  4. RECENT DEVELOPMENTS IN THE PROVISION OF PRO BONO LEGAL SERVICES BY ATTORNEYS IN SOUTH AFRICA

In this regard there have been and continue to be considerable gaps between the proper access to civil justice imperatives of constitutional South Africa and the status quo which has existed from the advent of a democratic South Africa until the present. Law as a vehicle for necessary positive change in the daily lives of South African residents is pertinently considered within the country’s woefully unequal socio-economic climate. This paper considers the role which pro bono work by private attorneys is playing and should play in promoting a more just and equitable society through proper access to justice. It explores the current position in South Africa as well as the position in selected foreign jurisdictions regarding pro bono services by attorneys in private practice in civil matters. Part of the discussion focuses on the question of whether pro bono work should be voluntary or mandatory. The merits of introducing a pro bono obligation are critically analysed by looking at the effect on both legal practitioners as well as those receiving the pro bono services. Having defined pro bono work, the practical need for pro bono work by lawyers in private practice is highlighted due to the dearth of legal aid in civil matters for indigent South Africans. Possible constitutional imperatives for the provision of free legal services in civil matters are highlighted. An important part of the paper is a reflection on some of the pro bono work being conducted by private firms of attorneys. The paper concludes with suggestions on means for establishing a more effective pro bono system in South Africa.

    2016-01-01

The effect of celebrity diagnosis on public awareness of health conditions has already been well documented. In October 2014, Bono, the lead singer with U2, revealed publicly for the first time that he has glaucoma. This study aimed to analyze the impact of Bono's announcement on public awareness of glaucoma using Google Search trends as an indicator of public interest in the disease. Google Trends was used to examine Google Search activity for the term 'Glaucoma' between 2009 and 2015 in both Ireland and the United Kingdom. Trend analyses were performed using Microsoft Excel Version 14.3.5. Increased Google Search activity for 'Glaucoma' in October 2014 was found in both Ireland and the United Kingdom. A five-fold increase from the mean Google Search activity for this term was found in Ireland and a two-fold increase from the mean Google Search activity for this term was found in the United Kingdom. No such increase in Google Search activity occurred during each country's 2014 Glaucoma Awareness week. Google Trends is useful in medical research as a means of assessing public awareness of, and/or interest in, health related topics. Current approaches to glaucoma related health promotion in both Ireland and the United Kingdom have failed to yield an increase in on-line Google Search activity. While there was an increase in interest in glaucoma it is unclear whether this led to an increase in health seeking behaviour.

  11. Characterizing Corrosion Effects of Weak Organic Acids Using a Modified Bono Test

    Science.gov (United States)

Zhou, Yuqin; Turbini, Laura J.; Ramjattan, Deepchand; Christian, Bev; Pritzker, Mark

    2013-12-01

To meet environmental requirements and achieve benefits of cost-effective manufacturing, no-clean fluxes (NCFs) or low-solids fluxes have become popular in present electronic manufacturing processes. Weak organic acids (WOAs) as the activation ingredients in NCFs play an important role, especially in the current lead-free and halogen-free soldering technology era. However, no standard or uniform method exists to characterize the corrosion effects of WOAs on actual metallic circuits of printed wiring boards (PWBs). Hence, the development of an effective quantitative test method for evaluating the corrosion effects of WOAs on the PWB's metallic circuits is imperative. In this paper, the modified Bono test, which was developed to quantitatively examine the corrosion properties of flux residues, is used to characterize the corrosion effects of five WOAs (i.e., abietic acid, succinic acid, glutaric acid, adipic acid, and malic acid) on PWB metallic circuits. Experiments were performed under three temperature/humidity conditions (85°C/85% RH, 60°C/93% RH, and 40°C/93% RH) using two WOA solution concentrations. The different corrosion effects among the various WOAs were best reflected in the testing results at 40°C and 60°C. Optical microscopy was used to observe the morphology of the corroded copper tracks, and scanning electron microscopy (SEM) energy-dispersive x-ray (EDX) characterization was performed to determine the dendrite composition.

This study aimed to analyze the impact of Bono’s announcement on public awareness of glaucoma using Google Search trends as an indicator of public interest in the disease. Google Trends was used to examine Google Search activity for the term ‘Glaucoma’ between 2009 and 2015 in both Ireland and the United Kingdom. Trend analyses were performed using Microsoft Excel Version 14.3.5. Increased Google Search activity for ‘Glaucoma’ in October 2014 was found in both Ireland and the United Kingdom. A five-fold increase from the mean Google Search activity for this term was found in Ireland and a two-fold increase from the mean Google Search activity for this term was found in the United Kingdom. No such increase in Google Search activity occurred during each country’s 2014 Glaucoma Awareness week. Google Trends is useful in medical research as a means of assessing public awareness of, and\\/or interest in, health related topics. Current approaches to glaucoma related health promotion in both Ireland and the United Kingdom have failed to yield an increase in on-line Google Search activity. While there was an increase in interest in glaucoma it is unclear whether this led to an increase in health seeking behaviour.

We examined the effects of Ecuador's Bono de Desarrollo Humano (BDH)--an unconditional cash transfer program that was rolled-out using a randomized design--on health and development outcomes in very young children. Communities that were randomly assigned to the treatment group began receiving the BDH in 2004 and those randomly assigned to the comparison group began receiving benefits two years later. Families enrolled in the BDH received a monthly cash stipend ($15USD) representing an approximate 6-10% increase in household income. Participants analyzed in this study are children aged 12-35 months from treatment (n = 797) and comparison (n = 399) communities in rural and urban Ecuador. Main outcomes measured were language skills (the Fundación MacArthur Inventorio del Desarollo de Habilidades Comunicativas-Breve), height-for-age z-score, and hemoglobin concentration. Results indicate that in rural areas, being randomized to receive the BDH in very early childhood led to significantly better performance on the number of words a child was saying, and on the probability that the child was combining two or more words. There were no significant effects on language development for children in urban areas and there were no effects on height-for-age z-score or hemoglobin concentration in rural or urban areas. A limited number of potential pathways with respect to cognitive/language stimulation, health behaviors, and parenting quality were also explored. Findings indicate that compared to children in comparison areas, rural children in treatment areas were more likely to have received vitamin A or iron supplementation and have been bought a toy in the past six months. This study provides evidence for significant benefits of an unconditional cash transfer program for language development in very young children in rural areas. Copyright © 2011 Elsevier Ltd. Circulating tumor cells (CTC) have substantial promise for multipurpose biomarker studies in prostate cancer. The IMMC-38 trial conducted by de Bono and colleagues, which was published in the October 1, 2008, issue of Clinical Cancer Research, demonstrated for the first time that CTCs are the most accurate and independent predictor of overall survival in metastatic prostate cancer. Since the publication of prospective trials demonstrating prognostic utility, CTCs have been utilized for nucleic acid analyses, for protein analyses, and in intermediate endpoint studies. CTC studies are also now facilitating the analysis of intrapatient heterogeneity. 5. IMPLEMENTING EDWARD DE BONO’S APPROACHES OF STRATEGIC THINKING IN THE FIELD OF PROFESSIONAL EDUCATION

Directory of Open Access Journals (Sweden)

    Olena Lykholat

    2017-04-01

Full Text Available Education is always regarded as a necessary factor of social development. One of the positive means to solve urgent problems in the field of professional education is not only systematization of the information, but also the creative accumulation and assimilation of the cultural experience and, as a result, of the scientific, artistic-design, project-constructive and/or technological principles of activities. The high standards to the future teachers’ professional education are caused by the binary character of the future activities: the teacher should be both a professional and a pedagogue. The transformation of the professional education, while there are lots of global challenges in the world, leads to the activation of the creative potential of the future pedagogue at a professional educational institution. The goal of this article is to analyze systems of thinking suggested by Edward de Bono, and to attempt implementing partially these approaches into strategic thinking in the field of professional education, i.e. in the future teachers’ sewing specialization at a professional educational institution. According to the goal of the article, the whole complex of scientific approaches and methods has been used at the different theoretical and empirical levels. The systemic approach is in the core of the research, following the idea of the integrity of thinking expressed by Edward de Bono and of mechanisms which facilitate it. At the moment in our volatile world there is a clear need in new type of thinking – creative and constructive, which allows to form new ideas and ways for development. The system of such a kind of thinking was developed by Edward de Bono. According to him, the main method for the process of problem solving should be: refusal from cliché and established patters of thinking; perception of the problem with humor; continuous questioning of permissiveness; change in the way of seeking for information; creation of integral

    2017-12-01

|| This paper develops a continuous-time random model of loss index triggers for cat bonds on the basis of the loss amount incurred until their maturity. Assuming that total loss amount due to a catastrophe is defined as the sum of the incurred loss amount plus the incurred-but-not-yet reported loss amount, we model the decreasing linear dynamics of the latter amount by means of an additive Brownian process (or Ornstein Uhlenbeck process; and get the former by the difference between the total loss amount and the incurred-but-not-yet-reported loss amount. Finally, we test the validity of the model by estimating its core parameters and by contrasting the goodness of fit through a data series of six floods occurred in several Spanish cities prone to suffer such kind of catastrophes.

