (ius constitutum diatur Pasal 18 B UUD 1945 hasil Amandemen, Pasal 1, Pasal 5 ayat (3 sub b UU Nomor 1 Drt tahun 1951, Pasal 5 ayat (1, Pasal 10 ayat (1 dan Pasal 50 ayat (1 UU Nomor 48 Tahun 2009. Kemudian secara parsial dalam daerah tertentu seperti Aceh Nangroe Darussalam diatur dalam UU Nomor 44 Tahun 1999, UU Nomor 11 Tahun 2006, berikutnya diimplementasikan dalam bentuk Qanunbaik tingkat Propinsi dan Kabupaten. Berikutnya di Bali diatur dan diimplementasikan dalam bentuk Awig-AwigDesa Adat (Pakraman serta dari perspektif ius constituendumdiatur dalam ketentuan Pasal 2 ayat (1, (2 RUU KUHP Tahun 2012. Kemudian tataran asas diatur Kitab Ciwasasanaatau Kitab Purwadhigama, Kitab Gajahmada, Kitab Simbur Cahaya, Kitab Kuntara Raja Niti, Kitab Lontara ‘ade’dan awig-awig. Selain itu, dikaji dari perspektif teori, praktik dan prosedurnya ditemukan dalam bentuk yurispudensi Mahkamah Agung RI seperti Putusan Mahkamah Agung RI Nomor 42 K/Kr/1966 tanggal 8 Januari 1966, Putusan Mahkamah Agung RI Nomor 275 K/Pid/1983 tanggal 29 Desember 1983 serta penjatuhan sanksi adat (obat adat hakikatnya bersifat untuk pemulihan keseimbangan alam magis, pemulihan alam kosmos guna mengembalikan pada keseimbangan yang terganggu agar bersifat religio magis kembali. Kemudian dalam kajian hukum pidana maka eksistensi hukum pidana adat Indonesia berada pada tataran dogmatik hukum, teori hukum dan filsafat hukum.     peoples Abstrak Air merupakan kebutuhan pokok seluruh makhluk hidup di dunia. Di satu sisi, ketersediaan air yang secara potensial dapat dimanfaatkan manusia, secara kualitas cenderung menurun. Sedangkan kebutuhan manusia akan air sebagai komoditas ekonomi selalu mengalami peningkatan dari waktu ke waktu. Ketidakseimbangan antara ketersediaan dan kebutuhan air inilah kemudian rentan menimbulkan konflik. Konflik sumber daya air tidak hanya terjadi dalam antara masyarakat dengan masyarakat, masyarakat dengan Investor, namun juga antara Masyarakat dengan Negara. Dalam tulisan ini penulis ingin menyoroti tentang kewenangan Negara dalam melakukan pengelolaan sumber daya air termasuk dalam hal menentukan kebijakan-kebijakannya. Kewenangan Negara ini bersumber pada amanat konstitusi UUD 1945 khususnya pasal 33 ayat (3 yang berbunyi: “Bumi dan air, dan kekayaan alam yang terkandung didalamnya dikuasai oleh Negara dan dipergunakan untuk sebesar-besar kemakmuran rakyat”. Pasal tersebut melahirkan konsep dasar Hak Menguasai sumber daya air oleh Negara. Tetapi, sangat dimungkinkan politik hukum yang ditetapkan oleh Pemerintah justru merampas hak ulayat dan hak-hak dasar masyarakat adat yang seyogianya dapat menikmati sumber daya air tersebut. Dalam regulasi lain yaitu UU Nomor 6 Tahun 2014 tentang Desa, Pasal 103 huruf b mengatur kewenangan Desa Adat berdasarkan hak asal-usul yang dimiliki oleh Desa Adat, termasuk pengaturan dan pengurusan ulayat atau wilayah adat mereka. Dalam tulisan ini penulis akan menguraikan pembatasan kewenangan Negara jika dihadapkan pada kewenangan masyarakat adat atas satu objek yang sama yaitu air dalam wilayah adat di Indonesia. Tulisan ini disusun dengan menggunakan metode penulisan yuridis normatif dengan pendekatan konseptual dan analisis.
