Full Text Available The activity of administrative bodies includes big numbers of various acts and actions, through which the will of public administration is formed. The will of public administration bodies, expressed in administrative individual and normative acts, in administrative contracts and real acts, finds its reflection in the Constitution, laws and other provisions of legal character. All this activity is not inerrant and therefore, it is not uncontrollable. The supervision of executive activity is subject to political control of administrative acts through authorities designated for this purpose, as well as internal control and the judicial control. The institution of judicial control of administrative acts and actions appears as very important and widely treated in the legal doctrine. The protection of constitutional and legal rights of private persons is accomplished by subjecting administrative activity both to internal administrative control, as well as to the judicial control in accordance with legal provisions. The judicial control of administrative acts represents a constitutional guarantee for citizens to protect their rights through public and fair trial by an independent and impartial court. In this way, the Constitution empowers the common administrative court that invalidates an action or administrative act, but not all administrative acts may be subject to administrative dispute, with the exception of cases against which the administrative conflict cannot be carried out (negative enumeration.

Full Text Available This article begins with an analysis of the development of administrative justice in Poland over the last centuries. In particular, the author examines administrative jurisdiction before 1918, when Poland regained its independence, the period of the Duchy of Warsaw, the Kingdom of Poland, and the practice on Polish territory under Austrian and Prussian control. The author then moves to modern law by presenting the judicial system in Poland in general, especially the differences between the separate systems of general courts and administrative courts, and analyses the jurisdiction of voivodship (regional administrative courts, and the basic principles of judicial and administrative proceedings. The focus of study is mainly devoted to judicial and administrative procedure, rather than an administrative process of citizens before administrative authorities regulated in a separate Code of Administrative Procedure. The article describes the role of the judge (pointing out the differences between the active role of first instance judges and the limited capabilities of the judges of the appeal and the powers of the Supreme Court, in particular its power to adopt resolutions, which has agreat importance for the unification of the jurisprudence. A brief analysis is given to class actions, which in the Polish legal system are inadmissible in court and administrative proceedings. The articles provides a statistical cross-section illustrating the role of administrative jurisdiction. The author concludes with observations pointing up the progress of administrative jurisdiction in Poland, not only in the legal sense, but also in the cultural sense.

Full Text Available The Constitution of Romania revised in 2003 establishes the free and voluntary nature of the special administrative jurisdictions, a fact which allows the party concerned to address either the administrative-judicial body or directly the court. If they opted for the administrative-judicial way, it must be followed to the end, then, under the terms established by the law, the party may address the court, under the right of access to justice provided by article 21 of the constitution. The administrative jurisdiction is an activity of solving an administrative litigation by specific procedural rules of judicial procedure, based on the principle of the independence, of insuring the right to defense and the administrative-jurisdictional independence activity, which results in a jurisdictional administrative act. In order to achieve the objectives of the paper, namely to highlight the essential elements of the resolution of litigation according to special administrative jurisdictions, we have achieved an analysis of the legislative acts referring to this activity, of the doctrine and jurisprudence. After examination and empirical research, the paper summarizes and specifies the general conclusions on the role and importance of special administrative courts.

However, the actual deployment of such strategies is often voluntary, decentralized, disjointed and episodic. An alternative approach is to cluster administrative elements across hospital departments and make them the responsibility of a dedicated manager. This approach treats administrative services as an organizing principle with uniform, predictable standards of service and cost. Customer requirements for products and services are met without the need for them to physically manage that process. Materiel managers can demonstrate a leadership role by applying their professionalism and know-how to a set of products and services traditionally ignored or dealt with in an uncoordinated manner. The intent is to be able to properly support telecommunications for the distribution of all information within a building/campus. This standard will provide a uniform administration scheme that is independent of applications, and will establish guidelines for owners, installers, designers and contractors. This standard will accommodate existing building wiring, new building wiring and outside plant wiring. Existing buildings may not readily adapt to all applications of this standard, but the requirement for telecommunications administration is applicable to all buildings. Administration of the telecommunications infrastructure includes documentation (labels, records, drawings, reports, and work orders) of cables, termination hardware, patching and cross-connect facilities, telecommunications rooms, and other telecommunications spaces (conduits, grounding, and cable pathways are documented by Facilities Engineering). The investment in properly documenting telecommunications is a worthwhile effort. It is necessary to adhere to these standards to ensure quality and efficiency for the operation and maintenance of the telecommunications infrastructure for Sandia National Laboratories.

Intracerebroventricular drug administration is a method that bypasses the blood-brain barrier and other mechanisms that limit drug distribution into the brain, allowing high drug concentrations to enter the central compartment. Instillation of drugs directly into the ventricles of the brain must be done carefully and with full consideration of factors affecting the efficacy and safety of this route of administration. These factors include the osmolarity, pH, volume, and presence of preservatives and diluents of the drug solution being administered. Very few studies have formally investigated intraventricular therapies, and dosing recommendations may vary widely depending on the agent and the patient. Many antimicrobials have been given intraventricularly, although very few prospective studies have evaluated this strategy. There are wide variations among the reports regarding dosage regimens and the pharmacokinetics of the antimicrobials used. Guidance on appropriate formulations and their use is lacking. Clinicians should be aware of their patients' ongoing disease processes and neurologic status, as well as pertinent physiochemical properties of drugs when formulating them for intracerebroventricular administration; a high index of suspicion should be maintained when monitoring patients for adverse drug events after instillation.

