The Environmental Protection Agency has issued its first proposed New Source Performance Standards for municipal incinerators in 18 years. EPA's 1971 NSPS set only particulate limits. The new NSPS also sets combustion standards, acid gas and dioxin emission limits, and a materials separation requirement. The latest NSPS, plus proposed emission guidelines for existing facilities, both regulate municipal waste combustors (MWCs) under the Clean Air Act. They both contain new emission limitations for the various pollutants emitted by MWCs, and materials separation requirements. The emission limitations, and the control technologies on which they are based, are different for different size facilities. The proposed regulations also contain operating requirements, testing and record-keeping provisions, and requirements for operator certification and training. The New Source Performance Standards are summarized. The emission guidelines for existing facilities are then described. These include: best demonstrated technology, combustion controls, and materials separation.

As a collaborative and open approach to science, citizen science has the potential make science more actionable, applicable, and usable, especially when designed with scientists, communities and decision-makers as partners. In response to recent interest in citizen science from the US Environmental Protection Agency, the National Advisory Council for Environmental Policy and Technology provided EPA with advice and recommendations on how to integrate citizen science into the core work of EPA. The Council's 28 members—representatives of academia; business and industry; nongovernmental organizations; and state, local and tribal governments—identifies citizen science as an invaluable opportunity for EPA to strengthen public support for EPA's mission and the best approach for the Agency to connect with the public on environmental protection. The report recommends that EPA embrace citizen science as a core tenet of environmental protection, invest in citizen science for communities, partners, and the Agency, enable the use of citizen science data at the Agency, integrate citizen science into the full range of work of EPA. This presentation will outline principles and strategy for integrating citizen science into science and policy at the national level, increasing the usability of citizen science data for decision-making and policy, and leveraging citizen science for environmental protection.

The EPA, under its Federal Guidance authorities, is responsible for advising the President on all matters pertaining to radiation and, through this mechanism, to provide guidance to other Federal agencies on radiation protection matters. Highlights are presented of significant radiation protection activities of all Federal agencies which were completed in 1975, or in which noteworthy progress was made during that period, and those events affecting members of the public. State or local activities are also presented where the effects of those events may be more far-reaching. At the Federal level significant strides have been made in reducing unnecessary radiation exposure through the efforts of the responsible agencies. These efforts have resulted in the promulgation of certain standards, criteria and guides. Improved control technologies in many areas make it feasible to reduce emissions at a reasonable cost to levels below current standards and guides. This report provides information on the significant activities leading to the establishment of the necessary controls for protection of public health and the environment. Radiation protection activities have been undertaken in other areas such as medical, occupational and consumer product radiation. In the context of radiation protection, ancillary activities are included in this report in order to present a comprehensive overview of the events that took place in 1975 that could have an effect on public health, either directly or indirectly. Reports of routine or continuing radiation protection operations may be found in publications of the sponsoring Federal agencies, as can more detailed information about activities reported in this document. The Uranium Mill Tailings Remedial Action (UMTRA) Project involves stabilizing 24 inactive uranium mill tailings piles in 10 states. Remedial work must meet standards established by the US Environmental Protection Agency (EPA). Remedial action must be designed and constructed to prevent dispersion of the tailings and other contaminated materials, and must prevent the inadvertent use of the tailings by man. This report is prepared primarily for distribution to parties involved in the UMTRA Project, including the US Nuclear Regulatory Commission (NRC), and states and tribes. It is intended to record the work done by the DOE since publication of the proposed EPA groundwater protection standards, and to show how the DOE has attempted to respond and react in a positive way to the new requirements that result from the proposed standards. This report discusses the groundwater compliance strategies now being defined and implemented by the DOE, and details the changes in disposal cell designs that result from studies to evaluate ways to facilitate compliance with the proposed EPA groundwater protection standards. This report also serves to record the technical advances, planning, and progress made on the UMTRA Project since the appearance of the proposed EPA groundwater protection standards. In 2001, as directed by the Energy Policy Act of 1992, the United States Environmental Protection Agency (EPA) issued public health and environmental radiation protection standards for the proposed repository at Yucca Mountain, Nevada. Several parties sued the Agency on numerous aspects of the rule. A Federal Court upheld EPA on all counts except for the compliance period associated with the individual-protection standard, which the Agency had limited to 10,000 years for a number of technical and policy reasons. However, the National Academy of Sciences WAS) had recommended that the standard be set for the time of peak risk, within the limits imposed by the long-term stability of the geologic environment, which NAS estimated at 1 million years. EPA's standards required that the Department of Energy (DOE) project doses to the time of peak dose but did not apply a compliance standard to these longer term projections. The Court ruled that EPA's 10,000-year compliance period was inconsistent with the NAS recommendation. This aspect of the rule was vacated and remanded to the Agency for revision. In 2005, EPA proposed amendments to the standards. Following public hearings and a public review period, the final amendments were issued in September 2008. This paper discusses the new requirements. The international metal processing industries are very concerned about the importation of scrap metal contaminated with radioactive materials. When radioactive sources fall out of regulatory control, improper handling can cause serious injury and death. There is no one way to address this problem and various US governmental and industry entities have developed radiation source control programmes that function within their authorities. The US Environmental Protection Agency's (EPA) mission is to protect public health and the environment. To ensure this protection, EPA's approach to orphan sources in scrap metal has focused on regaining control of lost sources and preventing future losses. EPA has accomplished this through a number of avenues including training development, product stewardship, identification of non-radiation source alternatives, physical tagging of sources, field testing of innovative radiation detection instrumentation and development of international best practices. In order to achieve its goal of enhanced control on contaminated scrap metal and orphaned radioactive sources, EPA has forged alliances with the metals industry, other Federal agencies, state governments and the IAEA. The U.S. Environmental Protection Agency (EPA) Endocrine Disruptor Screening Program (EDSP) currently relies on an initial screening battery (Tier 1) consisting of five in vitro and six in vivo assays to evaluate a chemical's potential to interact with the endocrine system. Chemical companies may request test waivers based on Other Scientifically Relevant Information (OSRI) that is functionally equivalent to data gathered in the screening battery or that provides information on a potential endocrine effect. Respondents for 47 of the first 67 chemicals evaluated in the EDSP submitted OSRI in lieu of some or all Tier 1 tests, seeking 412 waivers, of which EPA granted only 93. For 20 of the 47 chemicals, EPA denied all OSRI and required the entire Tier 1 battery. Often, the OSRI accepted was either identical to data generated by the Tier 1 assay or indicated a positive result. Although identified as potential sources of OSRI in EPA guidance, Part 158 guideline studies for pesticide registration were seldom accepted by EPA. The 93 waivers reduced animal use by at least 3325 animals. We estimate 27,731 animals were used in the actual Tier 1 tests, with additional animals being used in preparation for testing. Even with EPA's shift toward applying 21st-century toxicology tools to screening of endocrine disruptors in the future, acceptance of OSRI will remain a primary means for avoiding duplicative testing and reducing use of animals in the EDSP. Therefore, it is essential that EPA develop a consistent and transparent basis for accepting OSRI. © 2013 Wiley Periodicals, Inc.

An Environmental Protection Agency (EPA) recommendation for extensive changes to the Agency's 40-year-old Worker Protection Standard is currently stalled in the "proposed rule" stage. The proposal, which was available for public comment until 18 August, would improve safety, training, and hazard communication policies for agricultural pesticides. Exposure to hazards, including high heat, heavy machinery, stoop labor, and pesticides, makes occupational illness uncommonly common among the USA's estimated 2.5 million farm workers. To consider the proposed revisions' likelihood of addressing historical gaps in farmworker protection. The proposal was compared to the existing Worker Protection Standard, and key aspects were analyzed in relation to existing science on farm labor hazards, as well as historic occupational health, labor and immigration policy. US law historically has left farm workers largely unprotected. These exclusions and delays have been tolerated in part thanks to the myth of the independent family farmer, but more significant is the stingy nativism that presumes to benefit from immigrant labor without assuming any responsibility to protect the humans who provide it. In the first half of the 1970s, workers lobbied for robust protections, but rule making was impeded by lack of data and by the disproportionate influence of agricultural employers who sought minimal regulation. In 1974, the EPA passed the first Worker Protection Standard for farm workers. Key aspects of the proposed revision include stronger protections against drift and re-entry exposures, better information provision and training, and increased protections for workers under 16 years. The proposed changes represent an improvement over existing legislation, but do not go far enough. The revision should be strengthened along lines suggested by farm workers themselves, and other labor laws must also be amended to give the men, women, and children who work in the fields of this country full

We explore and contextualize changes at the Environmental Protection Agency (EPA) over the first 6 months of the Trump administration, arguing that its pro-business direction is enabling a form of regulatory capture. We draw on news articles, public documents, and a rapid response, multisited interview study of current and retired EPA employees to (1) document changes associated with the new administration, (2) contextualize and compare the current pro-business makeover with previous ones, and (3) publicly convey findings in a timely manner. The lengthy, combined experience of interviewees with previous Republican and Democratic administrations made them valuable analysts for assessing recent shifts at the Scott Pruitt-led EPA and the extent to which these shifts steer the EPA away from its stated mission to "protect human and environmental health." Considering the extent of its pro-business leanings in the absence of mitigating power from the legislative branch, we conclude that its regulatory capture has become likely-more so than at similar moments in the agency's 47-year history. The public and environmental health consequences of regulatory capture of the EPA will probably be severe and far-reaching.