She was admitted to our intensive care unit because of unstable angina, caused by critical blood flow reduction in a large portion of the myocardium, according to the severity of the symptoms and the electrocardiographic alterations. Because of the high risk related to heart surgery, the patient was successfully treated by unprotected angioplasty and drug-eluting stent positioning. Short- and mid-term outcomes were favourable. Subsequent tests confirmed the diagnosis of Marfan syndrome. After 2 years of follow-up, the patient remains asymptomatic and in good health. To our knowledge, this is the first report of a successful percutaneous intervention of the left main coronary artery in a patient with Marfan syndrome who had already undergone ascending aortic root and valve replacement by the Bentall-De Bono procedure for acute dissection.

Aortic disease is the main cause of death among patients with Marfan syndrome. Before the development of open surgery, most patients died in the fourth decade of life. Improvements in surgical techniques have facilitated prophylactic surgery and have dramatically changed the life expectancy of patients with Marfan syndrome. Valve-sparing techniques are becoming the standard surgical treatment for these patients, since the operative and long-term results are comparable with those obtained with the Bentall and De Bono procedure and their theoretical advantages over the Bentall and De Bono procedure are attractive for young patients. Distal aortic complications still cause substantial morbidity in patients who have undergone surgery. On the other hand, several medical approaches have appeared as alternatives or adjuncts to the standard treatment with beta-blockers. Mouse models of the disease have shown that the angiotensin II receptor blocker losartan can rescue the phenotype. Among female patients, pregnancy deserves special consideration. Aortic dissection occurs mainly in the third trimester of gestation and in patients with dilated aortas. As aortic dissection carries a high risk of maternal mortality and fetal demise, prophylactic aortic surgery is recommended before attempting pregnancy for those women with an aortic diameter exceeding 40 mm.

Previous studies show that the most toxic dioxin congener, 2,3,7,8-tetrachlorodibenzo-p-dioxin (TCDD), interferes with mineralization of the dental matrices in developing mouse and rat teeth. Culture of mouse embryonic molar teeth with TCDD leads to the failure of enamel to be deposited and dentin to undergo mineralization. Lactationally exposed rats show defectively matured enamel and retardation of dentin mineralization. To see if the impaired mineralization is associated with changes in the expression of dentin sialophosphoprotein (Dspp), Bono1 and/or matrix metalloproteinase-20 (MMP-20), thought to be involved in mineralization of the dental hard tissues, we cultured mouse (NMRI) E18 mandibular molars for 3, 5 or 7 days and exposed them to 1 μM TCDD after 2 days of culture. As detected by in situ hybridization of tissue sections, localization and intensity of Bono1 and MMP-20 expression showed no definite difference between the control and exposed tooth explants, suggesting that TCDD does not affect their expression. On the contrary, TCDD reduced or prevented the expression of Dspp in secretory odontoblasts and decreased it in presecretory ameloblasts. The results suggest that the retardation of dentin mineralization by TCDD in mouse molar teeth involves specific interference with Dspp expression

  16. Pro Bono Publico? Demand for Military Spending Between the World Wars

Directory of Open Access Journals (Sweden)

    Jari Eloranta

    2017-06-01

Full Text Available This article analyzes the demand for military spending in the 1920s and 1930s, based on variables arising from the international system and the selected countries. The main premise is that the military spending was an impure public good, implying that both public and private benefits drove the demand for this type of expenditure. Threats arising from the autocratic states in the 1930s increased these expenditures, and democracies overall tended to spend less. Moreover, the absence of clear international leadership by the USA or UK destabilized the international system and increased military spending, with alliances failing to produce a public good effect. Military spending resulted in joint products at the level of state and within state, and the level of economic development seemed to exert a downward pressure on the military spending of these states. There were some contradictory spillover effects felt by these states. On the whole, this article suggests that scholars should expand their explanatory models to include impure public good influences in military spending analysis.

Not investigations, if a disaster is ante portas and which consequences may occur, are content of this book. There are many publications written in detail about this themes. However new is, that there is someone who care about, if the results of so-called scientists are really correct. The author discovers due to facts, that the whole construction, which should support climate disaster, is a single cock-and-bull story. Constructed by the most supreme international climatic agencies to federal states of countries. After the discovery of this facts, the author follows the question: CUI BONO? Whom does it serve? So he stumbles on criminal machinations. This book is not only an economy- or polit thriller, as also simultanously a prove for exploitation of people by unscrupulous exploiters and egoists from economy and policy to manipulate and frighten them. 1. Paleoarchean and Cambrian observations of the geodynamo in light of new estimates of core thermal conductivity

    Science.gov (United States)

Tarduno, John; Bono, Richard; Cottrell, Rory

    2015-04-01

Recent estimates of core thermal conductivity are larger than prior values by a factor of approximately three. These new estimates suggest that the inner core is a relatively young feature, perhaps as young as 500 million years old, and that the core-mantle heat flux required to drive the early dynamo was greater than previously assumed (Nimmo, 2015). Here, we focus on paleomagnetic studies of two key time intervals important for understanding core evolution in light of the revisions of core conductivity values. 1. Hadean to Paleoarchean (4.4-3.4 Ga). Single silicate crystal paleointensity analyses suggest a relatively strong magnetic field at 3.4-3.45 Ga (Tarduno et al., 2010). Paleointenity data from zircons of the Jack Hills (Western Australia) further suggest the presence of a geodynamo between 3.5 and 3.6 Ga (Tarduno and Cottrell, 2014). We will discuss our efforts to test for the absence/presence of the geodynamo in older Eoarchean and Hadean times. 2. Ediacaran to Early Cambrian (~635-530 Ma). Disparate directions seen in some paleomagnetic studies from this time interval have been interpreted as recording inertial interchange true polar wander (IITPW). Recent single silicate paleomagnetic analyses fail to find evidence for IITPW; instead a reversing field overprinted by secondary magnetizations is defined (Bono and Tarduno, 2015). Preliminary analyses suggest the field may have been unusually weak. We will discuss our on-going tests of the hypothesis that this interval represents the time of onset of inner core growth. Summary Recent shortages in the supply of blood donations have renewed the interest in how blood donations can be increased temporarily. We survey the evidence on the role of financial and other incentives in eliciting blood donations among donors who are normally willing to donate pro bono. We present the predictions from different empirical/psychological-based theories, with some predicting that incentives are effective while others predict that incentives may undermine prosocial motivation. The evidence suggests that incentives work relatively well in settings in which donors are relatively anonymous, but evidence indicates also that when image concerns become important, incentives may be counterproductive as donors do not want to be seen as greedy. 2012-01-01

This is the second article in a series of three. It is essential to find out from patients what it is that they hope to achieve when requesting an improvement in their dental appearance. Their expectations, hopes and fears need to be explored in detail. The long-term biologic costs of some invasive procedures need to be explained to patients in advance so that they can make properly informed decisions. Failure to do so renders the practitioner vulnerable to a charge of behaving unethically. The differences between ethical marketing and selling are explained including the historic development of marketing. A practical approach, using a modification of the Edward de Bono Six Thinking Hats model is described to help ethical practitioners to develop sound treatment plans when dealing with complex aesthetic problems.

    2007-03-01

Physical therapy intervention for those with chronic disabling conditions typically follows an episode of care approach: therapists provide services when a decrement in functional performance occurs such that individuals require intervention to return to baseline performance. Attention to the psychosocial supports required for successful transition can be unintentionally minimized when the focus of an episode of care follows a change in physical function. The purpose of this case report is to present and discuss the challenges to successful community reintegration following physical therapy intervention with an emphasis on developing independent exercise habits in management of a person with multiple sclerosis. RW, presented in this case study, is a 52-year-old man diagnosed with progressive multiple sclerosis five years before self-referral to a pro bono physical therapy clinic.