Full Text Available Administrative contracts in Croatian legislation represent a novelty introduced into the General Administration Procedure Act in 2010. This is a novelty which has not proved to be successful in practice. Control over administrative contract formation is inevitable and is very significant for a number of reasons. Firstly, public legal bodies which form them do so by exercising their own public powers which are without doubt subject to legality control; secondly, in forming administrative contracts, public funds are used which must be controlled; thirdly, forming administrative contracts often touches on using public goods. Due to the restrictive interpretation of administrative contracts in Croatian legislation, this institute is indisputably only regulated in the General Taxation Act. However, for more than two decades contracts which satisfy all presumptions have existed in our law in order to be considered as administrative contracts. It is for this reason that control over contracts will be dealt with for contracts considered by the author to be administrative contracts. These are contracts on concessions and contracts on public procurement. How inadequate today’s regulation of control of administrative contract formation is will be demonstrated, particularly regarding contracts on concession and public procurement. Legislative changes will be proposed which should result in a more quality system of control over administrative contract formation. How control over administrative contract formation cannot be considered as separate from control over administrative contract execution will also be shown.

Full Text Available The article elaborates weather UML, primarily used in software engineering, can be a useful tool in business modeling and administration. By analyzing the advantages the modeling language has to offer we find that UML is visual and object oriented and that it is useful in expressing structure, interaction and behavior as well. With its help managers and business people can build models and diagrams to help put things into perspective. “Case Study 1” shows UML can be used as an analysis tool in business modeling to help increase the complexity and depth of the event or project that is being developed. “Case Study 2” attempts to prove that UML can also be efficiently used in finding solutions to newly appeared problems in a business environment. Despite the practicality of the Unified Modeling Language there is still some criticism brought to it. Some programmers consider it to be hard to learn and some developers claim that it is too abstract. The article concludes that despite the minor drawbacks; due to its adaptability and complex visual models, it is a very useful tool that adds value to the modeling of business structures and processes.

Full Text Available One of the variables that affects success in business life is emotional intelligence of working people. The purpose of this research is to identify whether the school administrators’ emotional intelligence scores differ meaningfully according to their gender, marital status, branch, being a principal or assistant principal, being elementary school administrator or high school administrator, having manegerial education course or not, educational background, period of occupational service, age, length of administration service, number of children. 180 administrators working as a principals and vise principals who worked in 2005 in Düzce elementary schools and high schools were surveyed in line with this aim. Mann-Whitney U-test, Kruskal Wallis test and ANOVA were used in order to find out groups that differ from others. It has been found that school administrators’ emotional intelligence scores differ meaningfully in terms of administrators’ branch and being elementary school administrator or high school.

Full Text Available The aim of this article is to conduct an analysis of the constitutionalization of Administrative Law, which results from changes in the rule of law and, under a theoretical standpoint, from the paradigm shift of legal exegesis followed by the advent of neo-constitutionalism, which poses the Constitution as the parameter for the interpretation of the other legal branches. Within this context, considering that the concept of administrative discretion goes through interpretation changes and that administrative activity is performed within the boundaries of discretion, this power/duty must always be used with substantial regulatory criteria in order to get the maximum effectiveness of the constitutional rules, thus being subjected to review. In this sense, it is demonstrated that a public official cannot in any way deviate from the realization of the fundamental rights guaranteed by the Constitution, hence stating the reviewability of the administrative discretion.

Full Text Available This article reviews the interpretation of section 6(2(aii of the Promotion of Administrative Justice Act which makes an administrator “biased or reasonably suspected of bias” a ground of judicial review. In this regard, the paper reviews the determination of administrative bias in South Africa especially highlighting the concept of institutional bias. The paper notes that inspite of the formulation of the bias ground of review the test for administrative bias is the reasonable apprehension test laid down in the case of President of South Africa v South African Rugby Football Union(2 which on close examination is not the same thing. Accordingly the paper urges an alternative interpretation that is based on the reasonable suspicion test enunciated in BTR Industries South Africa (Pty Ltd v Metal and Allied Workers Union and R v Roberts. Within this context, the paper constructs a model for interpreting the bias ground of review that combines the reasonable suspicion test as interpreted in BTR Industries and R v Roberts, the possibility of the waiver of administrative bias, the curative mechanism of administrative appeal as well as some level of judicial review exemplified by the jurisprudence of article 6(1 of the European Convention of Human Rights, especially in the light of the contemplation of the South African Magistrate Court as a jurisdictional route of judicial review.

Full Text Available Giving consideration to punishment, one of the inevitable elements of school discipline, always reactivates the issue of punishment administration and its effects in school setting. Punishment is administered by a beforehand-determined intention, its general and final goal being the attempt to make a child change his/her behavior so as to more successfully take part in school life. The issue of how much it is justifiable to administer punishment, as a way of directing child’s behavior, is not only raised in professional discussions but occurs as a personal dilemma with parents, teachers and all those involved in child upbringing. The definition of punishment contains certain incompatible elements in attitudes, which is reflected in punishment administration within different social contexts. Based on the analysis of research results, the paper discusses all the elements the teacher should be well acquainted with, influencing the effectiveness of punishment. The effects of punishment administration depend, among other things, on the type of punishment, way in which a person experiences and perceives punishment and the way of administering it. Prior to punishment administration, as a means of directing child’s behavior factors influencing successfulness of punishment should be established consistency in punishment administration, postponement of punishment intensity of punishment, explanation for punishment administration, nature of interrelations between a child and a person punishing him/her.