EPA Method Study 12, Cyanide in Water reports the results of a study by EMSL-Cincinnati for the parameters, Total Cyanide and Cyanides Amendable to Chlorination, present in water at microgram per liter levels. Four methods: pyridine-pyrazolone, pyridine-barbituric acid, electrode and Roberts-Jackson were used by 112 laboratories in Federal and State agencies, municipalities, universities, and the private/industrial sector. Sample concentrates were prepared in pairs with similar concentrations at each of three levels. Analysts diluted samples to volume with distilled and natural waters and analyzed them. Precision, accuracy, bias and the natural water interference were evaluated for each analytical method and comparisons were made between the four methods.

The Integrated Risk Information System (IRIS) of the U.S. Environmental Protection Agency (EPA) has an important role in protecting public health. Originally it provided a single database listing official risk values equally valid for all Agency offices, and was an important tool for risk assessment communication across EPA. Started in 1986, IRIS achieved full standing in 1990 when it listed 500 risk values, the effort of two senior EPA groups over 5 years of monthly face-to-face meetings, to assess combined risk data from multiple Agency offices. Those groups were disbanded in 1995, and the lack of continuing face-to-face meetings meant that IRIS became no longer EPA's comprehensive database of risk values or their latest evaluations. As a remedy, a work group of the Agency's senior scientists should be re-established to evaluate new risks and to update older ones. Risk values to be reviewed would come from the same EPA offices now developing such information on their own. Still, this senior group would have the final authority on posting a risk value in IRIS, independently of individual EPA offices. This approach could also lay the groundwork for an all-government IRIS database, especially needed as more government Agencies, industries and non-governmental organizations are addressing evolving risk characterizations. The US Environmental Protection Agency`s (EPA) proposed rule to certify that the Waste Isolation Pilot Plant (WIPP) meets compliance with the long-term radiation protection standards for geologic repositories (40CFR191 Subparts B and C), is one of the most significant milestones to date for the WIPP project in particular, and for the nuclear waste issue in general. The Environmental Evaluation Group (EEG) has provided an independent technical oversight for the WIPP project since 1978, and is responsible for many improvements in the location, design, and testing of various aspects of the project, including participation in the development of the EPA standards since the early 1980s. The EEG reviewed the development of documentation for assessing the WIPP`s compliance by the Sandia National Laboratories following the 1985 promulgation by EPA, and provided many written and verbal comments on various aspects of this effort, culminating in the overall review of the 1992 performance assessment. For the US Department of Energy`s (DOE) compliance certification application (CCA), the EEG provided detailed comments on the draft CCA in March, 1996, and additional comments through unpublished letters in 1997 (included as Appendices 8.1 and 8.2 in this report). Since the October 30, 1997, publication of the EPA`s proposed rule to certify WIPP, the EEG gave presentations on important issues to the EPA on December 10, 1997, and sent a December 31, 1997 letter with attachments to clarify those issues (Appendix 8.3). The EEG has raised a number of questions that may have an impact on compliance. In spite of the best efforts by the EEG, the EPA reaction to reviews and suggestions has been slow and apparently driven by legal considerations. This report discusses in detail the questions that have been raised about containment requirements. Also discussed are assurance requirements, groundwater protection, individual protection, and an evaluation of EPA`s responses to EEG`s comments.

During the 15 years that the U.S. Environmental Protection Agency (EPA) has supported university-based research centers, there have been many changes in mission, operating style, funding level, eligibility, and selection process. Even the definition of the term {open_quotes}research center{close_quotes} is open to debate. Shifting national priorities, political realities, and funding uncertainties have powered the evolution of research centers in EPA, although the agency`s basic philosophy on the purpose and value of this approach to research remains essentially unchanged. Today, EPA manages 28 centers, through the Office of Exploratory Research. These centers are administered under three distinct programs. Each program has its own mission and goals which guide the way individual centers are selected and operated. This paper will describe: (1) EPA`s philosophy of reserach centers, (2) the complicated history of EPA research centers, (3) coordination and interaction among EPA centers and others, (4) opportunities for collaboration, and (5) plans for the future.

Over the last 30 years the US Environmental Protection Agency (EPA) has conducted field, laboratory, and scientific literature studies on a variety of technologically enhanced naturally occurring radioactive materials. In doing so, EPA has recognized that the physical and chemical characteristics of these wastes and products can vary significantly, and the Agency is conducting detailed evaluations of these radioactive materials on an industry-by-industry basis. An example of the Agency's current efforts to characterize and assess the risks of these materials from the uranium mining industry in a technical report is presented along with information on EPA's current field and laboratory studies. The U.S. Environmental Protection Agency (EPA) issued its draft scientific integrity policy on 5 August. The draft policy addresses scientific ethical standards, communications with the public, the use of advisory committees and peer review, and professional development. The draft policy was developed by an ad hoc group of EPA senior staff and scientists in response to a December 2010 memorandum on scientific integrity from the White House Office of Science and Technology Policy. The Health Physics Society (HPS) provided comment to the U.S. Environmental Protection Agency (EPA) on options to consider when developing an action plan for President Trump's Executive Order to evaluate regulations for repeal, replacement, or modification. The HPS recommended that the EPA reconsider their adherence to the linear no-threshold (LNT) model for radiation risk calculations and improve several documents by better addressing uncertainties in low-dose, low dose-rate (LDDR) radiation exposure environments. The authors point out that use of the LNT model near background levels cannot provide reliable risk projections, use of the LNT model and collective-dose calculations in some EPA documents is inconsistent with the recommendations of international organizations, and some EPA documents have not been exposed to the public comment rule-making process. To assist in establishing a better scientific basis for the risks of low dose rate and low dose radiation exposure, the EPA should continue to support the "Million Worker Study," led by the National Council on Radiation Protection and Measurement.

The US Environmental Protection Agency's (EPA) proposed rule to certify that the Waste Isolation Pilot Plant (WIPP) meets compliance with the long-term radiation protection standards for geologic repositories (40CFR191 Subparts B and C), is one of the most significant milestones to date for the WIPP project in particular, and for the nuclear waste issue in general. The Environmental Evaluation Group (EEG) has provided an independent technical oversight for the WIPP project since 1978, and is responsible for many improvements in the location, design, and testing of various aspects of the project, including participation in the development of the EPA standards since the early 1980s. The EEG reviewed the development of documentation for assessing the WIPP's compliance by the Sandia National Laboratories following the 1985 promulgation by EPA, and provided many written and verbal comments on various aspects of this effort, culminating in the overall review of the 1992 performance assessment. For the US Department of Energy's (DOE) compliance certification application (CCA), the EEG provided detailed comments on the draft CCA in March, 1996, and additional comments through unpublished letters in 1997 (included as Appendices 8.1 and 8.2 in this report). Since the October 30, 1997, publication of the EPA's proposed rule to certify WIPP, the EEG gave presentations on important issues to the EPA on December 10, 1997, and sent a December 31, 1997 letter with attachments to clarify those issues (Appendix 8.3). The EEG has raised a number of questions that may have an impact on compliance. In spite of the best efforts by the EEG, the EPA reaction to reviews and suggestions has been slow and apparently driven by legal considerations. This report discusses in detail the questions that have been raised about containment requirements. Also discussed are assurance requirements, groundwater protection, individual protection, and an evaluation of EPA's responses to EEG's comments

The Environmental Protection Agency (EPA) is currently developing standards for the management, storage, and disposal of Low-Level Radioactive Waste (LLW). The Atomic Energy Act delegated EPA, among other provisions, the authority to establish generally applicable standards for the disposal of radioactive waste to ensure that the public and the environment are adequately protected from potential radiation impacts. As an initial effort to open communications on a standard for LLW, the Agency developed a preproposal draft (Preproposal Draft of 40 CFR Part 193 - 30 Nov 94) and circulated it to interested parties for review and comment. The extended comment period ended April 12, 1995. A summary of the comments received and analyzed to date follows. After all comments have been analyzed, the rule will undergo an Agency clearance process and be sent to the Office of Management and Budget for review. After that review, the formal process of publication of the proposed rule in the Federal Register and the formal public comment period will begin

This paper describes the changes to the waste characterization (WC) approval process proposed in August 2002 by the U.S. Environmental Protection Agency (EPA or the Agency or we). EPA regulates the disposal of transuranic (TRU) waste at the Waste Isolation Pilot Plant (WIPP) repository in Carlsbad, New Mexico. EPA regulations require that waste generator/storage sites seek EPA approval of WC processes used to characterize TRU waste destined for disposal at WIPP. The regulations also require that EPA verify, through site inspections, characterization of each waste stream or group of waste streams proposed for disposal at the WIPP. As part of verification, the Agency inspects equipment, procedures, and interviews personnel to determine if the processes used by a site can adequately characterize the waste in order to meet the waste acceptance criteria for WIPP. The paper discusses EPA's mandate, current regulations, inspection experience, and proposed changes. We expect that th e proposed changes will provide equivalent or improved oversight. Also, they would give EPA greater flexibility in scheduling and conducting inspections, and should clarify the regulatory process of inspections for both Department of Energy (DOE) and the public