    2003-10-01

This article investigates the rather unknown theme of “corporate identity and corporate image” as applied to the church. Starting from the premise that corporate identity enables us to communicate change, direction and a church’s point of difference, it is evident that proper strategic and visionary management is a prerequisite for the church today. “Corporate image is in the eyes of the world” and this urges the church to regard this undertaking in a serious light. Thus, a church's unique selling proposition has to be identified, not necessarily to compete, but to add specific value for its members. The concept of “sur/petition” of Edward de Bono (vis-à-vis competition is pursued in an integrated value system. The article addresses the distortion between the intended and the received image of the church.

    2018-03-01

Full Text Available This article evaluates the defence of violenti non fit inuiria in sport with specific reference to the principle of bonos mores or the “good morals” in society to tolerate injuries in sport. The increased prevalence of serious injuries in sport in the professional era, in which sportsmen earn their livelihood from sport, necessitate a review of the existing situation. The death of the Australian cricket player, Phil Hughes, as a result of fast, short-pitched bowling in cricket, has again put the spotlight on the aggressive and excessive use of "violence" in sport. The malicious intent in sport, to harm or even to kill an opponent, has made it necessary to ask if there should be any difference in the manner in which the perpetrator of violence in sport should be treated as against ordinary criminal law assault and murder offenders. A two-pronged approach is suggested in the article as a possible way of dealing with wrongfulness in cricket.

The three requirements for a Darwinian evolutionary process are replication, variation and selection. Dennett (2006) discusses various theories of how these three processes, especially selection, may have operated in the evolution of religion. He believes that the origins of religion, like the origins of language and music, may be approached scientifically. He hopes that such investigations will open a dialog between science and religion leading to moderation of current religious extremism. One problem with Dennett's program, illustrating the difficulty of breaking away from creationist thinking, is Dennett's own failure to consider how Darwinian methods may be used to study evolution of behavioral patterns over the lifetime of individual organisms.

    2018-02-01

ABSTRACT: One of the minor works of cardinal Roberto Bellarmino, De Gemitu Columbae sive De Bono lacrymarum (1617 is composed of three books: the first is dedicated to the "need for moans"; the second and third, respectively, to the sources and the fruits of the "tears". In investigating the origin of the moan, after quoting Isaiah and Nahum, the Author insists on a verse, particularly evocative, taken from the Song of Songs (6, 9. Therefore, the moan is not referred only to the animal in itself, but also to the whole Church: the work in question seems to be more connected to the textures of a "political theology" than to the classic counter-reformed edification readings. The present contribution aims to examine the relationships between De gemitu and the jus publicum ecclesiasticum, not only externum but also - and above all - internum. And, by this way, the highly debated theme of belonging to the Ecclesia, faced by the great Counter-reform theorist through the images of the dove and the chant.

  8. Engineering Codes of Ethics and the Duty to Set a Moral Precedent.

    Science.gov (United States)

    Schlossberger, Eugene

    2016-10-01

Each of the major engineering societies has its own code of ethics. Seven "common core" clauses and several code-specific clauses can be identified. The paper articulates objections to and rationales for two clauses that raise controversy: do engineers have a duty (a) to provide pro bono services and/or speak out on major issues, and (b) to associate only with reputable individuals and organizations? This latter "association clause" can be justified by the "proclamative principle," an alternative to Kant's universalizability requirement. At the heart of engineering codes of ethics, and implicit in what it is to be a moral agent, the "proclamative principle" asserts that one's life should proclaim one's moral stances (one's values, principles, perceptions, etc.). More specifically, it directs engineers to strive to insure that their actions, thoughts, and relationships be fit to offer to their communities as part of the body of moral precedents for how to be an engineer. Understanding codes of ethics as reflections of this principle casts light both on how to apply the codes and on the distinction between private and professional morality.

In 1953, during the building restoration of San Michele church (Bono, Sardinia, 16th-19th Century), a high number of disarticulated skeletons were recovered. From a group of 412 hip bones, two of these, affected by several pathological lesions, were analysed. The two coxal bones can be referred to the same individual, an adult man. A multi-analytical study, started with the purpose of investigating the bone pathology, was extended to characterize the mineral components of a large representative set of bones from the same ossuary, all attributed to adult men who lived in the region four-two centuries ago. A quantitative ICP-AES analysis for Ca, Fe, Mg, Mn, Na, Pb and Zn was executed, and a chemometric investigation on the results was performed. This approach gave evidence of the effects of diagenesis, allowed some hypothesis of the incidence of the known dietary habits on bone composition, and completely differentiated the pathological bones from those of a normal population on the basis of the mineral composition. Moreover, porosity, crystallinity and FT-IR analysis were conducted on both non- and pathological sample. Copyright © 2016 Elsevier GmbH. All rights reserved.

Findings in 54 patients (mean age 39 years, range 18-66 years, 25% female) were analyzed. Of these patients, 21 had dissection of the ascending aorta (15 acute and six chronic) and 33 had aneurysm of the ascending aorta. Surgery was classified as emergency surgery in three cases, as urgent in 15, and as scheduled surgery in 36. The Bentall-De Bono procedure was performed in 39 patients, aortic valve reimplantation was carried out in nine, Cabrol's operation was performed in three, and a homograft was used in three. The mean diameter of the ascending aorta was 66.6 mm. Overall, in-hospital mortality was 3.7% (33.3% for emergency surgery vs. 2.8% for scheduled surgery; P< .001). During the mean follow-up period of 4 years (range, 2 months-14 years), seven patients died, including four who died due to type-B aortic dissection. The actuarial survival rate at 2, 5 and 10 years was 94%, 83% and 75%, respectively, with 88%, 67% and 43% of patients, respectively, not requiring reoperation. Elective aortic root replacement was associated with a low risk and a good survival rate.

Full Text Available This paper is based on the development and results of the research project ‘School ecosystems for the development of children’s creative thought’, which has been being implemented under Action Research parameters since 2010. Its purpose is to design and carry out some pedagogical strategies leading to creative thought development in third, fourth and fifth grade children belonging to Technical School Rafael Uribe, Leonera headquarters, in the municipality of Toca, Department of Boyaca. The project is based on the Ecological Model for Human Development formulated by Urie Bronfenbrenner, Eduard de Bono´s creative thought basis, George Polya’s problem solving method, and the Philosophy for Children proposal stated by Matthew Lipman and promoted in Colombia by Diego Pineda. Those approaches are understood as cross-wise themes leading children to a reflection, creation, argumentation, and analysis process when facing the designed settings (ideas inventor, Math and recreation, Technological Curiosity, and Life Crops established individually in terms of time and actions, which have made possible to transform the ways of thinking and acting of those taking part in the pedagogical process through questions that guide the everyday duties and the scope of education aims.

Individual differences in emotional labor and subsequent vulnerability to burnout have been explored through the prism of Congruence Theory, which examines the congruence between personality traits and job requirements (Bono & Vey, 2007; Moskowitz & Coté, 1995). Drawing on theory and research dealing with the association between the need to belong and self-regulation (Baumeister, DeWall, Ciarocco & Twenge, 2005), this study examined the relationship between need to belong and service employees' surface acting and associated outcomes. In Study 1, participants (N = 54) were asked to write a response to an aggressive email from a hypothetical customer. The need to belong was positively related to display of positive emotions and negatively to display of negative emotions in the responses, but not related to felt anger, suggesting that it is associated with the inclination to engage in surface acting. In Study 2, a field study conducted with 170 service employee-customer dyads, surface acting mediated the positive relationship between fear of isolation and emotional exhaustion, and emotional exhaustion mediated the relationship between surface acting and customer satisfaction. These results suggested that service employees with a strong need to belong might have a heightened risk of burnout because of their inclination to engage in emotional labor. Caldron, Paul H; Impens, Ann; Pavlova, Milena; Groot, Wim

    2018-01-01

Short-term medical missions (STMMs) refer to the provision of direct pro bono medical services in lower and middle income countries for periods ranging from days to a few weeks by physicians from rich countries. Survey data have provided limited information on demographic and professional profiles of physicians as well as monetary and manpower inputs. Understanding why physicians participate, however, remains incomplete. The study's objective was to elicit physicians' motivations directly. Semi-structured interviews of physicians identified through snowball recruiting were conducted to explore motivational themes and then analyzed using narrative software employing directed content analysis methodology. Twenty physicians from varying backgrounds and specialties were interviewed. Responses identified aspects of the decision to participate and the relative influence of economic, diplomatic, value-related, and emotive constructs. Personality traits may be more influential to participation than demographic, professional, or socioeconomic determinants. Word-of-mouth recruitment appears to underlie the increase in STMM activity, facilitated by information technology. Reported key motivators for physician participation in STMMs tend to parallel schools of thought regarding philanthropy and volunteering and include satisfaction from helping in challenging conditions of limited resources, learning experiences, appreciation from patients, sense of renewal, and the legacy effect of teaching. In a retrospective, case-control study, 275 women with Alzheimer’s disease (AD and 276 control patients from a hospital population were enrolled from July 2007 to December 2010. The AD patients presented with later menopause (P < 0.01, lower occurrence of surgical menopause (P < 0.04, reduced hormone-replacement therapy intake (P < 0.0001, and a longer reproductive life span (P < 0.01, compared to controls. No significant differences were found with respect to age at puberty, number of pregnancies, previous abortions, or contraceptive therapy. A higher education level appeared to have a protective role against the risk of developing AD. In women, menopause and hormone-replacement therapy can differentially modulate the clinical manifestations of AD, but these factors do not play a predictive role in its development. Keywords: Alzheimer’s disease, gender, menopause, hormone-replacement therapy, surgical menopause, education

Full Text Available Este artículo obedece a tres objetivos principales.