Full Text Available The starting point of this work is the idea that the concept of “crisis” should be approached with no fear. It is necessary to understand it as the signal which attracts attention upon the fact that some changes are appropriate and that some rationally thought actions ought to be taken in order to soften the social phenomena occurring within a crisis period. We may say that in the core of the crisis lies impregnated the basic substance of progress and that the moment when a crisis is declared is as well the moment of a new start. It is necessary to anticipate the crisis, in order to prepare the adequate means able to soften up the shocks created by its incipit and to bring forward the progress through its action itself. One of the most necessary and useful instruments able to smooth down the crisis' effects is the early education provided to the citizens concerning the frame of the behavior to be adopted in case of crisis. The officials and the public servants are the social actors who constitute the interface between the citizen who is going to suffer the crisis and this latter's exerted pressure. The personnel from the public administration has to assume the hardest role in reducing the most possible the crisis' effects. Some possibilities are analysed that could reduce the effects of the economical, social and political crises, among which the most important is the quality of juridical norms. The Romanian legislation concerning the public charge is studied, in respect to its capacity to motivate the public servant to perform at his up most level, during crisis periods but not only then. An acute exposure of two vanadate solutions-metavanadate and decavanadate-containing different vanadate oligomers, induces different patterns of subcellular vanadium distribution in blood plasma, red blood cells (RBC), and cardiac muscle subcellular fractions of the fish Sparus aurata (gilthead seabream). The highest amount of vanadium was found in blood plasma 1 h after (5 mM) intravenous vanadate administration (295 +/- 64 and 383 +/- 104 microg V/g dry tissue, for metavanadate and decavanadate solutions, respectively), being 80-fold higher than in RBC. After 12 h of administration, the amount of vanadium in plasma, as well as in cardiac cytosol, decreased about 50%, for both vanadate solutions. During the period between 1 and 12 h, the ratio of vanadium in plasma/vanadium in RBC increased from 27 to 128 for metavanadate, whereas it remains constant (77) for decavanadate. Both vanadium solutions were primarily accumulated in the mitochondrial fraction (138 +/- 0 and 195 +/- 34 ng V/g dry tissue for metavanadate and decavanadate solutions, respectively, after 12 h exposure), rather than in cytosol. The amount of vanadium in cardiac mitochondria was twofold higher than in cytosol, earlier for metavanadate (6 h) than for decavanadate (12 h). It is concluded that, in fish cardiac muscle, the vanadium distribution is dependent on the administration of decameric vanadate, with vanadium being mainly distributed in plasma, before being accumulated into the mitochondrial fraction.

The three authority branches are broadly represented in the French administration: the judicial branch – French courts of law are divided into: judicial courts and administrative courts. Judicial courts are under the supreme authority of the Court of Cassation with jurisdiction to cancel judgments passed courts on inferior hierarchy levels and plays a central role in the appropriate performance of the activity. The legislative body - normally, the legislation is voted by Parliament. French Parliament is comprised of two chambers: the National Assembly and the Senate. The National Assembly is elected for five years by way of direct universal voting. The Senate is elected by way of indirect universal voting by the electoral group. The election system is based on rules contained in the Election Code. The executive authority is divided between the President of the Republic and the Prime Minister. The President of the Republic makes the appointments for civil and military positions located at the highest state level. Full Text Available The advent of new ICTs brought a lot of new assumptions about radical changes in our society. In the context of the arrival of a new society, public administration was supposed to witness (and to address or implement changes at different levels, such as:• citizenship (citizens becoming participants in governance or even a shift to e-democracy;• the nature of public service jobs (in terms of skills, work processes and job design;• organizational changes (from a hierarchical to a more horizontal structure, to network or even virtual organizations; and• the entire government (from classic bureaucracy to New Public Management and to network and digital governance. Technological change cannot be judged outside the social, economic and political frameworks. The massive change in our society cannot be explained only by technological (especially ICT factors. Excluding other factors may help us predict easier (but not more accurately future evolutions but as a scientific effort it is a bad practice. Much of the assumptions about technological change came from hasty generalizations. The changing nature of some collective actions, jobs in certain areas of the economy or organizations were considered as optimal (and necessary paths for the entire society (from individual to national levels. Public administration reforms are far from being a consequence of new technologies. Moreover public administration reforms do not embed ICTs and do not have a happy marriage with e-government.
Full Text Available Introduction Administrative corruption is a complicated and multi-faceted phenomenon that has many causes and ramifications, which manifest themselves in different forms in various countries and appear to be endemic of all social systems where authority is delegated. Although there might be different definitions of and approaches towards administrative corruption, the definition that has been put forward by the World Bank and Transparency International appears to be more general and comprehensive. It defines corruption as the abuse of public power, office, or resources by public or elected governmental officials for personal gain, e.g. by extortion, soliciting or offering bribes. Recent research findings indicate that organizational commitment and work satisfaction on the part of employees could be an effective antidote to administrative corruption. On the other hand, employee sense of equity and fairness also has been shown to be effective in enhancing organizational commitment. Last but not least, employee financial needs could play a significant part in their vulnerability to corruption. Therefore, the main aim of this paper is as follows: by utilizing the ideas of Selznick on organizational commitment, Merton's views on work satisfaction, Taylor's and Schwartz's ideas on financial needs, and Barnard's views on managerial capabilities, the relationships of these variables on administrative corruption were studied. The other purpose of the paper is to examine the effects of some other related variables like age, sex, level of education, job seniority, and marital status on administrative corruption. Full Text Available Research on administrative reforms during the past thirty years indicates that reform efforts of countries differ. The Anglo Saxon states were at the forefront of the New Public Management movement while countries on mainland Europe were more hesitant and moved further towards the Neo-Weberian state. Academics have tried to explain different reform efforts within countries by looking at political, historical and cultural issues, values and economic factors to name just a few. Three hypotheses are put forward to explain reform efforts in different states. This research involves analysing the implementation of two different reform trends, New Public Management and the Neo-Weberian tradition. The analysis indicates that countries vary in their commitment to reform rather than in the emphasis on either New Public Management or the Neo-Weberian State. Decentralization, clear objectives and consultation with communities and experts are closely related to national reform efforts. However, Iceland does distinguish itself from Europe and the Nordic countries. The analysis reveals that although decentralization is high in the Icelandic system, autonomy of agencies does not have a strong relation to a varied use of administrative instruments. The second part of the article focuses on the results and achievements of reform programmes. The achievement of reform programmes are examined in relation to theories of bounded rationality, street level bureaucracy (bottom up and consensus decision making. Three hypotheses are presented and tested to explain what causes reforms programmes to be successful in some countries and not in others. The analysis reveals that countries are more likely to succeed if bounded rationality is applied with careful preparation and when stakeholders are consulted.