The Environmental Protection Agency (EPA) Office of Superfund Remediation and Technology Innovation (OSRTI) and the Nuclear Regulatory Commission (NRC) are responsible for implementing the 'Memorandum of Understanding Between the Environmental Protection Agency and the Nuclear Regulatory Commission: Consultation and Finality on Decommissioning and Decontamination of Contaminated Sites'. This paper provides a brief overview of the origin of the Memorandum of Understanding (MOU), the major features of the MOU, and how the MOU has been implemented site specifically. EPA and NRC developed the MOU in response to direction from the House Committee on Appropriations to EPA and NRC to work together to address the potential for dual regulation. The MOU was signed by EPA on September 30, 2002 and NRC on October 9, 2002. The two agencies had worked on the MOU since March 2000. While both EPA and NRC have statutory authority to clean up these sites, the MOU provides consultation procedures between EPA and NRC to eliminate dual regulation. Under the MOU, EPA and NRC identified the interactions of the two agencies for the decommissioning and decontamination of NRC-licensed sites and the ways in which those responsibilities will be exercised. Except for Section VI, which addresses corrective action under the Resource Conservation and Recovery Act (RCRA), this MOU is limited to the coordination between EPA, when acting under its CERCLA authority, and NRC, when a facility licensed by the NRC is undergoing decommissioning, or when a facility has completed decommissioning, and the NRC has terminated its license. EPA believes that implementation of the MOU between the two agencies will ensure that future confusion about dual regulation does not occur regarding the cleanup and reuse of NRC-licensed sites. NRC and EPA have so far exchanged MOU consultation letters on eight NRC-licensed sites. EPA has responded to each consultation request with a letter expressing its views on actions

The United States Environmental Protection Agency's (US EPA) digital science "enterprise" plays a critical role in US EPA's efforts to achieve its mission to protect human health and the environment. This enterprise is an evolving cross-disciplinary research and development construct, with social and institutional dimensions. It has an active development community and produces a portfolio of digital science products including decision support tools, data repositories, Web interfaces, and more. Earth sciences and sustainable development organizations from around the world - including US government agencies - have achieved various levels of success in taking advantage of the rapidly-evolving digital age. Efficiency, transparency and ability to innovate are tied to an organization's digital maturity and related social characteristics. Concepts like participatory web, data and software interoperability, global technology transfer, ontological harmonization, big data, scaling, re-use and open science are no longer "new and emerging." They have emerged and - in some cases - are tied to US government directives. We assess maturity, describe future scenarios, discuss new initiatives and outline steps for better leveraging the information age to more effectively and efficiently achieve US EPA's mission. All Federal agencies must consider the financial impacts of their regulations. When costs significantly outweigh benefits, the Office of Management and Budget can recommend that Congress not provide the funds needed to implement the regulation. Without funds, the agency is forced to either revise or retract the regulation. This has happened previously with a regulation on uranium mill tailings proposed by the US Nuclear Regulatory Commission (NRC) and it could happen again with the US Environmental Protection Agency (EPA) regulations that govern the disposal of high-level radioactive waste (HLW). The EPA (1985, 1992) claims that its regulation: ''Environmental Standards for the Management and Disposal of Spent Nuclear Fuel, High-Level and Transuranic Radioactive Waste'' (40 CFR Part 191 or standards) does not increase costs above what the US Department of Energy (DOE) would spend anyway or, at most, what the DOE would spend to comply with 10 CFR Part 60: a regulation promulgated by the NRC. This report reviews and disputes the EPA claim. In Chapter 2 a summary of the basis for the EPA claim is presented and in Chapter 3 a critique of the basis of the claim is presented. This critique finds the EPA basis unrealistic, incomplete, and misleading. According to the EPA, a repository at Yucca Mountain would easily meet 40 CFR Part 191 even without the use of special engineered barriers. Because the NRC regulation (10 CFR Part 60) requires engineered barriers, the EPA places the onus for regulatory costs on the NRC. We disagree; the EPA standards drive regulatory costs as much as NRC regulations. The EPA has the higher responsibility for setting the overall standard for safety while the NRC can only implement this standard

The U.S. Environmental Protection Agency (EPA or the Agency) developed environmental standards for the disposal of defense-related transuranic wastes for the U.S. Department of Energy's (DOE or the Department) Waste Isolation Pilot Plant (WIPP). EPA implements these standards for WIPP, which has been in operation for over ten years. The general environmental standards are set forth in the Agency's 40 CFR Part 191 Environmental Radiation Protection Standards for the Management and Disposal of Spent Nuclear Fuel, High-Level and Transuranic Radioactive Wastes [1]. These standards are implemented by site-specific compliance criteria [2]. The WIPP Land Withdrawal Act requires DOE to submit a re-certification application every five years after the initial receipt of waste. DOE submitted the latest WIPP re-certification application in March 2009. For re-certification, DOE must identify changes that have occurred over the previous five years and analyze their impact on the potential long-term performance of the repository. Once EPA determines that the re-certification application is complete, the Agency has six months to review the application and make a final decision. During this review, EPA solicits and incorporates public comment where appropriate. During the first re-certification in 2004, several stakeholder groups brought up issues (e.g., karst) that were addressed in the original certification. EPA has received comments again raising some of these same issues for the 2009 re-certification. In addition, DOE must submit proposed changes to the WIPP repository to EPA for review and approval. This paper describes selected issues of concern to WIPP and highlights interactions between EPA as the regulatory authority and DOE as the implementing organization. In general EPA's experience points out the importance of communication, documentation and the regulator's responsibility in determining 'how much is enough'. (authors)

This study examines the increasingly active participation of courts in the administrative process as well as agency responses to court-imposed policy shifts. More specifically, it is an investigation of the interaction between the federal courts, primarily the Supreme Court and the District of Columbia Court of Appeals, and two federal regulatory agencies, the Nuclar Regulatory Commission and the Environmental Protection Agency. There are five objectives to the study. The first is to examine the natura of court-agency interaction and to determine the extent to which patterns of judicial review of administrative actions can be discerned. The second is to examine the effect of court orders on agency programs and policies. The third is to assess the anticipatory dimension of court-agency relations. The fourth is to inquire into the recurring dimension of court-agency interaction and to determine its effect on subsequent court decisions. The last is to assess the institutional capacity of courts to deal with scientific and technological issues. This study indicates that judicial review has a substantial effect on the NRC's and the EPA's decision-making activities. Few, if any, recent major policy decisions of the two agencies have not been scrutinized closely by federal appellate courts. During the past decade, the courts have blocked policy initiative on numerous occasions and have been the primary source of change in others. In addition, the mere anticipation of judicial review was found to be a factor motivating the two agencies to make reasoned decisions

The Environmental Protection Agency (EPA) is concerned with radionuclide aerosol sampling primarily at Department of Energy (DOE) facilities in order to insure compliance with national air emission standards, known as NESHAPs. Sampling procedures are specified in {open_quotes}National Emission Standards for Emissions of Radionuclides other than Radon from Department of Energy Sites{close_quotes} (Subpart H). Subpart H also allows alternate procedures to be used if they meet certain requirements. This paper discusses some of the mission differences between EPA and Doe and how these differences are reflected in decisions that are made. It then describes how the EPA develops standards, considers alternate sampling procedures, and lists suggestions to speed up the review and acceptance process for alternate procedures. The paper concludes with a discussion of the process for delegation of Radionuclide NESHAPs responsibilities to the States, and responsibilities that could be retained by EPA.

Environmental protection in the United States has reached a critical juncture. It has become clear that to address the complex and interrelated environmental challenges we face, we must augment our traditional approaches. The scientific community must build upon its deep understanding of risk assessment, risk management, and reductionism with tools, technologies, insights and approaches to pursue sustainability. The U.S. Environmental Protection Agency (EPA) has recognized this need for systemic change by implementing a new research paradigm called "The Path Forward." In 1986, the Federal Technology Transfer Act (FTTA) was established to promote a closer, collaborative relationship between federal government agencies and the private sector. With the increasing need for new cost-effective technologies to prevent and control pollution, both the US Environmental Protection Agency (EPA) and private industry are encouraged to facilitate the transfer of knowledge and technology under this Act. The FTTA removed several of the legal and institutional barriers to cooperative research that existed before the Act`s passage. Through the FTTA, the government strives to promote the movement of its products, processes, skills, and knowledge into the private sector for further development and commercialization by encouraging the exchange of technical personnel and the sharing of facilities and other resources. Collaborative efforts between industry, federal agencies, and academia are made possible through cooperative research and development agreements (CRADAs). Forty-two CRADAs and five licensing agreements have been initiated with EPA under this program. This paper provides an overview of this new and innovative program within the EPA. 1 fig., 2 tabs.