The 2016 RAD-AID Conference analyzed the accelerated global activity in the radiology community that is transforming medical imaging into an effective spearhead of health care capacity building in low- and middle-income countries. Global health efforts historically emphasized disaster response, crisis zones, and infectious disease outbreaks. However, the projected doubling of cancer and cardiovascular deaths in developing countries in the next 15 years and the need for higher technology screening and diagnostic technologies in low-resource regions, as articulated by the United Nations' new Sustainable Development Goals of 2016, is heightening the role of radiology in global health. Academic US-based radiology programs with RAD-AID chapters achieved a threefold increase in global health project offerings for trainees in the past 5 years. RAD-AID's nonprofit radiology volunteer corps continue to grow by more than 40% yearly, with a volunteer base of 5,750 radiology professionals, serving in 23 countries, donating close to 20,000 pro bono hours globally in 2016. As a high-technology specialty interfacing with nearly all medical and surgical disciplines, radiology underpins vital health technology infrastructure, such as digital imaging archives, electronic medical records, and advanced diagnosis and treatment, essential for long-term future health care capacity in underserved areas of the world. Although many individuals applying for political asylum allege maltreatment and sometimes torture in their countries of origin, the utility of medical evaluations in asylum adjudication has not been documented. This study compares the asylum grant rate among US asylum seekers who received medical evaluations from Physicians for Human Rights (PHR), with rates among asylum seekers who did not receive PHR evaluations. Retrospective analysis was carried out on all asylum cases referred to PHR between 2000 and 2004 for medical evaluations for which adjudication outcome was available. Basic demographic information was obtained: age, sex, country of origin, English language ability, US region where adjudication occurred, whether legal representation was pro bono, type of evaluation, provision of oral court testimony, and whether asylum seekers were in detention. Cases were analyzed descriptively and with chi square tests. Between 2000 and 2004, 1663 asylum seekers received medical evaluations from PHR; the adjudication status (either granted or denied) was determined in 746 cases at the time of the study. Of these cases, 89% were granted asylum, compared to the national average of 37.5% among US asylum seekers who did not receive PHR evaluations. Medical evaluations may be critical in the adjudications of asylum cases when maltreatment is alleged.

Preservation of the aortic valve using the technique described by David has been shown to be as effective as the Bentall-De Bono procedure. It avoids both the need for long-term anticoagulation and the complications associated with mechanical prostheses. We report our initial experience using this technique in patients with Marfan syndrome. Between April 2004 and April 2006, we used the David reimplantation technique in 40 patients with an aortic root aneurysm. Eighteen patients had Marfan syndrome. Their median age was 29 years (13-55 years). Echocardiography showed that the median diameter of the aortic sinus was 53 mm (46-59 mm). In 17 patients, aortic valve preservation was possible. No patient died during hospitalization and there were no significant complications. On echocardiography at discharge, no patient had greater than grade-II aortic regurgitation. During a median follow-up period of 8 months (1-24 months), one patient died due to rupture of an abdominal aneurysm. The others are all in New York Heart Association class I. Preservation of the aortic valve by means of valve reimplantation produced excellent results. It avoided both the thromboembolic and hemorrhagic complications associated with prostheses and the need for long-term anticoagulation. If reimplanted valves continue to function adequately over the long term, this technique should become the treatment of choice for aneurysms of the ascending aorta in patients with Marfan syndrome.

Full Text Available Legal aid in India has evolved over the last few decades since 42nd Amendment to the Indian Constitution. This paper attempts to provide philosophical underpinnings suggesting how legal aid model has evolved over the years and excogitate a newer trajectory for its future evolution. It delves into weighing Kant’s imperfect duty justifying a charity based regime and marks a transition to utilitarian model suggesting requirement of institutional need to address issues of basic liberty of ‘access to justice.’ It also spells out Rawls’ principles of justice and attempts to explore their applicability in the Indian context, to chart out a road map for future. While contrasting different models on legal aids, it makes a finding that, India doesn’t accord priority to liberty of access to justice. The Indian Supreme Court has emerged as a bastion of liberty but the finer details of the enactment has been messed up by the Indian lawmakers. The lower compensation to lawyers and lack of alternative incentives in attracting established litigators, testifies this. There is a convergence in Kantian duty of benevolence and Rawls’ liberty principle but in the world of moral relativism, a fair compensation must precede before imposing any obligation on lawyers to take up pro bono matters, as doing so, is likely to compromise their ‘true needs.’

  7. Production, soil erosion and economic failure in new citrus plantations in Eastern Spain

Eastern Spain has been worldwide well known by the high quality citrus production (Piqueras, 2012). During the last century, the export of València's oranges contributed to a high income in Spain albeit during the last decade the revenues for the small farmers were short (Bono, 2010). The orange agricultural specialization in València begun at the end of the eighteenth century in the town of Carcaixent, close to the Xúquer river, where the first commercial orange groves were planted. This was due to the climatic conditions (no frosts) and the traditional flood irrigation systems. The orange trade was not important until the second half of the nineteenth century, due to a combination of factors: i) the increasing demand of oranges from the United Kingdom, first, and then from Germany, France and other north-european industrialized countries; ii) the highly productive capacity of the Valencian soil thanks to its mild weather and irrigated fields; iii) the open mindedness of Valencian farmers towards innovation; and, iv) the developemnt of a railways network which made it possible to bring the oranges into the shipment ports (Bono, 2010; Piqueras, 2012). The Valencian orange trade knew its peak during the period 1925-1930 but later it experienced an economic crisis because of wars (both in Spain and Europe) and did not recover until the 1960's (Piqueras, 1999; Bono, 2010). After Spain's EEC (European Economic Community) membership (1986) and the creation of EU (1993) Valencian citrus sector grew: new orange groves were planted, new commercial varieties (especially mandarins) were promoted, and exports increased. Nevertheless, nowadays Valencian orange sector suffers from a structural problem: the small farm size and the lack of a good commercial network of distribution. But in spite of the current crisis, the orange groves' impact on landscape is still huge in Valencia, since it creates a thick forest of orange trees stretching not only the floodplains but also

Full Text Available Contemporary dentistry is, first of all, characterized by diverse accelerated development, owing to improvements of information and other technologies, as well as the development of dental materials (shape-memory biomaterials, nanomaterials, biomaterials for application in tissue engineering, etc.. Expert doctrinaire attitudes move from the direction of operative interventions, whereby disease and acute symptoms are primarily treated, towards the strengthening of oral health by minimally invasive procedures. A particular place in patients’ total rehabilitation belongs to numerous esthetic procedures which, to a large extent, make up a wants-based service, led by the patients’ needs and affinities. This paper deals with differences between cosmetic and esthetic dentistry. The complexity of esthetic dentistry, which favors therapy with the change of function parameters in care for the patient, is emphasized. On the other hand, more attention is paid to the need to know and respect ethical and marketing principles that follow any activity of dentists, starting from the first contact with the patient, the selection of certified materials, to the implementation of the appropriate treatment plan. Well-directed communication and comprehensive awareness of the patient, the use of the visual analog scale, consideration of realistic resources in therapy, and the acceptance of de Bono model of adopted parallel thinking are determinants which help dentists define a problem adequately, find quality solutions, open alternative solutions, and reduce the potential risks in patients’ therapy.