The Bonneville Power Administration (BPA) has decided to adopt a Power Subscription Strategy for entering into new power sales contracts with its Pacific Northwest customers. The Strategy equitably distributes the electric power generated by the Federal Columbia River Power System (FCRPS) within the framework of existing law. The Power Subscription Strategy addresses the availability of power; describes power products; lays out strategies for pricing, including risk management; and discusses contract elements. In proceeding with this Subscription Strategy, BPA is guided by and committed to the Fish and Wildlife funding Principles for the BPA announced by the Vice President of the US in September 1998. Full Text Available The article approaches the topic of administrative acts motivation, analyzed from the doctrinal and jurisprudential perspective. If at first, motivation was considered merely a formal condition of the administrative act, as a result of the national and European, doctrinal and jurisprudential evolution, motivation is now regarded as one of the most important conditions of validity for the administrative act. Motivating administrative acts represents also a manifestation of the right to information, sealed by the Romanian Constitution, and a dimension of the right to a good administration, as stipulated in the Charter of Fundamental Rights of the European Union.

Time is an integral part of the Bonneville Power Administration's (BPA) operational systems. Generation and power transfers are planned in advance. Utilities coordinate with each other by making these adjustments on a timed schedule. Price varies with demand, so billing is based on time. Outages for maintenance are scheduled to assure they do not interrupt reliable power delivery. Disturbance records are aligned with recorded timetags for analysis and comparison with related information. Advanced applications like traveling wave fault location and real-time phase measurement require continuous timing with high precision. Most of BPA is served by a Central Time System (CTS) at the Dittmer Control Center near Portland, OR. This system keeps time locally and supplies time to both the control center systems and field locations via a microwave signal. It is kept synchronized to national standard time and coordinated with interconnected utilities. It is the official BPA time. Powwer system control and operation is described, followed by a description of BPA timing systems including CTS, the Fault Location Acquisition Reporter, time dissemination, and phasor measurements. A three semester, 60-credit course package in the topic of Administrative Data Processing (ADP), offered in 1966 at Stockholm University (SU) and the Royal Institute of Technology (KTH) is described. The package had an information systems engineering orientation. The first semester focused on datalogical topics, while the second semester focused on the infological topics. The third semester aimed to deepen the students’ knowledge in different parts of ADP and at writing a bachelor thesis. The concluding section of this paper discusses various aspects of the department’s first course effort. The course package led to a concretisation of our discipline and gave our discipline an identity. Our education seemed modern, “just in time”, and well adapted to practical needs. The course package formed the first concrete activity of a group of young teachers and researchers. In a forty-year perspective, these people have further developed the department and the topic to an internationally well-reputed body of knowledge and research. The department has produced more than thirty professors and more than one hundred doctoral degrees.

Elkins' administrative behaviors of higher education administrators inventory and Goleman's emotional and social competence inventory were conducted to test the differences. The manager behaviors of Istanbul University administrators are significantly higher than University of Helsinki administrators. The emotional competences of University of Helsinki administrators are significantly higher than the administrators of Istanbul University in the dimensions of self-awareness, self management, emotional selfcontrol, achievement orientation and positive outlook. The social competencies of University of Helsinki administrators are significantly higher than the administrators of Istanbul University in the dimensions of social awareness, empathy, and conflict management. On the other hand, the social competencies of Istanbul University administrators are significantly higher than the administrators of University of Helsinki in the dimensions of organizational awareness, coach and mentor, influence and teamwork. There is a significant positive relationship between the leadership behaviors and emotional and social competencies administrators in both Istanbul University and University of Helsinki. Spinal anaesthetics can induce histopathologic lesions and regional haemodynamic alterations in the spinal cord. There are numerous causes of neurologic lesions, including direct trauma of the spinal cord and nerve roots during puncture or catheter insertion, compromised spinal cord perfusion and direct neurotoxic effect. Histopathologic lesions are localized either in meninges (meningitis or arachnoiditis) or in neuraxis (myelitis or axonal degeneration). Neurotoxicity can result from decrease in neuronal blood supply, elicited by high concentrations of the solutions, long duration exposure to local anaesthetics, and the use of adjuvants. They have been implicated in the occurrence of cauda equina syndrome after continuous spinal anaesthesia using hyperbaric solution of lidocaine and tetracaine given through small diameter catheters. Selective spinal analgesia is induced by spinal opioids without motor blockade except for meperidine. Complications occurred in patients after high doses of morphine, which were related to one of its metabolites, morphine-3-glucuronide. Preservative-free opioid solutions are to be preferred for spinal anaesthesia. There is no report of neurotoxicity neither in animal studies, nor in humans, using spinal clonidine. In order to reduce the incidence of neurotoxicity, some safety rules should be followed. The lowest efficient dose of local anaesthetics must be given. Incomplete blockade should not necessarily lead to a reinjection. Large volume of hyperbaric lidocaine or repeated injections of such solutions must be avoided as well as preservative-containing solutions. The administration of new compounds by the spinal route must be supported by data of spinal neuropharmacology and the lack of neurotoxicity must have been previously checked with animal studies.