The US Environmental Protection Agency (EPA) has proposed new ambient air quality standards specifically for fine particulate matter, regulating concentrations of particles with median aerodynamic diameters less than 2.5 {mu}m (PM{sub 2.5}). Two new standards have been proposed: a maximum 24-hr concentration that is intended to protect against acute health effects, and an annual concentration limit that is intended to protect against longer-term health effects. EPA has also proposed a slight relaxation of the 24-hr standard for inhalable particles (PM{sub 10}), by allowing additional exceedances each year. Fine particles are currently being indirectly controlled by means of regulations for PM{sub 10} and TSP, under the Clean Air Act of 1970 and subsequent amendments. Although routine monitoring of PM{sub 2.5} is rare and data are sparse, the available data indicate that ambient concentrations have been declining at about 6% per year under existing regulations.

Computational toxicology is the application of mathematical and computer models to help assess chemical hazards and risks to human health and the environment. Supported by advances in informatics, high-throughput screening (HTS) technologies, and systems biology, the U.S. Environmental Protection Agency EPA is developing robust and flexible computational tools that can be applied to the thousands of chemicals in commerce, and contaminant mixtures found in air, water, and hazardous-waste sites. The Office of Research and Development (ORD) Computational Toxicology Research Program (CTRP) is composed of three main elements. The largest component is the National Center for Computational Toxicology (NCCT), which was established in 2005 to coordinate research on chemical screening and prioritization, informatics, and systems modeling. The second element consists of related activities in the National Health and Environmental Effects Research Laboratory (NHEERL) and the National Exposure Research Laboratory (NERL). The third and final component consists of academic centers working on various aspects of computational toxicology and funded by the U.S. EPA Science to Achieve Results (STAR) program. On May 13, 1998, the United States Environmental Protection Agency (EPA) issued its 'final certification decision' to certify that the U. S. Department of Energy's (DOE) Waste Isolation Pilot Plant (WIPP) will comply with the radioactive waste disposal regulations set and the WIPP Compliance Criteria set forth at 40 CFR Parts 191 (US EPA, 1993) and 194 (US EPA, 1996) respectively. The WIPP will be the nation's first deep underground disposal facility for transuranic (TRU) radioactive waste generated as a result of defence activities. Since WIPP is a first-of-a-kind facility EPA's regulatory program contains an abundance of unique technical questions, as well as controversial policy considerations and legal issues. This paper presents the process that EPA undertook to reach its final decision. Oversight of the WIPP facility by EPA is governed by the WIPP Land Withdrawal Act (WIPP LWA), passed initially by Congress in 1992 and amended in 1996. The LWA required EPA to evaluate whether the WIPP will comply with Subparts B and C of 40 CFR Part 191, known as the disposal regulations. The EPA's final certification of compliance will allow the emplacement of radioactive waste in the WIPP to begin, provided that all other applicable health and safety standards have been met. The certification also allows Los Alamos National Laboratory (LANL) to strip TRU waste from specific waste streams for disposal at the WIPP. However, the certification is subject to several conditions, most notably that EPA must approve site-specific waste characterisation measures and quality assurance plans before allowing sites other than LANL to ship waste for disposal at the WIPP

US EPA - A*Star Partnership - Accelerating the Acceptance of ...
The path for incorporating new alternative methods and technologies into quantitative chemical risk assessment poses a diverse set of scientific challenges. Some of these challenges include development of relevant and predictive test systems and computational models to integrate and extrapolate experimental data, and rapid characterization and acceptance of these systems and models. The series of presentations will highlight a collaborative effort between the U.S. Environmental Protection Agency (EPA) and the Agency for Science, Technology and Research (A*STAR) that is focused on developing and applying experimental and computational models for predicting chemical-induced liver and kidney toxicity, brain angiogenesis, and blood-brain-barrier formation. In addressing some of these challenges, the U.S. EPA and A*STAR collaboration will provide a glimpse of what chemical risk assessments could look like in the 21st century. Presentation on US EPA – A*STAR Partnership at international symposium on Accelerating the acceptance of next-generation sciences and their application to regulatory risk assessment in Singapore.

The US Environmental Protection Agency (EPA) is currently developing standards for the disposal of low-level radioactive waste (LLW). As part of this Standard, EPA is including regulations for the disposal of naturally occurring and accelerator-produced radioactive material (NARM) wastes not covered under the Atomic Energy Act (AEA). The regulations will cover only higher-activity NARM wastes, defined as NARM waste with specific activity exceeding two nanocuries per gram. The proposed regulations will specify that NARM wastes exceeding the above limits, except for specific exempted items, must be disposed of in regulated radioactive waste disposal facilities. The proposed EPA regulations for NARM wastes will be discussed, as well as the costs and benefits of the regulation, how it will be implemented by EPA, and the rationale for covering only higher-activity NARM wastes exceeding two nanocuries per gram

The draft Environmental Statement issued by the Environmental Protection Agency (EPA) in the United States in preparation for Proposed Rulemaking Action concerning 'Environmental radiation protection requirements for normal operations of activities in the uranium fuel cycle' is summarized and discussed. The standards proposed by the EPA limit the annual dose equivalents to any member of the public, and also the releases of radionuclides to the 'general environment' for each gigawatt year of electrical energy produced. These standards were based on cost effectiveness arguements and levels and correspond to the ICRP recommendation to keep all exposures as low as reasonably achievable, economic and social factors being taken into account. They should be clearly distinguished from dose limits, although the EPA does not make this at all clear. The EPA seems to have shown an unexpected lack of understanding of the recommendations of ICRP Publication 9 (1965) and an apparent unawareness of ICRP Publication 22 (1973), and has therefore wrongly presented the new standards as a significant change in policy. The EPA has reviewed the information on the likely level of dose equivalents to members of the public and the likely cost reductions, thereby quantifying existing principles as applied to the fuel cycle as a whole. The EPA has stated that its proposals could be achieved as a cost in the region of Pound100,000 per death (or major genetic defect). It is pointed out that the EPA's use of the term 'waste' to exclude liquid and gaseous effluents may cause confusion. (U.K.)

As part of the standard development, EPA has performed risk assessments using the PRESTO-EPA codes. A program of sensitivity analysis was conducted on the PRESTO-EPA codes, consisting of single parameter sensitivity analysis and scenario sensitivity analysis. In many parts of the United States, mosquitoes were previously nuisance pests. However, they now represent a potential threat in the spread of viral diseases. The Aedes aegypti, Aedes albopictus, and Culex species mosquitoes are endemic to the United States and together may transmit a variety of viral diseases of growing concern, including West Nile virus, chikungunya, dengue fever, and Zika virus. The Centers for Disease Control and Prevention and the Environmental Protection Agency (EPA) recommend N,N-diethyl-meta-toluamide (DEET) as a first-line mosquito repellent, but for patients refusing to use DEET or other conventional repellents, guidance is limited to any EPA-registered product. Therefore, we conducted a systematic review of the literature to identify which EPA-registered personal mosquito repellent provides the best protection from A. aegypti, A. albopictus, and Culex spp. mosquitoes. We abstracted data from 62 published reports of EPA-registered mosquito repellents. The conventional repellent picaridin has the strongest data to support its use as a second-line agent, while IR3535 and oil of lemon eucalyptus are reasonably effective natural products. Citronella, catnip, and 2-undecanone offer limited protection or have limited data. These results can be used by pharmacists and other health care professionals to advise patients on the selection of an EPA-registered mosquito repellent. Regardless of the repellent chosen, it is vital for patients to follow all instructions/precautions in the product labeling to ensure safe and effective use. © 2016 Pharmacotherapy Publications, Inc.

The Environmental Protection Agency (EPA) has been given the responsibility of setting site-specific health and safety standards for the potential repository at Yucca Mountain, Nevada. The same legislation that gave the Agency that responsibility, mandated a study by the National Academy of Sciences (NAS) to provide input into the bases for the EPA standards. The NAS has completed and presented a report to the Agency; this paper summarizes the report's recommendations and conclusions. Following receipt of the report, the Agency opened a comment period and held public meetings to gather comments; the major issues from the comments are summarized. Based upon the report from NAS and the public comments, EPA has started formulating proposed standards which will be known as 40 CFR Part 197. It is planned for the proposal of 40 CFR Part 197 to occur in the summer of 1996

This report is the proceedings of the fourth workshop jointly organized by the Japan Atomic Energy Agency (JAEA) and the United States Environmental Protection Agency (US EPA) under the terms of agreement for cooperation in the field of radiation protection. The workshop was sponsored by the Nuclear Science and Engineering Directorate and was held at the Nuclear Science Research Institute, the Tokai Research and Development Center, JAEA, on November 7-8, 2006. The objective of the workshop was to exchange and discuss recent information on radiation effects, radiation risk assessment, radiation dosimetry, emergency response, radiation protection standards, and waste management. Twenty-two papers were presented by experts from JAEA, US EPA, the National Academies, Oak Ridge National Laboratory, Washington State University and the US Nuclear Regulatory Commission. Three keynotes addressed research on radiation effects and radiation protection at JAEA, the latest report on health risks from exposure to low levels of ionizing radiation published by the National Research Council (BEIR VII Phase 2), and recent developments in Committee 2 for the forthcoming recommendations of the International Commission on Radiological Protection (ICRP). To support the concept of criteria for potential below-regulatory-concern (BRC) wastes the US Environmental Protection Agency (EPA) has developed technical information, cost data, a methodology for analyzing promising candidate waste streams, and a rationale for proposing the criteria. Risk assessments to support the BRC criteria include an analysis of surrogate radioactive waste streams, disposal alternatives, and diverse demographic settings. In arriving at a proposed BRC level, EPA carefully weighed and considered many factors. Foremost was protection of the public and the development of an exposure level with assurance of no undue risk. Formalized quality assurance program requirements for the U.S. Environmental Protection Agency (EPA) have been established for more than a decade. During this period, the environmental issues and concerns addressed by the EPA have changed. Many issues, such as ozone depletion and global climate warming, have become international concerns among the world environmental community. Other issues, such as hazardous waste cleanup and clean air, remain a focus of national environmental concerns. As the environmental issues of the 1980`s evolved, the traditional quality assurance (QA) program was transformed through the use of quality management principles into a Quality System to help managers meet the needs of the 1990`s and beyond.