The Sonny Bono Copyright Term Extension Act of 1998 (CTEA, while having survived a surprisingly strong constitutional challenge in Eldred v. Ashcroft, remains controversial on efficiency ground. This article seeks to provide an economic analysis of the social costs of prolonged copyright terms, taking into account the potential of digital rights management (DRM technologies. The article suggests DRM technologies, when properly designed, may reduce the dead weight loss of copyright monopolies and the transaction costs of copyright licensing, seemingly strengthening the argument for prolonged or even perpetual copyright protection. Current DRM technologies are nevertheless far from ideal. With

Directory of Open Access Journals (Sweden)

    1999-03-01

Full Text Available The pactum successorium: stepchild of South African lawSouth African law does not generally permit a testator to bequeath his estate by means of contract. This rule flows from the general rule in Roman Law that an estate must devolve either by will or in terms of the law governing intestate succession. Despite the prohibition against succession pacts there have been numerous attempts by contracting parties to regulate devolution of their estates inter vivos by means of contract. Such contracts are commonly called pacta successoria and have been regarded as contra bonos mores and invalid since early law. Although a number of reasons have been put forward for the maintaining of the prohibition against pacta successoria, the main reason for the aversion against the pactum successorium is the fact that they interfere with the testator’s freedom of testation. It is suggested that the existing law in South Africa with regard to the pactum successorium should be changed. This calls for a reappraisal of the principle of freedom of testation. It is clear that South African law takes this principle much further than is the case in other legal systems such as in England and Germany. Furthermore, the South African devotion to the principle of freedom of testation appears strange in view of the obvious conflict with the principle of freedom of contract. Finally, it is suggested that the common law prohibition against the pactum successorium should be abolished. Since it is clear from the attitude of the courts so far, this can only be effected by legislature.

    Science.gov (United States)

Mazan, Melissa R; Kay, Gigi; Souhail, Mohammed Larbi; Bubeck, Kirstin; Jenei, Thomas; Merriam, Jay

There is an increasing need to produce veterinarians with knowledge and critical thinking skills that will allow them to participate in veterinary global health equity delivery, particularly in the developing world, where many people remain dependent on animal-based agriculture for a living. This need for veterinarians trained in global health is reflected by the demand among students for greater exposure and education. At the same time, many students are held back from on-site training in global health due to constraints of cost, time, or family obligations. The purpose of this article is to describe the use of a telemedicine approach to educating veterinary students at Tufts Cummings School of Veterinary Medicine. This approach simultaneously provides expert consultation and support for a pro bono hospital in the developing world. The development of a telemedicine teaching service is discussed, from initial ad hoc email consultation among friends and associates to a more formal use of store-and-forward delivery of data along with real-time videoconferencing on a regular basis, termed tele-rounds. The practicalities of data delivery and exchange and best use of available bandwidth are also discussed, as this very mundane information is critical to efficient and useful tele-rounds. Students are able to participate in discussion of cases that they would never see in their usual clinical sphere and to become familiar with diagnostic and treatment approaches to these cases. By having the patient "virtually" brought to us, tele-rounds also decrease the usual carbon footprint of global health delivery.

Health librarians should keep up-to-date in a dynamic environment and accept the importance of continuing personal development (CPD) and growth in their critical reflection and creative thinking skills. They also need to acknowledge the potential value of research activity and the challenges of ongoing improvement and development. Conference programmes may prove a useful source of stimulation, especially if supplemented by creativity techniques, action research and the ideal of 'finding flow'. The article analyses the themes and papers presented at the 10th International Conference on International Medical Librarianship (ICML) to identify opportunities for further research, literature reviews, assessment of practices and services, etc. Content analysis approach to conference papers and suggestions for further action including supplementing with techniques of creativity and group input. A fairly extensive list of further actions (although not intended to be exhaustive) is suggested for the sixteen conference themes. Although subjective, the list might help to stimulate growth in research on health librarianship and demonstrate how one source of stimulation--conference programmes (regularly presented to medical library communities)--can be used. Content analysis has proven a constructive means of generating research questions from a conference programme. Content analysis and other methods aimed at stimulating creative and progressive thinking, including brainstorming, force field analysis, De Bono's 6 hats, creative swiping and creative visualisation, may prove equally useful and require further investigation. To ensure an ongoing cycle, these can be linked to action research. © 2012 The authors. Health Information and Libraries Journal © 2012 Health Libraries Group.

Population delineation throughout the annual life cycle for migratory birds is needed to formulate regional and national management and conservation strategies. Despite being well studied continentally, connectivity of sandhill crane Grus canadensis populations throughout the western portion of their North American range remains poorly described. Our objectives were to 1) use global positioning system satellite transmitter terminals to identify summer distributions for the Lower Colorado River Valley Population of greater sandhill cranes Grus canadensis tabida and 2) determine whether intermingling occurs among any of the western greater sandhill crane populations: Rocky Mountain Population, Lower Colorado River Valley Population, and Central Valley Population. Capture and marking occurred during winter and summer on private lands in California and Idaho as well as on two National Wildlife Refuges: Cibola and Sonny Bono Salton Sea National Wildlife Refuges. A majority of marked greater sandhill cranes summered in what is established Lower Colorado River Valley Population breeding areas in northeastern Nevada and southwestern Idaho. A handful of greater sandhill cranes summered outside of traditional breeding areas in west-central Idaho around Cascade Reservoir near Donnelly and Cascade, Idaho. For example, a greater sandhill crane colt captured near Donnelly in July 2014 survived to winter migration and moved south to areas associated with the Rocky Mountain Population. The integration of the greater sandhill crane colt captured near Donnelly provides the first evidence of potential intermingling between the Lower Colorado River Population and Rocky Mountain Population. We suggest continued marking and banding efforts of all three western populations of greater sandhill cranes will accurately delineate population boundaries and connectivity and inform management decisions for the three populations.

To describe the clinical cardiac manifestations and temporal evolution of Marfan syndrome in children; to estimate the incidence of annuloaortic ectasia and mitral valve prolapse; and to evaluate tolerability and efficacy of beta-blockers in these patients. During one year, 21 children with Marfan syndrome underwent serial clinical and echocardiographic examinations. Echocardiograms assessed: the presence of mitral valve prolapse, aortic root diameter, mitral and aortic valves regurgitation, and aortic enlargement during beta-blocker therapy. Eleven patients had two measurements of the aortic root taken one year apart. The children were asymptomatic throughout the study. Mitral prolapse was found in 11 (52%) children. Annuloaortic ectasia occurred in 16 (76%) patients and found to be mild in 42.8%, moderate in 9.5%, and severe in 23.8%. One of these patients underwent aortic valve replacement and repair of the ascending aorta by the Bentall-De Bono technique, with good results. Heart rate decreased by 13.6% (from 85 to 73 bpm; p < 0.009) with the use of beta-blockers; however, aortic root diameter increased by 1.4 mm/year (p < 0.02). One child could not be given beta-blockers due to bronchial asthma, and no significant side effects were observed in the remaining children, including one who also had bronchial asthma. The children remained asymptomatic throughout the study, the use of beta-blockers led to a significant decrease in heart rate, and no significant adverse effects were observed. Contrary to the literature, incidence of annuloaortic ectasia was high among the study population, greater than that of mitral valve prolapse, even during beta-blocker therapy.

  2. Economic wealth and soil erosion in new Citrus plantations in Eastern Spain or how to explain the Land Degradation

We use to accept the idea that the best oranges are coming from Valecia Region in Eastern Spain. Although the oranges are originally from Eastern Asia, Valencia is having a mild climate in winter, with a low recurrency of frost and is strategically located close to the largest market of citrus: Western Europe. This resulted in a continuous growth of production and trade of citrus, and contributed to make the Valencia Region the largest World exporter (Bono, 2010). This economical success reached the highest point after the EU and Spain agreement in 1986. This expansion of citrus plantations were done on steep slopes allowed by the drip irrigation systems that does not need leveling the land as it was done by new farmers with large properties. The traditional farming of oranges was done in small properties, flood irrigation and leveled land. Those changes are triggering intense soil erosion rates such were shown by previous researchers in Valencia (Cerdà et al., 2009). This impact is also shown in other regions with a similar citrus production evolution, and China is a clear example (Wang et al., 2010; Liu et al., 2012). Land This research evaluate the relations between the investment (economic wealth) of the owners of citrus plantations and the soil erosion rates on their orchards. The economic wealth of the onwers was measured on the size of their properties and after an interview. The soil erosion rates were measured by means of rainfall simulation experiments in each farm by means of thunderstorms of 10 years return period (55 mm h-1). The results show that the soil losses in the new plantations are extremely high (> 10 Mg ha-1 y-1), and that we can show three types of orchards: 10.1. The soil erosion rates where positively related to the size of the farms. The higher erosion rates are shown also by the scientific literature review. Chemically treated plantations (Cerdà, 2002) show high erosion rates due to the road construction too (Cerdà, 2007) and is

  3. Globalization and sustainable development an E7 point of view

    Energy Technology Data Exchange (ETDEWEB)

    Strassburg, W.