The study aims were to evaluate the impact of electronic medication administration record implementation on medication administration efficiency and occurrence of medication errors as well as to identify the predictors of medication administration efficiency in an acute care setting. A prospective, observational study utilizing time-and-motion technique was conducted before and after electronic medication administration record implementation in November 2011. A total of 156 cases of medication administration activities (78 pre- and 78 post-electronic medication administration record) involving 38 nurses were observed at the point of care. A separate retrospective review of the hospital Midas+ medication error database was also performed to collect the rates and origin of medication errors for 6 months before and after electronic medication administration record implementation. The mean medication administration time actually increased from 11.3 to 14.4 minutes post-electronic medication administration record (P = .039). In a multivariate analysis, electronic medication administration record was not a predictor of medication administration time, but the distractions/interruptions during medication administration process were significant predictors. The mean hospital-wide medication errors significantly decreased from 11.0 to 5.3 events per month post-electronic medication administration record (P = .034). Although no improvement in medication administration efficiency was observed, electronic medication administration record improved the quality of care with a significant decrease in medication errors.

This dataset contains Decisions and Orders originating from EPAs Office of Administrative Law Judges (OALJ), which is an independent office in the Office of the Administrator of the EPA. The Administrative Law Judges conduct hearings and render decisions in proceedings between the EPA and persons, businesses, government entities, and other organizations which are or are alleged to be regulated under environmental laws. Administrative Law Judges preside in enforcement and permit proceedings in accordance with the Administrative Procedure Act. Most enforcement actions initiated by the EPA are for the assessment of civil penalties. The Decisions and Orders are organized into three categories: (1) alphabetical listing by the respondent involved, (2) reverse chronological listing by date, and (3) Decisions and Orders under FIFRA Section 6. This dataset includes Decisions and Orders dating back to 1989 in the Reverse Chronological list, Decisions and Orders dating back to 1997 in the Alphabetical list, and a few Decisions and Orders dating back to 1974 under FIFRA Section 6.

In their work the public authorities must show transparency reflected by the active involvement of citizens in administrative decision as its primary beneficiary. The citizen information, consultation and his stimulation to participate actively in the elaboration of draft normative acts for their preparation and before that by bringing them to public knowledge, are tasks of the public authorities which exceed the limit of the obligations imposed by internal rules and are significant efforts to modernize the public administration and rallying to the administrative structures.
Full Text Available The success and survival of any organizations be they government or not is contingent upon group efforts and cooperation to achieve set goals. This paper discusses the nature and scope of public administration to say that in modern day societies, any administration in the public interest transcends beyond government circles and finds expression in other spheres of human endeavors including the church, mosques, postal services as well as international relations and diplomacy, respectively. The paper discusses the concepts of administration and public administration thereby creating a distinction between the two concepts. Furthermore, the understanding of the scope of administration through the various schools of thought have also been captured, the essence of which is to generate a clearer understanding of the discourse under review. The paper ends with conclusions.

Full Text Available In the present study carried out with 190 educational administrators, the individual innovativeness of educational administrators was examined. As a result of the study, it was found out that the educational administrators considered themselves as early adaptors. It was also revealed that professional seniority was not important in terms of individual innovativeness and those educational administrators with professional experience of 10 years or over had the same level of innovativeness as those with experience below 10 years did. The results also demonstrated that educational administrators with experience below 10 years had the same level of individual innovativeness. In addition, the results obtained revealed a difference between the computer use frequencies of educational administrators and their individual innovativeness. In other words, it was found out that educational administrators using the Internet everyday were more innovative than those using the Internet a few times a week or a month. Depending on the results obtained in the study, various suggestions were put forward for applied and future studies

Solid organ transplant recipients are prescribed a high number of medications, increasing the potential for medication errors. Barcode-assisted medication administration (BCMA) is technology that reduces medication administration errors. An observational study was conducted at an academic medical center solid organ transplant unit before and after BMCA implementation. Medication accuracy was determined and administration errors were categorized by type and therapeutic class of medication. A baseline medication administration error rate of 4.8% was observed with wrong dose errors representing 78% of the errors. During the post-BCMA period the medication administration error rate was reduced by 68% to 1.5% (P = .0001). Wrong dose errors were reduced by 67% (P = .001), and unauthorized medication administrations were reduced by 73%. Steroids were associated with the highest error rate. The results of this study suggest that routinely adopting BCMA has the potential to reduce medication administration errors in transplant patients.

The present study describes a technique for dermal administration of cationic manganese porphyrin (Mn-porphyrin), an antioxidant with superoxide dismutase (SOD) activity, in hairless mouse. In general, the stratum corneum on the surface of the skin represents a barrier to passive diffusion of therapeutic agents by standard dermal administration. The present study investigated whether, dermal administration of Mn-porphyrin solution using iontophoresis, the electrical dermal administration technique, could overcome this barrier. We visually confirmed that Mn-porphyrin had penetrated to the reverse side of the hairless mouse skin after iontophoresis for a short period. With prolonged iontophoresis, the ratio of detectable Mn-porphyrin solution on the reverse side of the hairless mouse skin increased. In the future, this technique could provide an innovative approach for delivery of this antioxidant in intractable disease.