Although DOE's image with Congress and the media concerning environmental compliance may be poor, EPA sees the Department's recent attitude toward the environment as good. DOE and EPA must continue to move forward. In particular, EPA would like to emphasize less study of a problem and more clean-up. Strong, enforceable agreements will allow this goal to be met by letting EPA take more risks in its decision making. Currently EPA is developing an enforcement strategy for Federal facilities. This strategy will address identifying Federal facilities of concern, increasing enforcement and compliance monitoring activities at those facilities, implementing the model agreements, resource planning, and the establishment of an Agency Management System for Federal facilities. There are over 1000 Federal facilities which are listed on the EPA compliance docket. Over 200 Federal facilities are expected to be included on the NPL. Increased EPA attention may increase the ability of the various Federal agencies to obtain the necessary funding. Another subject being addressed by EPA is the liability of government contractors under the environmental statutes. The Agency is developing a GoCo enforcement strategy. In the hazardous waste enforcement program, three criteria are being considered for determining when to proceed against a contractor: Degree of contractor control over the hazardous waste management activity. Since 2002, the US Environmental Protection Agency (EPA) has been funding research on the environmental aspects of nanotechnology through its Science to Achieve Results (STAR) grants program. In total, more than $25 million has been awarded for 86 research projects on the environmental applications and implications of nanotechnology. In the applications area, grantees have produced promising results in green manufacturing, remediation, sensors, and treatment using nanotechnology and nanomaterials. Although there are many potential benefits of nanotechnology, there has also been increasing concern about the environmental and health effects of nanomaterials, and there are significant gaps in the data needed to address these concerns. Research performed by STAR grantees is beginning to address these needs.

As the nature and extent of radiological contamination becomes better documented and more public, radioanalytical laboratories are faced with a constantly expanding variety of new and difficult analytical requirements. Concurrent with those requirements is the responsibility to provide customers, regulatory officials, or the public with defensible data produced in an environment of verifiable, controlled quality. To meet that need, a quality assurance accreditation program for radioassay laboratories has been proposed by the American National Standards Institute (ANSI). The standard will provide the organizational framework and functional requirements needed to assure the quality of laboratory outputs. Under the proposed program, the U.S. Environmental Protection Agency`s (EPA`s) Laboratory Intercomparison Program plays a key role as a reference laboratory. The current and proposed roles of the EPA Intercomparison Program are discussed, as are the functional relationships between EPA, the accreditating organization, and the service and monitoring laboratories.

Rethinking Environmental Protection: Meeting the Challenges ...
Background: The U.S. Environmental Protection Agency (EPA) has made great progress in addressing some major environmental problems. These successes were framed within EPA’s statutory mandates which are largely media-specific and receptor-focused and follow a segmented risk-based construct. Today’s environmental problems are increasingly complex, and new approaches are needed to achieve sustainable solutions that protect the environment and public health. Objectives: We provide an overview of environmental protection at EPA and highlight today’s environmental challenges. We provide case examples of systems approaches that consider the links between environment and human health. We offer a strategic framework for tackling challenges so EPA can continue to protect the environment and public health.Discussion: Expanded approaches will be transdisciplinary, informed by vast new sources of data, and build upon new stakeholder partnerships. The Environmental Protection Agency (EPA) is issuing today a Regulation Interpretation Memorandum (RIM) which provides official interpretation of the issue of whether a generator who accumulates hazardous waste pursuant to 40 CFR 262.34, may qualify for interim status after November 19, 1980. This issue arose when the requirements for submitting a Part A permit application (one of the prerequisites to qualifying for interim status) were amended on November 19, 1980. The provisions interpreted today are part of the Consolidated Permit Regulations promulgated under Subtitle C of the Solid Waste Disposal Act, as amended by the Resource Conservation and Recovery Act, as amended (RCRA).

EPA believes that effective and efficient solutions to problems in all radioactive waste disposal areas will require close coordination and cooperation among all agencies involved. In this regard, EPA already has participated in meetings with the Energy Research and Development Administration, the Nuclear Regulatory Commission, the Council on Environmental Quality, the U.S. Geological Survey, and the Office of Management and Budget to lay the groundwork for the development of a consolidated national radioactive waste disposal plan. The EPA program is directed first toward developing goals and requirements; and then, in cooperation with the public, industry, the States and Federal agencies, towards determining by what means these goals can be achieved for each waste management option. In addition, the program will develop criteria for determining when the goals of the waste management options have been achieved. In summary, EPA will provide fundamental environmental criteria and generally applicable environmental standards for permanent disposal of high level radwastes. Concurrently, ERDA will develop the necessary technology; and NRC will conduct necessary studies, develop waste-related regulations, and license specific sites and methods of control. Together, we will be able to manage the disposal of the Nation's radioactive waste in an environmentally adequate manner

The 1990 Clean Air Act Amendments require that the U.S. Environmental protection Agency (EPA) assess the health risks associated with mercury emissions. Also, the law requires a separate assessment of health risks posed by the emission of 189 tract chemicals (including mercury) for electric utility steam-generating units. In order to conduct a meaningful assessment of health and environmental effects, we must have, among other things, a reliable and accurate method to measure mercury emissions. In addition, the rate of mercury deposition and the type of control strategies used may depend upon the type of mercury emitted (i.e., whether it is in the oxidized or elemental form). It has been speculated that EPA (Draft) Method 29 can speciate mercury by selective absorption; however, this claim has yet to be proven. The Electric Power Research Institute (EPRI) and the U.S. Department of Energy (DOE) have contracted with the Energy & Environmental Research Center (EERC) at University of North Dakota to evaluate EPA (Draft) Method 29 at the pilot-scale level. The objective of the work is to determine whether EPA (Draft) Method 29 can reliably quantify and speciate mercury in the flue gas from coal-fired boilers.

Three representatives of the Environmental Protection Agency (EPA) testified in response to questions over the agency's apparent approval of the land disposal of toxic materials in contradiction to the ban implicit in the Hazardous and Solid Waste Amendments of 1984. In new regulations, EPA interprets the ban as applying only when migration of toxic materials exceeds its screening levels. EPA also cites its screening levels to place a cap on waste treatment. At issue was EPA's effort to avoid the mandate of the 1984 legislation and its acceptance of screening levels which may assume a lower threat than actually exists. EPA representatives explained the rulemaking, and defended the use of screening levels as a basis for treatment and exemption. Additional material submitted for the record by the agency and by the House committee follows the testimony.

The total number of sites contaminated with radionuclides in the United States is in the thousands. These sites range in size from corners of laboratories to sprawling nuclear weapons facilities covering many square miles of land. The U.S. Environmental Protection Agency (EPA) is proposing regulations for the protection of the public from radionuclide contamination at sites that are to be cleaned up and released for public use. The rule will apply to site under the control of Federal agencies, and to sites licensed by the Nuclear Regulatory Commission (NRC) or NRC Agreement States. In support of this rulemaking, EPA is conducting a comprehensive technical analysis which will provide information on the volumes of soil requiring remediation at various possible dose and risk levels. The analysis will also provide information at different cleanup levels on the number of potential adverse health effects among people living or working on or near a site following the cleanup of its radioactive contamination. This paper summarizes the overall approach for the technical analysis. (author)

Following the decision to withdraw the Yucca Mountain license application, the Department of Energy created a Blue Ribbon Commission (BRC) on America's Nuclear Future, tasked with recommending a national strategy to manage the back end of the nuclear fuel cycle. The BRC issued its final report in January 2012, with recommendations covering transportation, storage and disposal of spent nuclear fuel (SNF); potential reprocessing; and supporting institutional measures. The BRC recommendations on disposal of SNF and high-level waste (HLW) are relevant to the U.S. Environmental Protection Agency (EPA), which shares regulatory responsibility with the Nuclear Regulatory Commission (NRC): EPA issues 'generally applicable' performance standards for disposal repositories, which are then implemented in licensing. For disposal, the BRC endorses developing one or more geological repositories, with siting based on an approach that is adaptive, staged and consent-based. The BRC recommends that EPA and NRC work cooperatively to issue generic disposal standards-applying equally to all sites-early in any siting process. EPA previously issued generic disposal standards that apply to all sites other than Yucca Mountain. However, the BRC concluded that the existing regulations should be revisited and revised. The BRC proposes a number of general principles to guide the development of future regulations. EPA continues to review the BRC report and to assess the implications for Agency action, including potential regulatory issues and considerations if EPA develops new or revised generic disposal standards. This review also involves preparatory activities to define potential process and public engagement approaches. (authors)

Phytoplankton communities in freshwater lakes, ponds, and reservoirs may be dominated by cyanobacteria (also called blue-green algae) under certain environmental conditions. Cyanobacteria may cause a range of water-quality impairments, including the potential for toxin production. Cyanobacteria toxins (cyanotoxins) may adversely impact human and ecological health. Microcystins are considered to be one of the most commonly found classes of cyanotoxins in freshwater ecosystems, and as such were selected as a recreational indicator of water quality for the 2007 United States Environmental Protection Agency (EPA) National Lakes Assessment. However, much less is known about the occurrence of other classes of cyanotoxins in fresh surface water such as anatoxins, cylindrospermopsins, nodularins, and saxitoxins.