    1998-07-01

The energy sector is a crucial feedstock to economic development. One example of this industry sector's contribution towards sustainable development is the so-called E7 initiative on sustainable energy development of some of the biggest electric utilities. E7 members from Canada, France, Germany, Italy, Japan and the US are demonstrating the functioning of the requested globally synchronized approach between developed and developing countries. E7 members focus their activities on (1) the efficient use of primary energy resources, (2) maximizing the use of renewable energy resources, (3) maximizing efficiency in the generation, delivery, and use of electricity, (4) minimizing environmental impacts of energy production and use and, (5) implementing innovative options to promote win-win benefits for the environment and the economy through their network of expertise on a pro bono basis. A main emphasis lies in the consistent Joint Implementation given the fact that innovative and efficient Green House Gas reduction measures will be the core of future E7 activities. Especially commercial projects will provide valuable contributions to Green House Gas reductions as well as to economic development of the recipient country. Other instruments, such Emission Trading and Clean Development Mechanism will have to be investigated appropriately in terms of their practicability for Green House Gas reductions so that their will be a notification by the international climate protection regime. Therefore Emission Trading and Clean Development Mechanism are of importance for E7 members' future operations, too. With respect to Sustainable Development industry, energy and environmental policy in leading industry countries must be more closely aligned to a global approach than has so far been the case. The electricity sector is called on to make a major contribution.

  4. The content of arbitration agreement: Facultative elements as an instrument for exercising contractual freedom

    2014-01-01

Full Text Available The content of an arbitration agreement is of great practical importance, given the effect its provisions may have on the rights and interests of the parties in the arbitration proceedings. Beside the mandatory elements, an arbitration agreement may include numerous facultative provisions, where parties express their contractual freedom, limited only by the imperative law and institutional arbitration rules. Even in cases when contractual provisions are contrary to the imperative law, in many states, the policy of maintaining arbitration agreement would result in ignoring the problematic provisions. The list of facultative elements of an arbitration agreement is practically limitless; among other elements, it may include: time limitations on the validity of an arbitration agreement; determinations referring to the composition of the arbitration tribunal; detailed rules pertaining to the procedure, decision-making processes and content of the arbitration award as well as its annulment; provisions on the choice of law; the right of third parties to intervene; joinder, consolidation and the authority of arbitration tribunal to decide as amiable compositeur or ex aequo et bono. The development of international commerce as well as arbitration legislature and practice, featuring transactions of ever-increasing complexity, have brought about the need to establish dispute resolution mechanisms modulated according to their specific characteristics. The customary practice of concluding arbitration agreements in the form of standardized and simple clauses is being challenged by the growing complexity of international trade. Therefore, not only should a modern arbitration agreement clearly demonstrate the parties' intent to submit a dispute to arbitration but it should also conform the arbitration procedure (as much as possible] to the content of the parties' relationship and the dispute that has emerged or may arise thereof.

  5. TOWARDS TOTAL INTEGRATION IN DESIGN STUDIO

Full Text Available Transmission of knowledge has been defined as “bringing the right knowledge by the right route at the right time to the right places.” In this context there is need to analyze the various pedagogical shifts associated with the decisive process of transmission and transaction of knowledge in design studio. Critical understanding of the importance of tangential knowledge and its integration within the design studio, leading to a comprehensive whole, is a significant aspect to be properly evolved and nourished in the studio. It can be argued that knowledge is not a substitute for architectural imagination but inadequate knowledge would handicap the general level of design. Being satisfied to manipulate formal configurations does not provide insights into the human experience. If the different types of knowledge that architecture requires are ignored, the profession will lose its credibility in the eyes of society. With the body of knowledge expanding diversely with the escalating wants of the user, and to further sustain the built environment with further progression, it’s quite certain to have an innovative design process that has a feel of antecedents yet is nourished by rationalism. Architectural Design is to an extent the yield of a creative process brought out through a refined approach, skill, and dexterity to suit the purpose. The assessors, the jury, or the teacher has created an aura of mystique around good design, without much explaining what good design is. Architectural education involves application of a theory of knowledge – what is known and how it is to be known. Nothing is taught unless it is learnt (Bono. Does the key to these issues lie in shifting from conventional mode to Total Integration Mode of Education?

The rights of women and people living with HIV (PLHIV) are protected under South African law, yet there is a gap in the application of these laws. While there are numerous systemic and social barriers to women's and PLHIV's exercise of their legal rights and rights to access social services, there has been little effort to document these barriers as well as legal needs and knowledge in this context. 1480 HIV-positive and HIV-negative women recruited from an antenatal clinic in Umlazi Township completed a questionnaire on legal knowledge, experience of legal issues, assistance seeking for legal issues, and barriers to seeking assistance. We compared the legal knowledge and experience of legal issues of HIV-positive and HIV-negative women, and described assistance seeking and barriers to assistance seeking among all women. Both HIV-positive and HIV-negative women had high levels of knowledge of their legal rights. There were few important differences in legal knowledge and experience of legal issues by HIV status. The most common legal issues women experienced were difficulty obtaining employment (11 %) and identification documents (7 %). A minority of women who had ever experienced a legal issue had sought assistance for this issue (38 %), and half (50 %) of assistance sought was from informal sources such as family and friends. Women cited lack of time and government bureaucracy as the major barriers to seeking assistance. These results indicate few differences in legal knowledge and needs between HIV-positive and HIV-negative women in this context, but rather legal needs common among women of reproductive age. Legal knowledge may be a less important barrier to seeking assistance for legal issues than time, convenience, and cost. Expanding the power of customary courts to address routine legal issues, encouragement of pro bono legal assistance, and introduction of legal navigators could help to address these barriers.

  7. Overcoming the Challenges of Co-creation

    2016-12-01

There is growing interest in co-creation, especially for community-related issues like climate change, resilience, pollution, and environmental justice. Nevertheless, co-creation is still not mainstream practice in either geosciences or the world of decision-makers. This presents many challenges. On the science side, challenges include a paucity of training opportunities, lack of funding for co-creation, difficulty publishing or otherwise getting credit for the effort, and a perceived lack of prestige compared to theoretical research. On the community side, parallel challenges include a lack of experience working with scientists or thinking about geoscience's relevance to community issues, tight budgets and competing priorities, the need for outputs beyond publications, and the difficulty including science among a range of factors. Additionally, scientists and community leaders often work across public and private sectors and must navigate different approaches to data, privacy, and accountability. We'll use this session to explore opportunities to overcome the challenges of co-creation. Systems thinking suggests a range of approaches: enabling individuals, reducing specific challenges, changing the relationship between the elements of the systems, and changing the goals or mindsets of the systems - each more powerful than the last. For example, mentoring and coaching enables individuals, and pro-bono work eases the challenge of getting professional credit. New modes of output, like plain language abstracts, change the relationship between publications and other outputs. We can work on changing mindsets by publicizing and celebrating individual successes. With more effort and impact, we can build collaborations in the collective impact model, where we bring scientific and community organizations together around a common agenda and shared measurement. Building on these examples, we will use this session to collect strategies and opportunities from all participants.

A key challenge for asylum seekers in the United States is being able to provide evidence of prior persecution in their home countries. Medical/psychological affidavits corroborating applicants' accounts often make the difference between successful and unsuccessful applications. The purpose of this study was to identify the unmet demand for and features of effective medical/psychological affidavits in the asylum process, as well as the personal and systemic barriers for asylum seekers. This is a qualitative study of semi-structured interviews with legal professionals who work in asylum law. Sixteen asylum lawyers and one Board of Immigration Appeals accredited representative practicing in the state of Michigan, United States, participated in this study. All participants noted that a vast majority of their asylum cases would benefit from a medical affidavit but that they have difficulty finding qualified physicians with experience writing such affidavits and testifying as expert witnesses. The major barriers to obtaining medical/psychological evaluations included inability to pay for services, lack of practitioner availability, and lack of practitioner training. The participants reported that features of a strong medical affidavit included clear, concise, and corroborative accounts that supported the applicant's story from a diagnostic perspective and forensic descriptions that reinforced the credibility of the applicant. Several also noted that medical/psychological evaluations frequently would reveal additional details and incidents of trauma beyond those stated in the applicant's preliminary statement. The study results suggest substantial unmet need for trained physicians to perform medical and psychological evaluations on a pro bono basis. Lawyers' recommendations regarding effective medical affidavits and necessary ongoing support for asylum applicants should inform current efforts to improve physician and lawyer collaborations on asylum cases.