Full Text Available Objective basing on the research of formation and development of the administrative prejudgment in the Russian criminal law and comparativelegal analysis of this institution as well as the longterm experience in crime investigation to trace the problems and trends of administrative prejudgment and prove the necessity to introduce or to be more precise legalize the administrative prejudgment in the Russian criminal law. Methods the research is based on the general dialectic method of cognition comparative historical formaljuridical methods as well as special and privatelegal methods of research. Results analysis of the main problems and collisions of administrative prejudgment in the Russian criminal law the doctrine and the practice of implementation of this institution can become the basis for legalization of the administrative prejudgment in the Russian criminal law and implementing it for the crimes stipulated in the Special part of the Russian Criminal Code if they are of low or middle gravity and committed intentionally those most often occurred. The article studies the institution of the administrative prejudgment in the Russian criminal law since 1922 until present. Various researchersrsquo opinions are given for and against returning of this institution. Taking into account the criminological indicators the authors express their own opinion on legalization of the administrative prejudgment. Scientific novelty having abandoned the formal approach to the institution of the administrative prejudgment both in the Russian criminal law and in the foreign laws the authors believe that the criminal personality should be the central factor of the administrative prejudgment legalization. In this context the authors state the direct connection between the personal features of a criminal including their inclination to immoral and illegal behavior and the crime committed by them. New medication administration systems are showing promise in improving patient safety at the point of care, but adoption of these systems requires significant changes in nursing workflow. To prepare for these changes, the authors report on a time-motion study that measured the proportion of time that nurses spend on various patient care activities, focusing on medication administration-related activities. Implications of their findings are discussed.

Direct observation was used to detect medication errors and Bar Code Medication Administration (BCMA) workarounds on two pediatric units and one neonatal unit at UCSF Benioff Children's Hospital. The study (1) measured the frequency of nursing medication administration-related errors, (2) characterized the types of medication errors, (3) assessed compliance with the institution's six medication administration safety processes, and (4) identified observed workarounds following BCMA implementation. The results of the direct observation were compared to medication administration-related incident reports (IRs) for the same period. The frequency of medication errors was 5% for the three units. Compliance with the process measures was achieved 86% of the time (range 23-100%). Seven medication administration-related IRs were submitted during the same observation period. Three BCMA workarounds were identified; (1) failure to visually confirm patient's identification, (2) failure to compare the medication to the electronic medication administration record at least twice before administration, and (3) charting administration of medication before actual administration. The direct observation methodology identified a low frequency of medication administration errors (MAEs) consistent with post-BCMA implementation. The incident reporting system identified different MAEs than direct observation suggesting that both methods should be used to better characterize the scope of MAEs.

Pub-lic administration has to keep the pace with the changes that are taking place in society. Specifc issues like ageing of the population and the mi-gration from small to larger communities, or from poor to wealthy regions are placing supplemen-tary burdens on modern administrative systems for decades. The economic crisis that started in 2008 made administrative matters even more complicated. Functional economies and consol-idated democracies proved to be vulnerable to what was considered by many as a market failure. The crisis and the responses of the governments around the world raised a number of questions related to the role that state and public authority in general should play in a modern democracy. The paper is briefy exploring the challenges that administrative systems from the new European Union member states and from the candidatestates were or are facing in their attempt to meet the requirements of the European Union mem-bership, and is proposing a challenging measure: the development of an acquis communautaire for the feld of public administration and consequent-ly the establishment of a correspondent structure inside the European Commission. The acquis communautaire will comprise of a minimum set of principles, widely accepted, that should rep-resent a ‘to do list’ for new member states that are having diffculties in promoting a sound and sustainable reform in public administration.
Full Text Available The main purpose of this paper is to examine how employees’ personal ethics, expressed through their personal values and attitudes toward social and environmental issues, are associated with the ethics of organizations in public administration. The authors introduce their own theoretical model that examines the relations between employees’ personal ethics – expressed through employees’ personal values and attitudes toward natural and social environments – and the ethics of public administration. The reported study examined these relations and tested a proposed model based on the answers of 212 employees from public administration organizations in Slovenia. Employees’ attitudes toward natural and social environments and the ethics of their organizations were measured using a questionnaire designed to measure aspects of ethics whereas personal values were measured using the Schwartz value survey. The results demonstrated that employees’ self-enhancing values significantly influence their attitudes toward the natural environment. Employees’ self-transcendence and self-enhancement values significantly influence their attitudes toward the social environment and the ethics of organizations. In addition, research results about the mediation effect of employees’ attitudes toward natural and social environments on the association between the employees’ personal values and their perception of the ethics of public administration organizations reveals that employees’ social attitudes have a significant impact on the ethics of public administration while the impact of self-transcending and self-enhancing values becomes insignificant. Based on results of testing our model we can conclude that the employee’s attitudes toward to the social environment represent a significantly more powerful predictor of ethics in public administration organizations than the employees’ personal values. Furthermore, the administrative appeals regarding the adjudication or refusal of a building permit, the openness of administration, the income tax and the suspension of an unemployment benefits are examined. Full Text Available Medication administration errors are common, costly and the cause of adverse events in clinical practice. Interruptions during medication administration rounds are thought to be a prominent causative factor of these medication errors. In this observational study, data were collected on the number and duration of several different sources of verbal and non-verbal interruptions using unobtrusive structured observations on 32 medication administration rounds. Interruptions occurred very often (6.9 times per nurse each hour, differed in frequency among the medication administration rounds and were from a variety of sources. The most frequent interruptions were caused by nursing colleagues (43% and non-verbal interruptions from the ward environment (25%, such as noises from pagers, conversations in the vicinity of the nurse, the work of cleaners, or stock management by pharmacy staff. The longest durations of interruptions were from nursing colleagues’ verbal interrup- interruptions. When comparing the medication rounds, more and longer interruptions were observed during the morning rounds than those at noon. A comparison between surgical and non-surgical units showed that interruptions occurred more often and lasted longer in non-surgical units than those in surgical units. But the observed differences were not statistically significant. In conclusion, interruptions during medication administration rounds are frequent and originated from different human and environmental sources. Interventions should target not only interruptions by colleagues, but should also consider ways to reduce self-initiated interruptions and those arising from the immediate ward environment.
Full Text Available Administrative data often arise as electronic copies of paid bills generated from insurance companies including the Medicare and Medicaid programs. Such data are widely seen and analyzed in the public health area, as in investigations of cancer control, health service accessibility, and spatial epidemiology. In areas like political science and education, administrative data are also important. Administrative data are sometimes more readily available as summaries over each administrative unit (county, zip code, etc. in a particular set determined by geopolitical boundaries, or what statisticians refer to as areal data. However, the spatial dependence often present in administrative data is often ignored by health services researchers. This can lead to problems in estimating the true underlying spatial surface, including inefficient use of data and biased conclusions. In this article, we review hierarchical statistical modeling and boundary analysis (wombling methods for areal-level spatial data that can be easily carried out using freely available statistical computing packages. We also propose a new edge-domain method designed to detect geographical boundaries corresponding to abrupt changes in the areal-level surface. We illustrate our methods using county-level breast cancer late detection data from the state of Minnesota.
Full Text Available The government disseminated a new constitution in 1995 with the provision on decentralization of Article 176 2 (b that acted shortly before the rebirth of the local government act in 1997. Devolution as a form of decentralization transferred both political and administrative powers from the center to lower local councils specially to handle the responsibility of service delivery. Following the approval of the Kampala Capital City Authority (KCCA Act 2010, the city’s administration reverted to the central government. Detractors of decentralization allege that the conveyance in the policy and legislation for change of Kampala city administration was timely because decentralization failed to deliver desired services to residents. This article contends that recentralization of Kampala city administration was a necessary evil, it decreased the autonomy of sub-national governments in civil service administration, eroded accountability to the electorates, and transferred the allegiance of the accounting officer from local governments with and for which they work to the central government that designates and positions. To inflame accountability in local governments, the article champions for the reexamining of the KCCA Act 2010 to allow power sharing between the mayor and executive director to enhance bottom-up accountability, checks and balances, and for participation of central government in appointing of executive director to allow financial and security support. It additionally requests for a reconsideration of the 9th Parliament to lobby for the amendments owing to challenges in its implementation and impact on accountability.