This article is a case study on how administrative agencies interact with each other in cases of shared regulatory jurisdiction. The theoretical literature on the topic of overlapping jurisdiction both (1) makes predictions about how agencies are expected to behave when they share jurisdiction, and (2) in recent iterations argues that overlapping jurisdiction can confer unique policymaking benefits. Through the lens of that theoretical literature, this article examines the relations between the Food and Drug Administration (FDA) and the Environmental Protection Agency (EPA) regarding the public health risks posed by mercury in fish. It concludes that the FDA-EPA case study (1) corroborates the extant theoretical accounts of how agencies behave in cases of overlapping jurisdiction, (2) supports the conclusion of the recent scholarship that overlapping jurisdiction can confer unique policy benefits, and (3) reveals a few wrinkles not given adequate treatment in the extant literature.

On October 18, 1997, the 25th anniversary of the enactment of the Clean Water Act, the Vice President called for a renewed effort to restore and protect water quality. The Vice President asked that the Secretary of Agriculture and the Administrator of the Environmental Protection Agency (EPA), working with other affected agencies, develop a Clean Water Action Plan that builds on clean water successes and addresses three major goals: (1) enhanced protection from public health threats posed by water pollution; (2) more effective control of polluted runoff; and (3) promotion of water quality protection on a watershed basis.

These regulatory criteria were originally promulgated by the US Environmental Protection Agency (EPA) in 40 CFR Part 191 in 1985. This paper reports that the Environmental Protection Agency (EPA) has developed a voluntary program to evaluate radon reduction contractors and provide this information to the public, as part of activities mandated by the Indoor Radon Abatement Act (IRAA) of 1988. The Radon Contractor Proficiency Program consists of several elements that collectively help to ensure the proficiency of radon mitigators and give the public greater confidence in their capability. Contractors who participate in the program must pass a written examination, adhere to mitigation guidelines, keep records of work, meet continuing education requirements and pass a re-examination every two years. Upon meeting the program's requirements, mitigators are listed in EPA's National RCP Proficiency Report. The first Report released on May 15, 1990 listed 636 contractors. The second Report, to be release in August, will list 895 contractors, representing an increase of 40 per cent

Coping with EPA's new petroleum industry storm water permits

The United States Environmental Protection Agency has just released for public comment its so-called multi-sector industry specific storm water permit. This permit -- developed in response to the 730 group storm water permit applications submitted in 1992 to EPA -- proposes the establishment of specific runoff sampling and facility design requirements for at least two petroleum industry sectors. This proposed permit establishes specific conditions for the oil and gas extraction section (SIC group 13) and for lubricant manufacturers (SIC 2992). Permit conditions are also established for allied industrial sectors such as the chemical, transportation and asphalt materials industries. By most standards, the proposed permit is much tougher than EPA's baseline general permit for storm water discharges which was released in September of 1992. For example, under the proposal, most industries are required to perform periodic storm water sampling. EPA has also established storm water effluent and performance standards for several industrial categories. This paper will discuss the petroleum industry specific conditions of the new permit. The paper will also discuss the results of the industry-wide storm water sampling efforts undertaken by more than 300 oil patch facilities across the country. In particular, sampling results will be discussed in the context to the permit conditions proposed by EPA. The paper will also discuss strategies for dealing with the new permits

New EPA ban stymies Canadian exports of PCB waste

With reference to a 1996 EPA ruling permitting the importation to the USA of PCBs for incineration, a unanimous three-judge panel of the US Court of Appeals for the Ninth District in San Francisco ruled that the Environmental Protection Agency (EPA) did not have the authority to permit the import of PCB wastes into the USA for disposal. Prior to the decision, 35 applications from Canada to export some 37,000 tonnes of PCB to the USA for disposal have been approved. Canadian brokers are upset with the decision, claiming that the decision will create a virtual monopoly for Bovar Inc., of Calgary, the only PCB-disposal facility in Canada. The loss (at least for the time being) of the alternate disposal opportunity will likely have the effect of forcing Canadian customers to pay more for PCB disposal. The Canadian government is monitoring the situation and is waiting to see whether an appeal is filed against the ruling

The Indoor Radon Abatement Act of 1988 (IRAA) directed EPA to undertake a variety of activities to address the growing public concern over dangers posed by exposure to indoor radon. Among other requirements, the law directed the Agency to study radon levels, evaluate mitigation methods, establish proficiency programs, assist states with program development, develop training centers, and provide public information. EPA has developed and implemented programs to address each of the key provisions of this statute. This paper presents EPA's broad national strategy to reduce radon risks. It combines and reinforces EPA's basic foundation, including its guiding policies and cooperative partnerships, with an overall management approach and focus for the future. The paper starts with an overview that introduces the strategy's four key elements: underlying policies and scientific principles, a decentralized system of states and other partners for targeting the public, multiple strategies for achieving radon risk reduction, and a strong focus on five key program priorities. This paper then discusses each of these elements in more detail and describes how they interact to guide future efforts and directions of the Agency

The author talks about the Australian Radiation Protection and Nuclear Safety Agency (ARPANSA), the new regulatory authority which will combine the existing resources of the Australian Radiation Laboratory and the Nuclear Safety Bureau. Most uses of radiation in Australia are regulated by State or Territory authorities, but there is presently no regulatory authority for Commonwealth uses of radiation. To provide for regulation of the radiation practices of the Commonwealth, the Australian Government has decided to establish the Australian Radiation Protection and Nuclear Safety Agency (ARPANSA) and a Bill has passed through the House of Representatives and will go to the Spring sitting of the Senate. The new agency will subsume the resources and functions of the Nuclear Safety Bureau and the Australian Radiation Laboratory, with additional functions including the regulation of radiation protection and nuclear safety of Commonwealth practices. Another function of ARPANSA will be the promotion of uniform regulatory requirements for radiation protection across Australia. This will be done by developing, in consultation with the States and Territories, radiation health policies and practices for adoption by the Commonwealth, States and Territories. ARPANSA will also provide research and services for radiation health, and in support of the regulatory and uniformity functions. The establishment of ARPANSA will ensure that the proposed replacement research reactor, the future low level radioactive waste repository and other Commonwealth nuclear facilities and radiation practices are subject to a regulatory regime which reflects the accumulated experience of the States and Territories and best international practice, and meets public expectations

Those methodologies are in the form of computer program models or extensive documentation. This research paper compares the significant differences between the DOE and EPA methodologies and default parameters for the important air exposure pathway. The purpose of this analysis was to determine the fundamental differences in methodology and parameter values between the DOE and the EPA. This study reviewed the parameter values and default values that are utilized in the air exposure pathway and revealed the significant differences in risk assessment results when default values are used in the analysis of an actual site. Three new methods applicable to the determination of hazardous metal concentrations in stationary source emissions were developed and evaluated for use in U.S. Environmental Protection Agency (EPA) compliance applications. Two of the three independent methods, a continuous emissions monitor-based method (Xact) and an X-ray-based filter method (XFM), are used to measure metal emissions. The third method involves a quantitative aerosol generator (QAG), which produces a reference aerosol used to evaluate the measurement methods. A modification of EPA Method 301 was used to validate the three methods for As, Cd, Cr, Pb, and Hg, representing three hazardous waste combustor Maximum Achievable Control Technology (MACT) metal categories (low volatile, semivolatile, and volatile). The measurement methods were evaluated at a hazardous waste combustor (HWC) by comparing measured with reference aerosol concentrations. The QAG, Xact, and XFM met the modified Method 301 validation criteria. All three of the methods demonstrated precisions and accuracies on the order of 5%. The measurement methods should be applicable to emissions from a wide range of sources, and the reference aerosol generator should be applicable to additional analytes. EPA recently approved an alternative monitoring petition for an HWC at Eli Lilly's Tippecanoe site in Lafayette, IN, in which the Xact is used for demonstrating compliance with the HWC MACT metal emissions (low volatile, semivolatile, and volatile). The QAG reference aerosol generator was approved as a method for providing a quantitative reference aerosol, which is required for certification and continuing quality assurance of the Xact. 30 refs., 5 figs., 11 tabs.

