    The results of the hearings concerning Wyhl and Biblis C show that the basic tendencies can also be found in the analysis of the formal licensing procedure within the ATVfV - Atomrechtliche Verfahrensordnung (an order of the Atomic Energy Law concerning the licensing procedure). The corresponding explanations are formulated in an understandable manner; thus disputes about function and procedure of the hearing are theoretically not to be expected.     The BMUB/BfS project 3611I01512 formed the frame of the GRS for the scientifictechnical cooperation with Technical Support Organisations and Nuclear Regulatory Authorities in the field of nuclear safety of NPPs and for the evaluation of nuclear risks in Eastern Europe and other regions for the period from September 2011 till June 2014. In the present final report main results of the project are described. The project comprised the following technical topics: - Record status of NPP modernisation programs, Monitoring and evaluation of modernisation programs; - Design basis and severe accident analyses for NPP with PWR (WWER-440, WWER-1000); - Cooperation with INSC partner countries on DBA, BDBA and severe accident analyses for WWER plants of generation 3+ and on building NRA and safety evaluation capacities; - Decommissioning of nuclear facilities and disposal of radioactive waste; - Evaluation of new reactor concepts and their safety design; Panels at regulatory level. The work results are preceded by a summary on the activities related to the project management and to the planning of the bilateral work.

    Under the - constitutionally based - regime ruling compensation for expropriated property notably the valuation key day is of crucial importance for the level of compensation. The study examines the therefor acknowledged principles and criteria, their constitutional foundation, their applicability on expropriation measures directly performed by an Act of Parliament, finally their transferability to the 13th amendment to the Atomic Energy Act.

    The new issue of the text contains the Atomic Energy Act (AtG) in its new wording of the announcement of 31 Oct 76, the new wording of the ordinances put in effect in 1977: Atomic procedure ordinance (AtVfV), radiation protection ordinance (SSU), and atomic financial security ordinance (AtDeckV); furthermore the x-ray ordinance (RoeV) of 1978 in its wording which has been changed by the radiation protection ordinance. Also printed are the cost ordinance (AtKostV) of 1971, the food irradiation ordinance (LebensmBestrV) in the wording of 1975 and the medicine ordinance (ArzneimV) in the wording of 1971.     The recurrent safety inspection is intended as an inspection supplementing the continuous operation monitoring activities within the framework given by the supervisory activities of the supervisory authority. The first recurrent safety inspection is scheduled to be performed about ten years after start-up of the plant, with subsequent inspection intervals to cover ten-year periods, and recorded operating and monitoring results to be taken into account at each recurrent inspection. The purpose of the recurrent safety inspections is to ascertain that post-inspection operation of the plant meets the then required safety standards. Significant testing results of the latest inspection are to be analysed and compared with regard to the current state of the art and operating results accumulated since the previous inspection, for subsequent definition of enhancements if required.     Section 7 of the Atomic Energy Act (AtG), section 4 of the Federal Emission Control Act (BImSchG), the Nuclear Installations Licensing Ordinance (AtVfV), and the Ninth Ordinance on the Implementation of the BImSchG (Principles of the licensing procedure) require participation of the public in the procedure before administrative provisions or decisions are issued.   9. Report on the fuel cycle centre for spent fuel elements from nuclear power plants in the Federal Republic of Germany


    The report takes into account the contents of the safety report which was presented on March 31st, 1977 to the Social Minister of Lower Saxony by the Deutsche Gesellschaft fuer Wiederaufbereitung von Kernbrennstoffen mbH, Hanover, together with the application for a licence for the construction and operation of a fuel cycle centre. However, the report is not to be seen as the brief description of the facility, as it is required according to section 3, sub-section 3 of the AtVfV (Nuclear Installations Ordinance). It is more introductory information. Statements and drafts are preliminary; they have neither been decided on nor have they been licensed. However, the report gives a survey of the present state-of-the-art and of planning activities concerning the nuclear fuel cycle centre, while paying special attention to data relevant to the site. The government of Lower Saxony has proposed as a preliminary site on Febr. 22nd, 1977 an area near Gorleben in the rural district of Luechow-Dannenberg.     Prior to release from the radiological supervision and control regime of the AtG (German Atomic Energy Act), nuclear facilities have to be scanned using licensed radioactivity measuring methods for providing evidence that the remaining radioactive contamination is below the legally defined limits and excludes hazards to the population, material goods, or the environment. The manually performed {alpha}/{beta} measuring methods applied so far for radiological decontrolling measurement are surface scanning methods measuring the contamination of very thin surface layers of the structures, while radioactivity in deeper layers is not necessarily detected. The gamma scanning method presented in this document is capable of scanning the structures and materials of nuclear facilities from the surface down to much deeper layers in just one measuring run. The automated scanning process at the same time offers the advantage of preventing the uncertainties possibly contributed through human factors. Hierzu sind die Anlagen freizumessen, d.h. es ist durch qualifizierte Messverfahren sicherzustellen, dass festgelegte radiologische Grenzwerte unterschritten werden. Die bisherigen auf {alpha}/{beta}-Messung beruhenden Freimessverfahren (Kontaminationsmonitore) erfassen nur die Radioaktivitaet in duennsten Oberflaechenschichten. Radioaktivitaet in darunter liegenden Schichten wird nicht zwangslaeufig erfasst. Zudem erfolgen diese Messungen ausschliesslich manuell. Das Gamma-Scanning-Freimessverfahren erfasst neben der Oberflaechenschicht gleichzeitig auch tiefere Schichten.     Betriebsergebnisse und Hinweise auf die im Berichtsjahr erteilten atomrechtlichen Genehmigungen. Zu den abgeschalteten bzw. stillgelegten Kernkraftwerken sowie den eingestellten Vorhaben wird eine Kurzbeschreibung des gegenwaertigen Status gegeben. Fuer die Forschungsreaktoren sind die wesentlichen Angaben zum Typ, den Kenndaten (thermische Leistung, thermischer Neutronenfluss) und dem Nutzungszweck der Anlage dargestellt. Des Weiteren wird ein Ueberblick ueber die Genehmigungs- und Betriebshistorie sowie den aktuellen Betriebszustand gegeben. Zu den Anlagen der Kernbrennstoffver- und -entsorgung werden Angaben zu Zweckbestimmung und Leistungsgroesse gemacht. Dargestellt werden weiterhin die Genehmigungshistorie und der momentane Betriebs- und Genehmigungszustand. Im Bereich der Endlagerung werden die neuen gesetzlichen Strukturen, die Aufsicht und die laufenden Projekte beschrieben. Die Informationen sind am Ende des Berichts zu einer Uebersicht in Tabellenform zusammengefasst. Der Bericht wird jaehrlich in aktualisierter Form herausgegeben.