Administration of human subject research is complex, involving not only the institutional review board but also many other regulatory and compliance entities within a research enterprise. Its efficiency has a direct and substantial impact on the conduct and management of clinical research. In this paper, we report on the Clinical Research Administration (CLARA) platform developed at the University of Arkansas for Medical Sciences. CLARA is a comprehensive web-based system that can streamline research administrative tasks such as submissions, reviews, and approval processes for both investigators and different review committees on a single integrated platform. CLARA not only helps investigators to meet regulatory requirements but also provides tools for managing other clinical research activities including budgeting, contracting, and participant schedule planning.

As with all professional ethical principles, those in psychiatry have to evolve over time and societal changes. The current ethical challenges for psychiatric administration and leadership, especially regarding for-profit managed care, need updated solutions. One solution resides in the development by the American Association of Psychiatric Administrators (AAPA) of the first set of ethical principles designed specifically for psychiatric administrators. These principles build on prior Psychological Theories of leadership, such as those of Freud, Kernberg, and Kohut. Supplementing these theories are the actual real life models of psychiatrist leadership as depicted in the memoirs of various psychiatrists. Appreciating these principles, theories, and models may help emerging leaders to better recognize the importance of ethical challenges. A conclusion is that psychiatrists should have the potential to assume more successful leadership positions once again. In such positions, making the skills and well-being of all in the organization seems now to be the foremost ethical priority.

While there has been an extended discussion concerning city population distribution, little has been said about administrative units. Even though there might be a correspondence between cities and administrative divisions, they are conceptually different entities and the correspondence breaks as artificial divisions form and evolve. In this work we investigate the population distribution of second level administrative units for 150 countries and propose the Discrete Generalized Beta Distribution (DGBD) rank-size function to describe the data. After testing the goodness of fit of this two parameter function against power law, which is the most common model for city population, DGBD is a good statistical model for 73% of our data sets and better than power law in almost every case. However, it appears in various forms in national systems and is sustained and strengthened by EU policies whose objectives aim at the establishment of an area of freedom, security and justice with respect for fundamental rights and the different legal systems and traditions of the Member States and to ensure a high level of security through measures of preventing crime, racism and xenophobia. This article aims to show how the concept of administrative police is reflected in the European Union, the complementary and coordinating role of the latter, and the need for a uniform legal framework in European national systems which can allow the shaping of a European model.

Full Text Available The general configuration of the state and its responsibilities has changed and this has introduced important modifications both in the policy arena and in the State’s requirements for high-level skills, qualitatively and quantitatively. Even if Romanian public administration is mainly seen as bureaucratic, oversized and unable to attract the best trained civil servants, the issue of the professionalization of its human resources has never been brought to the fore. Moreover, public functions are not included in the category of the most desired ones the vast majority of people try to obtain such a job, considering that it provides stability. Turnaround professional qualification indicates the rate of experience, knowledge, and integrity necessary to conduct renewal work. Unfortunately, formal barriers hindering the promotion (e.g. waiting time, professional seniority and limited development opportunities (flat management structures, lack of visible career paths, inadequate information on vacancies have a negative impact on the degree of motivation and commitment at work, and of course they adversely affect service quality. In this regard we undertake a study among students and graduates of schools of public administration in Romania, Bucharest, from which we determine the worst and the best 10 jobs you can get today in public administration. Studies of disease management (DM) have shown that patients who participate in such programs achieve better health status and make fewer emergency room visits. Private and government payers have recently increased their efforts to promote DM initiatives through financial incentives to healthcare providers. This article explores opportunities for administrators of health services organizations (HSO) to promote DM in the current political and economic environment. Our survey of professionals (DM leaders, physicians, and DM nurses) in six DM programs reveals these professionals' assessments of the key players and resources that they deem important to their respective DM programs. They view DM programs as heavily dependent on the support of physicians, nurses, and health plan leaders but relatively less so on the support of HSO administrators- a situation that may suggest opportunities for administrators to take on greater leadership in moving the HSO toward developing DM programs. Survey results also indicate a strong need for the integration of resources such as communication systems, electronic medical records, and DM reporting. Taken collectively, these needs suggest a number of strategies for the administrator to play a larger role in supporting the adoption and effective implementation of DM. In the article, we propose that DM programs can benefit substantially from an administrator who can demonstrate a thorough knowledge of DM-related government and private-payer initiatives and who has the ability to provide leadership to develop and implement viable DM programs. Valued contributions that the administrator should bring to the table include support of standardized DM processes, use of practice guidelines, and provision of pertinent information systems.