Modeling a point-source release of 1,1,1-trichloroethane using EPA's SCREEN model

Using data from the Environmental Protection Agency's Toxic Release Inventory 1988 (EPA TRI88), pollutant concentration estimates were modeled for a point source air release of 1,1,1-trichloroethane at the Savannah River Plant located in Aiken, South Carolina. Estimates were calculating using the EPA's SCREEN model utilizing typical meteorological conditions to determine maximum impact of the plume under different mixing conditions for locations within 100 meters of the stack. Input data for the SCREEN model were then manipulated to simulate the impact of the release under urban conditions (for the purpose of assessing future landuse considerations) and under flare release options to determine if these parameters lessen or increase the probability of human or wildlife exposure to significant concentrations. The results were then compared to EPA reference concentrations (RfC) in order to assess the size of the buffer around the stack which may potentially have levels that exceed this level of safety

A series of activities have been conducted by a core group of EPA scientists from across the Agency. The activities were initiated in 2012 and the focus was to increase the reuse and interoperability of science software at EPA. The need for increased reuse and interoperability is linked to the increased complexity of environmental assessments in the 21st century. This complexity is manifest in the form of problems that require integrated multi-disciplinary solutions. To enable the means to develop these solutions (i.e., science software systems) it is necessary to integrate software developed by disparate groups representing a variety of science domains. Thus, reuse and interoperability becomes imperative. This report briefly describes the chronology of activities conducted by the group of scientists to provide context for the primary purpose of this report, that is, to describe the proceedings and outcomes of the latest activity, a workshop entitled “Workshop on Advancing US EPA integration of environmental and information sciences”. The EPA has been lagging in digital maturity relative to the private sector and even other government agencies. This report helps begin the process of improving the agency’s use of digital technologies, especially in the areas of efficiency and transparency. This report contributes to SHC 1.61.2.

The US EPA is the lead Federal agency for emergency responses to unknown radiological materials, not licensed, owned or operated by a Federal agency or an Agreement state (Federal Radiological Emergency Response Plan, 1996). Radiological risk assessments and resulting risk estimates have been developed by numerous national and international organizations, including the National Research Council's fifth Committee on the Biological Effects of Ionizing Radiations (BEIR V), the United Nations Scientific Committee on the Effects of Atomic Radiation (UNSCEAR), and the International Commission on Radiological Protection (ICRP). A fourth organization, the Environmental Protection Agency (EPA), has also performed a risk assessment as a basis for the National Emission Standards for Hazardous Air Pollutants (NESHAP). This paper compares the EPA's model of risk assessment with the models used by the BEIR V Committee, UNSCEAR, and ICRP. Comparison is made of the values chosen by each organization for several model parameters: populations used in studies and population transfer coefficients, dose-response curves and dose-rate effects, risk projection methods, and risk estimates. This comparison suggests that the EPA has based its risk assessment on outdated information and that the organization should consider adopting the method used by the BEIR V Committee, UNSCEAR, or ICRP

Under the requirements of the Federal Facility Compliance Act (FFCA), the Department of Energy (DOE) is directed to develop treatment plans for their stockpile of wastes generated at their various sites. As a result, DOE is facing the monumental problem associated with the treatment and ultimate disposal of their mixed (radioactive and hazardous) waste. Meanwhile, the Environmental Protection Agency (EPA) issued a final open-quotes Hazardous Waste Combustion Strategyclose quotes in November 1994. Under the Combustion Strategy, EPA permit writers have been given the authority to use the Omnibus Provision of the Resource Conservation and Recovery Act (RCRA) to impose more stringent emission limits for waste combustors prior to the development of new regulations. EPA and DOE established a multi-year Interagency Agreement (IAG) in 1991. The main objective of the IAG (and of the second IAG that was added in 1993) is to conduct a research program on thermal technologies for treating mixed waste and to establish permit procedures for these technologies particularly under the new requirements of the above-mentioned EPA Combustion Strategy. The objective of this Paper is to summarize the results of the EPA/DOE joint efforts on mixed waste treatment since the establishment of the original Interagency Agreement. The Environmental Protection Agency's (EPA) Office of Emergency and Remedial Response (OERR) requires environmental data of known quality to support Superfund hazardous waste site projects. The Quality Assurance Technical Support (QATS) Program is operated by Shaw Environmental and Infrastructure, Inc. to provide EPA's Analytical Operations Center (AOC) with performance evaluation samples, reference materials, on-site laboratory auditing capabilities, data audits (including electronic media data audits), methods development, and other support services. The new QATS contract awarded in November 2000 required that the QATS Program become ISO 9000 certified. In a first for an EPA contractor, the QATS staff and management successfully transformed EPA's QA/R-2 type Quality Management Plan into a Quality Management System (QMS) that complies with the requirements of the internationally recognized ISO 9002 standard and achieved certification in the United States, Canada, and throughout Europe. The presentation describes how quality system elements of ISO 9002 were implemented on an already existing quality system. The psychological and organizational challenges of the culture change in QATS' day-to-day operations will be discussed for the benefit of other ISO 9000 aspirants.

The Environmental Response Team (ERT) of the United States Environmental Protection Agency (USEPA) conducted air monitoring activities during the September 11, 2001 attack on the World Trade Center in New York City. This paper describes ERT's response actions and analytical support. It covers ERT activities from the morning of September 11 to October 17, 2001 when ERT was alerted of anthrax activities in Washington, DC and Boca Raton, Florida. ERT members provided technical support regarding respirator/personnel protective equipment selection, decontamination and health and safety protocols. In the first few weeks, ERT was also providing analytical laboratory support to the EPA, the Occupational Safety and Health Administration, the National Institute for Occupational Safety and Health, and the New York City Department of Health. ERT also provided on-site gas chromatography-mass spectrometry analysis via the Trace Atmospheric Gas Analyzer (TAGA) bus, providing real-time direct readings to the EPA and the New York Fire Department. Site boundary air monitoring stations were maintained until early November at which point the EPA Region 2 took over all monitoring responsibilities. Air sampling efforts were initially directed at worker health and safety and the surrounding environments. Air sampling was conducted for asbestos, acid gases, heavy metals, phosgene, mercury, dioxins/furans, volatile organic compounds, and polychlorinated biphenyls. The sampling activities were later expanded to include chlorine, hydrogen chloride, sulfur dioxide, and hydrogen cyanide. Site assessment is still ongoing. What began as a typical emergency response air sampling effort soon became a huge air monitoring effort with the original six stations expanded to more than 20. ERT made every effort to collect, analyze, quality assure and transfer data for posting on publicly accessible website within less than 24 hours. This web feature service contains location and facility identification information from EPA's Facility Registry System (FRS) for the subset of facilities that link to the National Center for Education Statistics (NCES). The primary federal database for collecting and analyzing data related to education in the United States and other Nations, NCES is located in the U.S. Department of Education, within the Institute of Education Sciences. FRS identifies and geospatially locates facilities, sites or places subject to environmental regulations or of environmental interest. Using vigorous verification and data management procedures, FRS integrates facility data from EPA00e2??s national program systems, other federal agencies, and State and tribal master facility records and provides EPA with a centrally managed, single source of comprehensive and authoritative information on facilities. The Amoco/EPA Pollution Prevention Project involved a number of representatives from federal and Virginia regulatory agencies, and Amoco's refining business. Participants believed that the Project could benefit from a broader perspective than these organizations along might provide. The Trump administration has undertaken an assault on the Environmental Protection Agency (EPA), an agency critical to environmental health. This assault has precedents in the administrations of Ronald Reagan and George W. Bush. The early Reagan administration (1981–1983) launched an overt attack on the EPA, combining deregulation with budget and staff cuts, whereas the George W. Bush administration (2001–2008) adopted a subtler approach, undermining science-based policy. The current administration combines both these strategies and operates in a political context more favorable to its designs on the EPA. The Republican Party has shifted right and now controls the executive branch and both chambers of Congress. Wealthy donors, think tanks, and fossil fuel and chemical industries have become more influential in pushing deregulation. Among the public, political polarization has increased, the environment has become a partisan issue, and science and the mainstream media are distrusted. For these reasons, the effects of today’s ongoing regulatory delays, rollbacks, and staff cuts may well surpass those of the administrations of Reagan and Bush, whose impacts on environmental health were considerable. The Trump administration has undertaken an assault on the Environmental Protection Agency (EPA), an agency critical to environmental health. This assault has precedents in the administrations of Ronald Reagan and George W. Bush. The early Reagan administration (1981-1983) launched an overt attack on the EPA, combining deregulation with budget and staff cuts, whereas the George W. Bush administration (2001-2008) adopted a subtler approach, undermining science-based policy. The current administration combines both these strategies and operates in a political context more favorable to its designs on the EPA. The Republican Party has shifted right and now controls the executive branch and both chambers of Congress. Wealthy donors, think tanks, and fossil fuel and chemical industries have become more influential in pushing deregulation. Among the public, political polarization has increased, the environment has become a partisan issue, and science and the mainstream media are distrusted. For these reasons, the effects of today's ongoing regulatory delays, rollbacks, and staff cuts may well surpass those of the administrations of Reagan and Bush, whose impacts on environmental health were considerable.