We present the first spectroscopic abundance determination of iron, α-elements (Si, Ca, and Ti), and sodium for the Mira variable V1 in the metal-rich globular cluster NGC 5927. We use high-resolution (R ∼ 28,000), high signal-to-noise ratio (∼200) spectra collected with WINERED, a near-infrared (NIR) spectrograph covering simultaneously the wavelength range 0.91–1.35 μm. The effective temperature and the surface gravity at the pulsation phase of the spectroscopic observation were estimated using both optical (V) and NIR time-series photometric data. We found that the Mira is metal-rich ([Fe/H] = ‑0.55 ± 0.15) and moderately α-enhanced ([α/Fe] = 0.15 ± 0.01, σ = 0.2). These values agree quite well with the mean cluster abundances based on high-resolution optical spectra of several cluster red giants available in the literature ([Fe/H] = ‑ 0.47 ± 0.06, [α/Fe] = + 0.24 ± 0.05). We also found a Na abundance of +0.35 ± 0.20 that is higher than the mean cluster abundance based on optical spectra (+0.18 ± 0.13). However, the lack of similar spectra for cluster red giants and that of corrections for departures from local thermodynamical equilibrium prevents us from establishing whether the difference is intrinsic or connected with multiple populations. These findings indicate a strong similarity between optical and NIR metallicity scales in spite of the difference in the experimental equipment, data analysis, and in the adopted spectroscopic diagnostics. Based on spectra collected with the WINERED spectrograph available as a visitor instrument at the ESO New Technology Telescope (NTT), La Silla, Chile (ESO Proposal: 098.D-0878(A), PI: G. Bono).

  14. Access to Justice in South Africa: Are there Enough Lawyers?

    2013-07-01

Full Text Available This paper addresses head on the contention by a prominent legal practitioner in South Africa that there are too many lawyers in the country. It does not canvass the complex issues involved in determining the meaning of access to justice or the relationship between law and society in the context of legal services, and deals with access to justice in the narrow sense of the delivery of legal services in South Africa. The paper analyses the evidence presented to substantiate the contention that there are too many lawyers against the socio-economic environment in South Africa and the requirements of the Constitution. It recognizes that the country has only a minority of people who can afford lawyers and compares the ratio of lawyers to people in this category with the ratio in other developed countries. It also recognizes that large numbers of people who cannot afford lawyers may need them and that such people will have to rely largely on the state-funded national legal aid body, Legal Aid South Africa and other mechanisms. The paper discusses the different modes of delivery of legal aid services by Legal Aid South Africa, as well as those provided by the legal profession pro bono, public interest law firms and mechanisms that compliment or are alternatives to lawyers, in the light of the number of practicing lawyers in the country. An analysis is made to determine if there are enough lawyers to provide the necessary legal services required by the Constitution in criminal matters, and for civil matters in general for those who can and cannot afford lawyers. The paper concludes that there are not enough lawyers in the country at present to provide access to justice in the narrow sense, and suggests how this shortage can be overcome by using mechanisms that provide alternatives to lawyers.

The result has been a nodalisation of the cities' economies, documented by their high concentration of command and control functions essential for economic globalization. In order to specif the relationship between global city formation and the deepening of global integration we draw on the findings of the global city and global commodity chain literature. Since advanced producer services have been identified as key actors in interlocking de-centralized production sites and urban networks we have analyzed the involvement of financial institutions in bond and share issues of the 50 top ranked Mexican and Chilean enterprises. Based on this initial empirical investigation we take a first step to specif how the two firm-based, trans-state networks -global city- and global production networks - relate

  17. Severe bill deformity of an American Kestrel wintering in California

    2011-01-01

During a recent survey for West Nile virus in wild birds around the Sonny Bono Salton Sea National Wildlife Refuge, Imperial County, California (Dusek et al. 2010), we captured a female American Kestrel (Falco sparverius) with a severe bill deformity (Figure 1). The kestrel was captured on 9 March 2006, at 08:45, approximately 0.25 km south of the intersection of Wiest and Lindsey roads (33°  08' 42' N, 115° 26' 59' W) and 6 km east-northeast of Calipatria. It was caught on a bal-chatri trap baited with a domestic mouse (Berger and Mueller 1959), as were all the 208 kestrels captured during this study. The bird was initially perched on a high transmission line running along Wiest Road and was caught within 10 minutes of our setting the trap. In examining the bird, we observed that the maxilla beyond the cere was missing. The upper bill structure from the palatine process, which included part of the maxilla, the entire premaxilla, and the external rhamphotheca (the hardened keratin layer cover ing the premaxilla) was missing rostral to the bird's cere and nares (Threlfall 1968, Lucas and Stettenheim 1972, Proctor and Lynch 1993). The epidermal layer of the cere appeared to have fused over the remaining area between the nares where the upper bill normally would have been. The deformation did not appear to be recent or related to our trapping, as there were no obvious abrasions or open wounds in the region surrounding the nares and oropharynx or signs of recent trauma surrounding the oropharynx area. Both nares were clearly defined, and the tongue protruded from the open oropharynx area. After completing the physical examination, measurements, and obtaining a blood sample for testing for West Nile virus, we released the kestrel at the location of capture. After its release, we monitored the kestrel's behavior for approximately 30 minutes but did not observe any additional hunting.

    2008-01-01

Full text: Problem solving skills are essential for all radiation protection personnel. Although some students have more natural problem solving skills than others, all students require practice to become comfortable using these skills. At the University of Ontario Institute of Technology (UOIT), a unique one-semester course was developed as part of the core curriculum to teach students problem solving skills and elements of modelling and simulation. The underlying emphasis of the course was to allow students to develop their own problem solving strategies, both individually and in groups. Direction was provided on how to examine problems from different perspectives, and how to determine the proper root problem statement. A five-point problem solving strategy was presented as: 1) Problem definition; 2) Solution generation; 3) Decision; 4) Implementation; 5) Evaluation. Within the strategy, problem solving techniques were integrated from diverse areas such as: De Bono 's six thinking hats, Kepner-Tregoe decision analysis, Covey's seven habits of highly effective people, Reason's swiss cheese theory of complex failure, and Howlett's common failure modes. As part of the evaluation step, students critically explore areas such as ethics and environmental responsibility. In addition to exploring problem solving methods, students learn the usefulness of simulation methods, and how to model and simulate complex phenomena of relevance to radiation protection. Computational aspects of problem solving are explored using the commercially available MATLAB computer code. A number of case studies are presented as both examples and problems to the students. Emphasis was placed on solutions to problems of interest to radiation protection, health physics and nuclear engineering. A group project, pertaining to an accident or event related to the nuclear industry is a course requirement. Students learn to utilize common time and project management tools such as flowcharting, Pareto

Full Text Available Abstract The art in law, like medicine, is in its humanity. Nowhere is the humanity in law more poignant than in BC Supreme Court Justice Ian Pitfield's recent judgment in the legal case aimed at protecting North America's only supervised injection facility (SIF as a healthcare program: PHS Community Services Society versus the Attorney General of Canada. In order to protect the SIF from politicization, the PHS Community Services Society, the community organization that established and operates the program, along with two people living with addiction and three lawyers working for free, pro bono publico, took the federal government of Canada to court. The courtroom struggle that ensued was akin to a battle between David and Goliath. The judge in the case, Justice Pitfield, ruled in favour of the PHS and gave the Government of Canada one year to bring the Controlled Drugs and Substances Act (CDSA into compliance with the country's Charter of Rights and Freedoms. If parliament fails to do so, then the CDSA will evaporate from enforceability and law in June of 2009. Despite the fact that there are roughly twelve million intravenous drug addiction users in the world today, politics andprejudice oards harm reduction are still a barrier to the widespread application of the "best medicine" available for serious addicts. Nowhere is this clearer than in the opposition by conservative Prime Minister Stephen Harper and his faithful servant, federal health minister Tony Clement, towards Vancouver's SIF ("Insite". The continued angry politicization of addiction will only lead to the tragic loss of life, as addicts are condemned to death from infectious diseases (HIV & hepatitis and preventable overdoses. In light of the established facts in science, medicine and now law, political opposition to life-saving population health programs (including SIFs to address the effects of addiction is a kind of implicit capital punishment for the addicted. Myanmar is classified as critical shortage of health workforce. In responses to limited number of trained health workforce in the hard-to-reach and remote areas, the MOH trained the Community Health Worker (CHW) as health volunteers serving these communities on a pro bono basis. This study aimed to assess the socio-economic profiles, contributions of CHW to primary health care services and their needs for supports to maintain their quality contributions in rural hard to reach areas in Myanmar. In 2013, cross-sectional census survey was conducted on all three groups of CHW classified by their training dates: (1) prior to 2000, (2) between 2000 and 2011, and (3) more recently trained in 2012, who are still working in 21 townships of 17 states and regions in Myanmar, using a self-administered questionnaire survey in the Burmese language. The total 715 CHWs from 21 townships had completely responded to the questionnaire. CHWs were trained to support the work of midwives in the sub-centres and health assistant and midwives in rural health centres (RHCs) such as community mobilization for immunization, advocates of safe water and sanitation, and general health education and health awareness for the citizens. CHWs were able to provide some of the services by themselves, such as treatment of simple illnesses, and they provided services to 62 patients in the last 6 months. Their contributions to primary health care services were well accepted by the communities as they are geographically and culturally accessible. However, supports from the RHC were inadequate in particular technical supervision, as well as replenishment of CHW kits and financial support for their work and transportation. In practice, 6 % of service provided by CHWs was funded by the community and 22 % by the patients. The CHW's confidence in providing health services was positively associated with their age, education, and more recent training. A majority of them intended to serve as a CHW for more than