To our knowledge, there have been only 4 cases of hemorrhagic complications attributed to the administration of IPSK reported in the literature. In this article, we report a case of a 17-year-old girl who received IPSK and developed shock, anemia, coagulopathy and massive hemothorax. Our discussion focuses on the hemorrhagic complication of chest tube insertion and the role of IPSK in blood clot lysis and inhibition of local hemostasis.

In response to societal, organization, and leadership changes, an innovative nursing structure was implemented and evaluated. An administrative support team was developed to provide specialized internal consultation and support to a flattened and decentralized nursing division. The four administrative support team roles provided an organization perspective that ensured constancy of purpose throughout the division. This structural innovation proved to be congruent with nursing shared governance and total quality management initiatives occurring in the organization. Evaluation studies indicated that the model has effectively supported 5 years of continuing organizational change.

This paper addresses cultural issues in psychiatric administration and leadership through two issues: (1) the changing culture of psychiatric practice based on new clinician performance metrics and (2) the culture of psychiatric administration and leadership in light of organizational cultural competence. Regarding the first issue, some observers have discussed the challenges of creating novel practice environments that balance business values of efficient performance with fiduciary values of treatment competence. This paper expands upon this discussion, demonstrating that some metrics from the Centers for Medicare & Medicaid Services, the nation's largest funder of postgraduate medical training, may penalize clinicians for patient medication behaviors that are unrelated to clinician performance. A focus on pharmacotherapy over psychotherapy in these metrics has unclear consequences for the future of psychiatric training. Regarding the second issue, studies of psychiatric administration and leadership reveal a disproportionate influence of older men in positions of power despite efforts to recruit women, minorities, and immigrants who increasingly constitute the psychiatric workforce. Organizational cultural competence initiatives can diversify institutional cultures so that psychiatric leaders better reflect the populations they serve. In both cases, psychiatric administrators and leaders play critical roles in ensuring that their organizations respond to social challenges.

Before assuming office, administrators must pledge to be efficient and faithful, and they must prepare an inventory of goods belonging to the juridic person they serve. Among their duties, administrators must: Ensure that adequate insurance is provided; Use civilly valid methods to protect canonical ownership of the goods; Observe civil and canon law prescriptions as well as donors' intentions; Collect and safeguard revenues, repay debts, and invest funds securely; Maintain accurate records, keep documents secure, and prepare an annual budget; Prepare an annual report and present it to the Ordinary where prescribed; Observe civil law concerning labor and social policy, and pay employees a just and decent wage. Administrators who carry out acts that are invalid canonically are liable for such acts. The juridic person is not liable, unless it derived benefit from the transaction. Liability is especially high when the sale of property is involved or when a contract is entered into without proper cannonical consent. Although Church law is relatively powerless to punish those who have been negligent, stewards, administrators, and trustees must do all they can to be truthful to the responsibility with which they have been entrusted.

Full Text Available Background & Aims of the Study Burnout is an occupational hazard which is known as one of the major factors affecting employees’ psychological disorders. The present study aimed to evaluate occupational burnout among administrative and healthcare staffs of Shiraz University of Medical Sciences. Materials & Methods In this cross sectional study, 300 employees (150 administrative staff and 150 health care staff were selected using random sampling method. Data were collected using Maslach Burnout Inventory and analyzed using SPSS software. Results: The mean of burnout was 2.33±0.60. The results showed no significant difference between men and women employees in terms of occupational burnout and its three dimensions. Moreover, a significant difference between administrative and medical staffs were found only in the dimension of emotional exhaustion. The mean score of emotional exhaustion in the administrative staff was significantly lower than that of their peers in the healthcare sector (2.03±0.84vs. 2.36±1.00 (p=0.03. Conclusions: The results showed that the majority of employees reported an average level of burnout .Such finding was in agreement with the results reported in previous studies. The obtained results can pave the way for further study on the identifying determinants of burnout.

Along with developments leading to the New Approach, it became clear that the insights from research on procedural justice deserve particular attention. The goals of the judge's actions in this respect are both that the proceedings are fair and just and that parties perceive the way they are being treated during proceedings as fair and just.Within the New Approach we discern five procedural justice elements: (1 respect, (2 voice and due consideration, (3 some influence on how proceedings will continue, (4 an explanation of how the proceedings will continue and (5 direct interpersonal contact.The introduction of the New Approach shows two important bottlenecks in Dutch administrative court proceedings, which are (i the possible or supposed collision between legally right outcomes and procedural justice and (ii the lack of uniformity and predictability.Although what we describe and discuss in this paper focuses on the Dutch situation, many of these considerations apply to administrative court proceedings in other countries. The themes and difficulties that face the administrative law judge seem to be common to many countries.