Federal Regulations concerning radiation protection standards have been undergoing significant changes within the last decade. In addition to these changes, a proliferation in the number of Federal radiation standards has also occurred. A tabulation of these regulations aids in the understanding of which current standards apply to the nuclear industry with respect to environmental contamination and exposure to workers, and the public. Furthermore, most of the current regulations, proposed revisions, and proposed new rulings fall into several major categories. A tabulation of these categories illustrates common public, occupational, and environmental needs for which the DOE, NRC, and EPA have developed their specific radiation standards. Finally, risk based systems for radiation protection have been proposed by the DOE, NRC, and EPA, although these agencies are not entirely consistent in the application of this methodology. 2 tables

In October 1992, Congress enacted the Waste Isolation Pilot Plant (WIPP) Land Withdrawal Act which gave the U.S. Environmental Protection Agency (EPA) significant new responsibilities for overseeing the U.S. Department of Energy's (DOE) activities at the WIPP. The WIPP, which is designed to safely contain radioactive waste for at least 10 000 years, is located near Carlsbad, New Mexico, and is the world's first geological disposal facility for transuranic waste. In May 1998, EPA determined that the WIPP will safely contain transuranic waste, which is generated as a result of the U.S. nuclear weapons program, because DOE demonstrated that the facility will comply with the Agency's radioactive waste disposal standards. EPAS's decision allowed the DOE to begin disposing radioactive waste in the WIPP. As of October 2000, the WIPP has received over 75 shipments of transuranic radioactive waste. In implementing its new responsibilities, EPA committed to conducting an open public process that includes interaction with all interested parties. EPA believes that a successful communications and consultation program facilitates the regulatory oversight process and promotes sound public policy decisions. As a first step in meeting its commitment to an open public process, EPA conducted a public consultation and communication 'needs assessment'. The purpose of this assessment was to obtain input from citizen and environmental groups and the public on their key concerns about EPA's role and responsibilities at the WIPP, as well as to determine the best methods for communicating with them. Throughout the WIPP certification process, EPA provided opportunities for public involvement beyond those required in typical U.S. regulatory programs. Globally, protected areas are the most commonly used tools to halt biodiversity loss. Yet, some are failing to adequately conserve the biodiversity they contain. There is an urgent need for knowledge on how to make them function more effectively. Impact evaluation methods provide a set of tools that could yield this knowledge. However, rigorous outcome-focused impact evaluation is not yet used as extensively as it could be in protected area management. We examine the role of international protected area funding agencies in facilitating the use of impact evaluation. These agencies are influential stakeholders as they allocate hundreds of millions of dollars annually to support protected areas, creating a unique opportunity to shape how the conservation funds are spent globally. We identify key barriers to the use of impact evaluation, detail how large funders are uniquely placed to overcome many of these, and highlight the potential benefits if impact evaluation is used more extensively. © 2015 The Author(s).

Sellers' hedging incentives at EPA's emission trading auction

Cason (1993) argued that the auction the EPA (Environmental Protection Agency in the USA) used in order to start the market for sulfur allowances, is not efficient. The set-up of the auction gives both buyers and sellers an incentive to understate their valuation of an allowance. In this paper, we show that the sellers' incentives are even more perverse than Cason suggested. In particular, we show that sellers have an incentive to set their ask price equal to zero, while simultaneously hedging their bets by submitting a positive bid. It is not possible to derive the Nash equilibrium for this set-up. If such an equilibrium exists, sellers either set only a positive ask price, or an ask price equal to zero, and a positive bid as well. 14 refs

The U.S. Environmental Protection Agency (EPA) requested an external, independent verification study of their “Preliminary Remediation Goals for Radionuclides” (PRG) electronic calculator. The calculator provides information on establishing PRGs for radionuclides at Comprehensive Environmental Response, Compensation, and Liability Act (CERCLA) sites with radioactive contamination (Verification Study Charge, Background). These risk-based PRGs set concentration limits using carcinogenic toxicity values under specific exposure conditions (PRG User’s Guide, Section 1). The purpose of this verification study is to ascertain that the computer codes has no inherit numerical problems with obtaining solutions as well as to ensure that the equations are programmed correctly.

The Uranium Mill Tailings Radiation Control Act of 1978 (UMTRCA), authorizes the Department of Energy (DOE) to undertake remedial actions at 24 DOE designated processing sites. The term ''processing site,'' by statutory definition, means the inactive uranium mill or processing site and any other real property or improvement which is in the vicinity of the mill or processing site and is determined to be contaminated with residual radioactive materials derived from the mill or processing site. For purposes of this document, the inactive mill or processing site is referred to as the ''processing site'' and the other real property or improvement in the vicinity of such site is referred to as a 'vicinity property.'' The purpose of the remedial actions is to stabilize and control the uranium mill tailings and other residual radioactive materials in a safe and environmentally sound manner. Remedial actions undertaken by DOE are to be accomplished: With the full participation of the affected states and Indian tribes, in accordance with standards issued by the Environmental Protection Agency (EPA), and with the concurrence of the Nuclear Regulatory Commission (NRC). The US Environmental Protection Agency is proposing an environmental standard for the disposal of commercial low-activity mixed waste (LAMW), waste characterized by the presence of both hazardous chemicals and very low-level radioactive materials. LAMW is and will be generated in large amounts by environmental restoration efforts, nuclear power production and, in smaller amounts, by medical and educational facilities, industrial activities, and the process of research and development. The dual regulatory nature of this waste (covered by two very different statutes) is currently an impediment to its permanent disposal. The proposed standard addresses this issue by creating a voluntary regulatory option under which LAMW that meets the proposed radionuclide concentration limits may be disposed of via disposal technology based upon the Resource Conservation and Recovery Act (RCRA) hazardous waste disposal requirements. Such a facility would also have to be licensed by the NRC. EPA will explore the attributes of this disposal technology to develop concentration limits that are protective of the public health for LAMW. (author)

Background: The U.S. Environmental Protection Agency (EPA) and the National Institute of Environmental Health Sciences (NIEHS) have jointly supported the Children's Environmental Health and Disease Prevention Research Centers (“Children’s Centers”) program since 1998, forming a highly successful and collaborative, interdisciplinary research network. Methods: These multidisciplinary, translational research centers are investigating the role of a wide range of environmental exposures in adverse children's health outcomes and how to protect children's health. Studies include how exposure to chemicals such as ambient air pollutants, arsenic in water and food, endocrine-disrupting compounds (EDCs) including bisphenol A (BPA), manganese, organophosphate pesticides and polybrominated flame retardants may, in combination with other factors such as social and behavioral factors and genetic susceptibility, result in adverse birth and health outcomes including asthma, autism, childhood leukemia, changes in epigenetics/gene expression, changes in neurodevelopment and immune system function -- and how to prevent adverse health outcomes. EPA RE-Powering Mapper: Alternative Energy Potential at Cleanup Sites
The U.S. Environmental Protection Agency (EPA) Office of Land and Emergency Management??s (OLEM) Office of Communications, Partnerships and Analysis (OCPA) initiated the RE-Powering America's Land Initiative to demonstrate the enormous potential that contaminated lands, landfills, and mine sites provide for developing renewable energy in the United States. EPA developed national level site screening criteria in partnership with the U.S. Department of Energy (DOE) National Renewable Energy Laboratory (NREL) for wind, solar, biomass, and geothermal facilities. While the screening criteria demonstrate the potential to reuse contaminated land for renewable energy facilities, the criteria and data are neither designed to identify the best sites for developing renewable energy nor all-inclusive. Therefore, more detailed, site-specific analysis is necessary to identify or prioritize the best sites for developing renewable energy facilities based on the technical and economic potential. Please note that these sites were only pre-screened for renewable energy potential. The sites were not evaluated for land use constraints or current on the ground conditions. Additional research and site-specific analysis are needed to verify viability for renewable energy potential at a given site.

This paper considers the efforts of United Nations and international agencies to address the threats to Palestinian children arising from Israeli occupation. It contains an account of the reasons why agencies have failed, over many years, to prevent systematic violations by the Israeli authorities and settlers. The discussion is organised around two inter-related domains: institutional and political. The paper argues that, in the occupied Palestinian territory (oPt), limitations to the ways in which child protection has been conceptualised and pursued in practice are abundantly evident. Nevertheless, political pressure by Western donor governments serves to constrain an approach to child protection that is more preventative in nature, that addresses more explicitly Israeli violations of international law, and that reflects the experience and aspirations of Palestinian children themselves. Ultimately, therefore, the failure to protect Palestinian children must be seen not only as a result of humanitarian miscalculation but also as a consequence of political strategy. © 2013 The Author(s).