    2002-01-01

A review of existing records and the scientific literature was conducted for occurrences of avian diseases affecting free-ranging avifauna within the Salton Sea ecosystem. The period for evaluation was 1907 through 1999. Records of the U.S. Department of Agriculture, Bureau of Biological Survey and the scientific literature were the data sources for the period of 1907a??1939. The narrative reports of the U.S. Fish and Wildlife Service's Sonny Bono National Wildlife Refuge Complex and the epizootic database of the U.S. Geological Survey's National Wildlife Health Center were the primary data sources for the remainder of the evaluation. The pattern of avian disease at the Salton Sea has changed greatly over time. Relative to past decades, there was a greater frequency of major outbreaks of avian disease at the Salton Sea during the 1990s than in previous decades, a greater variety of disease agents causing epizootics, and apparent chronic increases in the attrition of birds from disease. Avian mortality was high for about a decade beginning during the mid-1920s, diminished substantially by the 1940s and was at low to moderate levels until the 1990s when it reached the highest levels reported. Avian botulism (Clostridium botulinum type C) was the only major cause of avian disease until 1979 when the first major epizootic of avian cholera (Pasteurella multocidia) was documented. Waterfowl and shorebirds were the primary species affected by avian botulism. A broader spectrum of species have been killed by avian cholera but waterfowl have suffered the greatest losses. Avian cholera reappeared in 1983 and has joined avian botulism as a recurring cause of avian mortality. In 1989, avian salmonellosis (Salmonella typhimurium) was first diagnosed as a major cause of avian disease within the Salton Sea ecosystem and has since reappeared several times, primarily among cattle egrets (Bubulcus ibis). The largest loss from a single epizootic occurred in 1992, when an estimated

incidents at law schools that raise serious issues about the professionalism of law students. They include, for example, the UofT marks scandal, the Windsor first year blog and the proliferation of blogs like www.lawstudents.ca and www.lawbuzz.ca with gratuitous, defamatory and offensive entries. It is not clear that all of this conduct would be caught by University codes of conduct which often limit their reach to on campus behaviour or University sanctioned events. What should a law school code of professional responsibility look like and what ethical responsibilities should it identify? For example, should there be a mandatory pro bono obligation on students or a duty to report misconduct. The last part of the article addresses this question by setting out a model code of professional responsibility for law students.

the highest rainfall intensities were applied in the most natural areas with a dense vegetation cover, the most intense responses were produced in the most altered environments (badlands, born forest, vineyard, pasture and stony soils). These results agreed with the cause-effect relationships observed in some antecedent studies, which compare the hydrological and erosive response in different land uses (Badía et al., 2008; García-Ruíz et al., 2008; García-Ruíz and Lana-Renault, 2011). This has been mainly associated with variations of soil chemical, physical and hydrological properties (Pardini et al., 2004, Emran et al., 2012; Regüés et al., 2012). Likewise, this analysis has provided comparable information for various contrasted land uses, allowing estimate proportionality factors between them. This information favours the classification of certain environments according to its relative trends to surface runoff and erosion. This study aims to identify the impact of liquidity risk on expected excess returns of Brazilian corporate bonds in the secondary market.

Patient-reported outcomes may help inform treatment choice in advanced/metastatic renal cell carcinoma (RCC), particularly between approved targeted therapies with similar efficacy. This double-blind crossover study evaluated patient preference for pazopanib or sunitinib and the influence of health-related quality of life (HRQoL) and safety factors on their stated preference. Patients with metastatic renal cell carcinoma were randomly assigned to pazopanib 800mg per day for 10 weeks, a 2-week washout, and then sunitinib 50mg per day (4 weeks on, 2 weeks off, 4weeks on) for 10 weeks, or the reverse sequence. The primary end point, patient preference for a specific treatment, was assessed by questionnaire at the end of the two treatment periods. Other end points and analyses included reasons for preference, physician preference, safety, and HRQoL. Of 169 randomly assigned patients, 114 met the following prespecified modified intent-to-treat criteria for the primary analysis: exposure to both treatments, no disease progression before cross over, and completion of the preference questionnaire. Significantly more patients preferred pazopanib (70%) over sunitinib (22%); 8% expressed no preference (P<.001). All preplanned sensitivity analyses, including the intent-to-treat population, statistically favored pazopanib. Less fatigue and better overall quality of life were the main reasons for preferring pazopanib, with less diarrhea being the most cited reason for preferring sunitinib. Physicians also preferred pazopanib (61%) over sunitinib (22%); 17% expressed no preference. Adverse events were consistent with each drug׳s known profile. Pazopanib was superior to sunitinib in HRQoL measures evaluating fatigue, hand/foot soreness, and mouth/throat soreness. This innovative crossover trial demonstrated a significant patient preference for pazopanib over sunitinib, with HRQoL and safety as key influencing factors. Copyright © 2016 Elsevier Inc. Toward development of a precision medicine framework for metastatic, castration-resistant prostate cancer (mCRPC), we established a multi-institutional clinical sequencing infrastructure to conduct prospective whole-exome and transcriptome sequencing of bone or soft tissue tumor biopsies from a cohort of 150 mCRPC affected individuals. Aberrations of AR, ETS genes, TP53, and PTEN were frequent (40%-60% of cases), with TP53 and AR alterations enriched in mCRPC compared to primary prostate cancer. We identified new genomic alterations in PIK3CA/B, R-spondin, BRAF/RAF1, APC, β-catenin, and ZBTB16/PLZF. Moreover, aberrations of BRCA2, BRCA1, and ATM were observed at substantially higher frequencies (19.3% overall) compared to those in primary prostate cancers. A total of 89% of affected individuals harbored a clinically actionable aberration, including 62.7% with aberrations in AR, 65% in other cancer-related genes, and 8% with actionable pathogenic germline alterations. This cohort study provides clinically actionable information that could affect treatment decisions for these affected individuals. Copyright © 2017 Elsevier Inc. All rights reserved.

, and he was kept out of office for decades. Warwick offered him a platform, when other places thought of him as a ‘has been’. He visited about five times, then in 1992, the Berlin Wall having fallen and the Cold war ended, the Americans allowed us to have free and fair elections, supervised by President Carter and Cheddi Jagan won and became President of Guyana. I was his regular houseguest from 1992 until 1997 when he died. He taught me more about how colonialism behaved than any textbook. He had lived through the colonial period and was jailed by the British in 1953. All his life was dedicated to the betterment of the poor: he was fiercely concerned with reducing and eliminating poverty. In return for his great hospitality, all I could do was to edit and publish some of his political speeches. He also asked me to be his Ambassador at Large and to sit on the UNESCO Executive Board representing Guyana. He had no money, since he inherited a bankrupt country in 1992, so it was an amazing honour to serve him pro bono. One day I will write something more extensive about him… one of the stories he told me was about Fidel Castro. The two of them were friends  and political comrades in the late 50s and early 60s. It was Cuba who supplied us with food in the early 1960s when the CIA formented strikes and shortages in Guyana. Castro, however, needed allies in the region, against American embargo, so when Cheddi was manoeuvred out of Office, Castro started to court the friendship of our new autocratic Prime Minister, Forbes Burnham, and more or less dropped his relationship with Cheddi. I learn from this that politics trumps decency; that politicians by and large are opportunists. Learning this first hand from a great and ethical politician like Cheddi Jagan was more powerful than learning this from textbooks. As to Janet Jagan, his wife, who, when he died, was elected President in our national elections, with an enhanced vote, she was an astonishingly generous host. My
